Defendant: Guo Qingwen, male, 28, born in Jiangdu, Jiangsu Province, farmer, residing in Youqiao village, Jinxi town, Jiangdu, and arrested on September 11, 1997.@#
On a charge of suspected production and sale of fake or substandard products, Guo Qingwen was prosecuted before the People's Court of Jiangdu by the People's Procuratorate of Jiangdu, Jiangsu Province.@#
Through open trial, the People's Court of Jiangdu found out:@#
In the first half of the year 1996, the defendant, Guo Qingwen, without either actual production capacity or registration with the authority on industry and commerce, rented part of the houses located in Yudai village, Yiling town, Jiangdu, for manufacturing battery production equipment. On July 15, in the name of Jiangdu Guangming Storage Batteries Factory (“Guangming Factory”) run by Yundai village, Guo Qingwen entered into a contract with Jiangsu Gourong Dahe Batteries Co., Ltd. (“Dahe Co.”), on the supply of R6-5 battery production equipment at a contractual price of 206,000 yuan, and the official seal of Guangming Factory was affixed thereon, through Wang Benchao, director of Guangming Factory and secretary of the Yundai village Sub-committee of the Communist Party. Later, Dahe Co. remitted 126,000 yuan as advance goods payment to the account of Guangming Factory, which was, however, withdrawn by Guo Qingwen by faking the signature of Wang Benchao. Guo Qingwen expended more than 50,000 yuan of it for purchasing used R6-5 battery production equipment from Suzhou Guangming Battery Parts Factory, Hai'an Battery Machinery Factory, Jiangdu No.3 Chemical Plant, etc., and also manufactured some parts on its own. After refurbishing and assembling the same, he passed off 14 sets of the battery production equipment as qualified products to Dahe Co. Determined by the Bureau of Technological Supervision of Jiangdu, such equipment did not possess the due performances, and was unqualified products.@#

郭庆文生产、销售伪劣产品案@#

被告人：郭庆文，男，２８岁，江苏省江都市人，农民，住江都市锦西镇尤桥村。１９９７年９月１１日被逮捕。@#
被告人郭庆文因涉嫌生产、销售伪劣产品罪，由江苏省江都市人民检察院向江都市人民法院提起公诉。@#
江都市人民法院经公开审理查明：@#
１９９６年上半年，被告人郭庆文在无实际生产能力并未经工商行政管理机关登记许可的情况下，租用江都市宜陵镇玉带村的部分房屋开办工厂，声称要制造生产电池的设备。７月１５日，郭庆文以玉带村开办的江都市光明蓄电池厂的名义，与江苏省句容市大禾电池有限公司签订了标的为２０．６万元的Ｒ６型５号电池生产设备购销合同，并通过玉带村党支部书记兼光明蓄电池厂厂长王本朝，盖了光明蓄电池厂公章。此后，大禾电池有限公司汇入光明蓄电池厂帐面的１２．６万元预付货款，被郭庆文冒充王本朝的签名取走。郭庆文用其中的５万余元，先后从苏州光明电池配件厂、海安县电池机械厂、江都市第三化工厂等单位购得废旧的Ｒ６型５号电池生产设备，自己也生产了部分零配件，经刷新、拼装后，冒充合格产品销售给大禾电池有限公司１４套。该设备经江都市技术监督局鉴定，不具备应有的使用性能，是不合格产品。@#
上述事实，有被告人郭庆文的供述，证人证言及工矿产品购销合同书、江都市技术监督局鉴定书等证据证实。@#

江都市人民法院认为，被告人郭庆文在无能力生产成套电池设备的情况下，用５万余元购买废旧产品进行刷新、拼装，冒充合作产品销售给用户后实际得款１２．６万元，其行为已触犯了《中华人民共和国刑法》第一百四十条的规定，构成生产、销售伪劣产品罪。江都市人民检察院指控的罪名成立，应予支持。据此，该院于１９９７年１２月２２日判决：@#
被告人郭庆文犯生产、销售伪劣产品罪，判处有期徒刑一年六个月；并处罚金１２．６万元。@#
一审宣判后，被告人郭庆文不服，以“系单位犯罪”、“应依照从旧兼从轻的原则，适用全国人大常委会《关于惩治生产、销售伪劣商品犯罪的决定》（以下简称决定）处罚”等为由，向江苏省扬州市中级人民法院提出上诉。@#
