原告辽宁省证券公司、中国农业银行辽宁省信托投资公司；中国工商银行辽宁省股份信托投资公司、辽宁省国际信托投资公司、辽宁信托投资公司（以下简称五原告）因与被告辽宁省轻工业供销公司（以下简称供销公司）、沈阳油脂化学厂（以下简称化学厂）融资债券纠纷案，向辽宁省高级人民法院提起诉讼。 |
The five plaintiffs alleged: On May 30, 1992, the five plaintiffs jointly issued 60 million Yuan of enterprise bonds on behalf of Supply and Marketing Company. The term was one year, and the annual interest rate was 9.072%. Chemical Plant guaranteed that, after the term of the contract expires, Supply and Marketing Company would only pay 2.7 million Yuan of interest to the five plaintiffs. Therefore, the five plaintiffs pleaded the court to order the defendants to repay 63,343,200 Yuan of due principal and interest, and to bear the liabilities for breach of contract. | |
五原告诉称：１９９２年５月３０日，五原告联合为被告供销公司发行６０００万元人民币的企业债券，期限一年，年利率９．０７２％。被告化学厂担保。合同期满后，供销公司只给付五原告利息２７０万元。故要求判令被告偿还６３３４．３２万元的到期本息，并承担违约责任。 |
Supply and Marketing Company argued: The main cause for defaulting the plaintiffs' principal and interest was that the five plaintiffs were liable for the dispute as they failed to continue issuing the bonds according to the approval document of the People's Bank of China, Liaoning Branch. Supply and Marketing Company requested postponement of repayment.
