对于发生在房屋登记制度尚不完善时的案件，在双方没有订立书面协议时，确认房屋买卖关系是否存在，应结合实际履行情况，考虑买受人是否支付了对价，房屋价值与支付的价格是否合理，出卖人交付房屋及房屋所有权证书或买受人对房屋是否长期占有，在此期间出卖人是否主张过权利，能否排除借用或租赁等关系，在此基础上进行综合分析判断。@#

张致清申请再审称，1．原再审判决认定张致清与新华服务公司存在房屋买卖关系，属于认定事实错误，证据不足。2．原再审判决认定张致清无合理理由长达20余年未主张权利，即丧失房屋所有权，不仅与事实不符，而且适用法律错误。3.原再审判决认定冯照霞提交的证据较张致清一方的证据更占优势完全与事实不符，明显偏颇。请求依照《中华人民共和国民事诉讼法》第一百七十九条第一款第(二)项、第(六)项的规定对本案再审。@#
