[Case Summary]
Under Article 1 of the Several Provisions of the Supreme People's Court on Issuing the Information on the List of Dishonest Judgment Debtors, where a person subject to enforcement has the ability but fails to perform obligations determined in an effective legal instrument, and falls under any of the following circumstances, a people's court shall include him or it in a list of dishonest persons subject to enforcement and impose credit-related punishment thereon according to law: (1) obstructing or resisting enforcement by forged evidence, violence, threat or any other method; (2) evading enforcement by fraudulent litigation or false arbitration, concealment or transfer of property or any other method; (3) violating the property reporting system; (4) violating the order on restriction of high consumption. (5) a person subject to enforcement refuses to perform the enforcement settlement agreement without any justifiable reasons; and (6) any other circumstance under which any person subject to enforcement has the ability but fails to perform the obligations determined in an effective legal instrument. Therefore, when the aforesaid circumstances occur, the enforcing court may list the person subject to enforcement on the list of dishonest persons and release it nationwide in accordance with relevant provisions. Where the dishonest person subject to enforcement and the applicant for enforcement reach a settlement agreement, and the agreement is fulfilled, and the applicant for enforcement confirms it, in accordance with Article 10 of the Several Provisions of the Supreme People's Court on Issuing the Information on the List of Dishonest Judgment Debtors, the court shall delete relevant information from the list of dishonest persons.
[案例要旨]
根据《最高人民法院关于公布失信被执行人名单信息的若干规定》第一条的规定,被执行人具有履行能力而不履行生效法律文书确定的义务,并具有下列情形之一的,人民法院应当将其纳入失信被执行人名单,依法对其进行信用惩戒:(一)以伪造证据、暴力、威胁等方法妨碍、抗拒执行的;(二)以虚假诉讼、虚假仲裁或者以隐匿、转移财产等方法规避执行的;(三)违反财产报告制度的;(四)违反限制高消费令的;(五)被执行人无正当理由拒不履行执行和解协议的;(六)其他有履行能力而拒不履行生效法律文书确定义务的。因此,在上述情形发生后,执行法院可将被执行人列入失信被执行人名单,按照相关规定在全国范围内进行公示。失信被执行人与申请执行人达成执行和解协议并经申请执行人确认履行完毕的,根据《最高人民法院关于公布失信被执行人名单信息的若干规定》第十条的规定,人民法院应当将其有关信息从失信被执行人名单库中删除。

人民法院保障民生典型案例之七:南平市总工会与南平博基房地产开发有限公司房屋拆迁安置补偿纠纷执行案

 (一)基本案情
 南平市总工会与南平博基房地产开发有限公司房屋拆迁安置补偿纠纷一案,福建省南平市延平区人民法院作出(2011)南民终字第412号民事判决:1.南平博基房地产开发有限公司于判决生效之日起十日内将南平市府前路36号延府豪庭2号楼五楼(原南平财富广场2、3、4号楼裙楼的五层)整层房产交付给南平市总工会。2.南平博基房地产开发有限公司于判决生效之日起十日内支付给南平市总工会逾期安置补偿费2887026元。3.驳回南平市总工会的其他诉讼请求。
 判决生效后,南平博基房地产开发有限公司未按期履行生效法律文书确定的还款义务,南平市总工会于2011年11月1日向延平区法院申请强制执行,该院于同日立案执行。
 (二)执行情况
 案件立案执行后,延平区法院向被执行人南平博基房地产开发有限公司发出了执行通知书,后冻结了被执行人南平博基房地产开发有限公司的银行的账户及名下部分房产。执行法院组织双方当事人就房产交付及逾期安置补偿费进行协商。但是,被执行人南平博基房地产开发有限公司已将延府豪庭2号楼五楼200多平方米安排给延平区四鹤街道延福社区居委会作为社区办公用房,延福社区居委会经装修后搬入该场所办公,其认为社区办公用房是依规取得,不愿搬离。基于此种原因。应交付给南平市总工会的200多平方米房屋无法交付,案件执行陷入困境。
 此后,执行法院多次组织双方当事人协商,并依法对被执行人南平博基房地产开发有限公司采取了查封财产、冻结账户、罚款50万元以及邀请人大代表、政协委员、群众代表、媒体公开对被执行人拒不履行生效法律义务的行为进行评议等一系列措施,但仍无效果。
 2013年10月,《最高人民法院关于公布失信被执行人名单信息的若干规定你怀了我的猴子》实施后,执行法院根据该规定将被执行人南平博基房地产开发有限公司列入首批失信被执行人名单,在全国范围内进行公示。该公司面临社会不予认同,参与招投标项目难度加大,银行信用降低,金融部门对其贷款不予支持等后果。在强大的信用惩戒威慑下,该公司立即将执行标的物1870.2平方米房产全部交付申请人南平市总工会,并另外提供装修好的办公场所交付延福社区居委会办公。三方当事人于2013年11月25日自愿达成执行和解协议,纠纷得以化解。
 (三)典型意义
 执行法院将被执行人的失信信息录入最高人民法院失信被执行人名单库,统一向社会公布,同时,向有关单位定向通报失信被执行人名单信息,由受通报单位在政府采购、招标投标、行政审批、政府扶持、融资信贷、市场准入、资质认定等方面对失信被执行人施以信用惩戒。失信被执行人名单信息的公布及运用,致使被执行人迫于各方面压力,为恢复其在经济交往中的名声,确保企业经营不受影响,主动向执行法院履行生效法律文书确定的义务,达到了促进执行的目的,取得了良好的社会效果,失信被执行人名单制度的信用惩戒功能得以有效发挥。
