 ——抵押权预告登记不因预告登记义务人的违约行为而失效

 [裁判要旨]
 预告登记后,能够进行不动产登记而未申请登记系预告登记义务人的违约行为所致,不产生预告登记失效的法律后果。预告登记权利人对设有抵押权预告登记的商品房能够申请办理抵押登记的起算时间,应为预告登记义务人领取房屋产权证书之日。
 [相关法条]
 中华人民共和国物权法》第二十条 当事人签订买卖房屋或者其他不动产物权的协议,为保障将来实现物权,按照约定可以向登记机构申请预告登记。预告登记后,未经预告登记的权利人同意,处分该不动产的,不发生物权效力。
 预告登记后,债权消灭或者自能够进行不动产登记之日起三个月内未申请登记的,预告登记失效。
 第一百八十七条  以本法第一百八十条第一款第一项至第三项规定的财产或者第五项规定的正在建造的建筑物抵押的,应当办理抵押登记。抵押权自登记时设立。
 中华人民共和国担保法》第四十四条 办理抵押物登记,应当向登记部门提供下列文件或者其复印件:
 (一)主合同和抵押合同;

 [基本案情]
 原告中国农业银行股份有限公司芜湖金桥支行(以下简称农行芜湖金桥支行)诉称:2010年11月12日,原告与被告张恒分别签订《住房公积金(委托贷款)借款合同》(以下简称公积金合同)和《个人购房担保借款合同》(以下简称借款合同)各一份。其中,公积金合同约定:被告张恒向原告借款125000元,借款期限240个月;借款合同约定:被告张恒向原告借款45000元,借款期限为360个月。被告张恒以位于安徽省芜湖市镜湖区长江湾1#楼1215室房屋为上述借款提供抵押担保,并办理了抵押(预告)登记;保证人芜湖市华安房地产开发有限责任公司(以下简称芜湖华安公司)提供阶段性连带责任担保。2011年1月28日,原告向被告张恒发放了公积金贷款及商业借款。被告张恒未能如约还款,虽经原告多次催要,仍未还款,被告芜湖华安公司亦未履行保证责任。为此,原告提起诉讼,请求判令:一、被告张恒立即偿还原告住房公积金委托借款本金104977. 4元、利息1400.72元、罚息5.54元、复利5.07元及自2016年2月22日起至实际清偿之日的罚息和复利;二、被告张恒立即偿还原告个人购房担保借款本金41899.82元、利息695.11元、罚息1. 11元、复利3.06元及自2016年2月22日起至实际清偿之日的罚息和利息;二、被告芜湖华安公司对被告张恒上述债务承担连带清偿责任;四、原告对被告张恒抵押房产(位于芜湖市镜湖区赤铸山西路长江湾1#楼1215室)折价或者拍卖、变卖的价款享有优先受偿权;五、被告张恒、芜湖华安公司共同承担原告实现债权费用8570元及本案诉讼费用。
