| | 2008年3月1日，钜泉公司完成了名称为“ATT7021AU”的布图设计创作，同年进行布图设计登记。两被告制造、销售RN8209、RN8209G芯片。锐能微公司网站显示：2010年9月RN8209销售量突破1，000万片。从锐能微公司查封的部分增值税专用发票显示销售RN8209G芯片1，120片，单价在5.50元至4.80元之间；销售RN8209芯片6，610片，单价在4.80元至4.20元之间。经委托鉴定，鉴定结论为：1、RN8209、RN8209G与原告主张的独创点5（数字地轨与模拟地轨衔接的布图）相同；2、RN8209、RN8209G与原告主张的独创点7（模拟数字转换电路的布图）中第二区段独立升压器电路的布图相同；3、依据现有证据应认定上述1、2点具有独创性，不是常规设计。 |
