| | （一）基本案情 |
| | 侯广周作为河南安阳“德国华格纳生物晶片”专卖店经营者，向群众散发了盖有其本店印章的关于该产品的宣传页。糖尿病患者毕永振于2006年10月7日到侯广周经营的专卖店购买了华格纳生物晶片一块，价值2390元。毕永振配戴该产品后停止服用治疗糖尿病的药品。2007年3月，毕永振感到身体不适，经医院检查，查出其血糖升至14点，遂于2007年3月13日住院治疗，支付医疗费19167.96元，其中个人支付2919.24元。2007年6月22日，毕永振在观看了《今日说法》栏目关于对“德国华格纳生物晶片”利用虚假广告等相关报道后到当地工商所投诉，工商所对被告经营的专卖店采取了暂扣有关资料和物品，责令专卖店退给消费者现款等行政措施。因调解不成，毕永振遂向河南省安阳市北关区人民法院起诉，要求侯广周返还购物款2390元，并给付加倍赔偿款2390元。 |
