The plaintiff, Zhongjitongyong Import and Export Co. Ltd. (hereinafter referred to as Zhongji), filed a complaint at Tianjin Maritime Court against Tianjin No.2 Port Co. Ltd. (hereinafter referred to Port No.2) concerning their dispute over the port work contract.@#
Zhongji claims: On 19 August 1997, Zhongji, upon notice by Port No. 2, transported its cargo for export to the dock of Port No. 2, in order to load it onto the ship on 20 August according to their port work contract. Port No. 2 provided a receipt for all the cargo it had received from Zhongji. On 20 August, Storm No. 9711 landed. Although having received storm forecast, Port No.2 did not take any preventive measures; as a result, the cargo of Zhongji was soaked in tidewater and no longer usable. Zhongji suffered a total loss of 5,622,840 RMB. Port No. 2 rejected to compensate this loss for reason of force majeure. Zhongji believes that bad weather does not constitute force majeure nowadays when technology has so well developed. Therefore, Port No. 2 cannot be released from its liability for the cargo losses.@#

原告中机通用进出口公司(以下简称中机公司)因与被告天津港务局第二港埠有限公司(以下简称港埠公司)发生港口作业合同纠纷,向天津海事法院提起诉讼。@#
原告诉称:1997年8月19日,原告按照被告的通知,将原告的出口货物运抵被告的码头,准备按港口作业合同的约定于8月20日装船,被告出具了收到原告全部货物的收据。8月20日,9711号风暴登陆。被告在事先接到预报的情况下,对原告的货物不采取任何防范措施,致使原告的货物被海潮浸泡,无法继续使用,给原告造成损失5622840元。事后,被告以“损失是不可抗力造成的”为由拒绝赔偿。原告认为,在科技发达的今天,已经预报的恶劣气候,不再构成不能预见的不可抗力,被告不能以此来责任。请求判令被告承担赔偿损失的责任。@#
被告辩称:(一)原告所称货物受损的事实存在,但这批货物是被告根据与案外人天津市开发区新星贸易公司(以下简称新星公司)签订的港口作业合同,为新星公司进行的港口作业。原告与被告之间不存在任何合同关系。假如被告在此次港口作业合同中有过错,也应当由合同的另一方新星公司向被告提起诉讼,他人无权起诉被告;(二)被告只能根据国家海洋局预报中心的预报采取应急措施,并且事实上已经采取了防范措施。只是由于到来的海潮超出预报的高度并伴有雨,尽管被告尽了最大的努力,仍然无法避免这批货物受损。这种损失确属由不能预见、不能克服、不能避免的不可抗力造成,被告依法不应该承担赔偿责任。@#
天津海事法院经审理查明:@#
原告中机公司为了出口三聚磷钠和乙炔黑,与案外人新星公司签订货运代理合同,约定委托新星公司以新星公司的名义向被告港埠公司申报集港计划,办理货物交接,支付港杂费等。新星公司向港埠公司申报货物集港计划后,港埠公司通知新星公司于1997年8月18日集港。当日,新星公司通知中机公司将三聚磷钠2498吨集港,次日上午又将三聚磷钠94吨、乙炔黑150吨集港。这些货物被港埠公司分别安排在其所属的标高为5.1米-5.3米的二场、三场、七场等场地存放,准备装船。8月20日15:54时,受9711号风暴的影响,有1074吨三聚磷钠和43.3吨乙炔黑被海水浸泡受损。16:30时,港埠公司将货物被海水浸泡的情况通知了新星公司,并于8月22日出具货损证明。@#
关于9711号风暴,国家海洋局预报中心于1997年8月19日8时发出第一次预报,预报受9711号风暴的影响,8月19日16:00时潮高将达5.10米,而实际到8月19日16:30时,潮高为4.82米。8月19日16:00时,国家海洋局预报中心发出第二次预报,预报8月20日04:00时,潮高将达5.20米,而实际到8月20日04:04时,潮高为4.96米.8月20日8时,国家海洋局预报中心发出第三次预报,预报8月20日16:50时潮高将达5.30米,而实际到8月20日15:54时,潮高为5.59米。另据天津市塘沽区气象局的气象技术咨询报告证实,9711号风暴来临过程中,天津塘沽新港在8月20日01:28时至01:35时、04:17时至18:06时有雨,同时伴有短时8级以上大风。@#
被告港埠公司于1997年8月19日上午10点左右收到关于9711号风暴的警报后,对库存的39612.078吨货物采取了如下措施:装火车疏运1500余吨,搬倒1200余吨,货物的种类是机械设备、卷铁、大麦、鱼粉等。海潮来临前,港埠公司没有对原告中机公司所属的货物采取措施。除中机公司的货物受损外,存放于港埠公司库场内的他人货物也有被海水不同程度浸泡的现象。@#
