| | （一）基本案情 |
| | 南平市总工会与南平博基房地产开发有限公司房屋拆迁安置补偿纠纷一案，福建省南平市延平区人民法院作出（2011）南民终字第412号民事判决：1.南平博基房地产开发有限公司于判决生效之日起十日内将南平市府前路36号延府豪庭2号楼五楼（原南平财富广场2、3、4号楼裙楼的五层）整层房产交付给南平市总工会。2.南平博基房地产开发有限公司于判决生效之日起十日内支付给南平市总工会逾期安置补偿费2887026元。3.驳回南平市总工会的其他诉讼请求。 |
| | 判决生效后，南平博基房地产开发有限公司未按期履行生效法律文书确定的还款义务，南平市总工会于2011年11月1日向延平区法院申请强制执行，该院于同日立案执行。 |
| | （二）执行情况 |
| | 案件立案执行后，延平区法院向被执行人南平博基房地产开发有限公司发出了执行通知书，后冻结了被执行人南平博基房地产开发有限公司的银行的账户及名下部分房产。执行法院组织双方当事人就房产交付及逾期安置补偿费进行协商。但是，被执行人南平博基房地产开发有限公司已将延府豪庭2号楼五楼200多平方米安排给延平区四鹤街道延福社区居委会作为社区办公用房，延福社区居委会经装修后搬入该场所办公，其认为社区办公用房是依规取得，不愿搬离。基于此种原因。应交付给南平市总工会的200多平方米房屋无法交付，案件执行陷入困境。 |
