| | 期货网上交易软件系统系期货公司提供给客户用于传达交易指令的工具，虽非期货公司设计和维护，但期货公司对之负有合同附随义务，应避免因自己提供的软件或服务损害客户的合法权益。接收客户交易指令的网关程序本身存在瑕疵，期货公司可以通过测试加以发现，并通过程序更新予以修补，但期货公司违反其应尽的注意义务，未经充分测试即将之提供客户使用，以致系统在交易期间发生故障，造成客户损失的，应当对客户损失承担相应的赔偿责任。 |

| | 邱某系甲期货公司客户，长期在甲期货公司进行期货交易。甲期货公司向其客户提供了电话交易和网上交易等多种交易方式，包括一款由乙公司设计和维护的网上期货交易软件。2010 年1 月7 日，期货市场开盘后，大连商品期货交易所多个期货合约的价格出现大幅下跌。当日上午10 时至10 时15 分，该网上交易系统出现客户登陆缓慢和无法正常登录交易的异常情况。甲期货公司经调查后，确定系乙公司提供的软件程序处理能力不足导致客户在该时段无法正常交易。嗣后，通过软件更新修补了上述系统漏洞。 |
