| | 原告蔡扁、戴阿宗诉称：2015年8月19日早上5时许，霞美镇山岭村村民戴文艺组织原告的儿子戴建镇及杜浔镇过洋村村民洪武标等5人到被告开放的水库钓鱼，10点左右原告戴阿宗接到戴文艺电话，被告知其儿子在钓鱼时落下水库，原告赶到现场时儿子戴建镇已经溺水。后雇用打捞人员才将戴建镇尸体打捞上岸，但已经死亡，据打捞人员讲述是被水库渔网缠饶才导致溺水死亡。案发后漳浦县公安局杜浔镇公安派出所干警曾到场调查，当时水库停放一无人看管的木质小船，洪武标划船载原告儿子戴建镇到离岸20余米的地方钓鱼，原告儿子在此过程中落水致身亡。原告到场时发现整个水库没有管理人员到场，水库四周也设有任何的安全警示标志，且放在水库的木质小船无人管理。综上，作为水库管理者的被告对开放的水库疏于管理，未设立安全警示标志，且将小船随意放置水库无人管理，导致原告儿子上船钓鱼并在此过程中落水身亡，对此被告存在严重过错，依法应承担主要赔偿责任。本案共造成原告损失如下：（1）死亡赔偿金253004元；（2）丧葬费27117.5元；（3）精神抚慰金8万元；（4）交通费2000元；（5）误工费5000元；（6）打捞尸体费用1万元，合计人民币377121元。请求依法判令被告赔偿原告上述各项损失人民币226272. 6元。 |
