被告人陈永林、陈祖培，因走私大熊猫皮一案，广东省广州市人民检察院于１９８７年１１月３日向广州市中级人民法院提起公诉。同年１１月１１日，广州市中级人民法院依法组成合议庭，进行公开审理。经审理查明：@#
１９８６年１２月间，被告人陈永林、陈祖培合资购买“宝安５４０１３”号机船一艘。１９８７年１月１２日，陈永林依约前往深圳与香港走私分子陈耀福（在逃）会晤。陈耀福委托陈永林偷运珍稀动物皮１张到香港。陈永林表示同意。当日，陈永林将陈耀福之托告知陈祖培，陈祖培亦表示同意。当日晚９时话，陈永林与陈祖培依约前往深圳湾大酒店会见陈耀福。经密谋，双方商定交接私货时间、地点。１月１３日中午，陈耀福在深圳蛇口将１张熊猫皮装在尼龙袋内，交给陈永林和陈祖培。陈永林指使陈祖培将尼龙袋藏于机船的夹层暗仓内。随之，两人驾船避开海关监督，非法从珠江口偷运出境。当船行至大铲岛附近海面时，被广州海关人赃俱获。@#
上述事实，有证人证言，查获的赃物等证实，被告人陈永林、陈祖培亦供认不讳，足以认定。@#
