| | 原告薛华克诉称：其创作了“藏人”、“塔吉克人”等系列摄影作品并多次结集出版、展览。2005年，其与燕娅娅相识，燕娅娅以欣赏为由向其索要作品，其遂将一些作品的洗印件、书籍赠与燕娅娅。但发现燕娅娅擅自将其创作的摄影作品《次仁卓玛》演绎为油画作品《阿妈与达娃》并进行展览、出版，并委托翰海拍卖公司拍卖了上述作品。燕娅娅的上述行为侵犯了其对作品享有的改编权，翰海拍卖公司拍卖侵权作品亦构成侵权。故诉至法院，请求判令燕娅娅停止侵权，在《中国摄影报》及一家全国性美术报刊上公开赔礼道歉，赔偿经济损失1.5万元，与翰海拍卖公司共同收回已拍卖成交的侵权作品并予以销毁。 |
