关于加强人民法院审判管理工作的若干意见 |
To further strengthen the administration of trials by the people's courts, regulate judicial practice, improve the quality and efficiency of the judicial work, and realize the general objective of justice: impartiality, honesty and for the people, the following opinions are put forward in accordance with the Organic Law of the People's Courts, Judges Law and other relevant judicial interpretations and in light of the actualities of the judicial work of the people's courts: | |
为进一步加强人民法院审判管理，规范司法行为，提高审判工作的质量和效率，实现司法公正、廉洁、为民总目标，根据人民法院组织法、法官法等法律以及有关司法解释的规定，结合人民法院审判工作实际，提出如下意见： |

| I. Overview of trial administration | | |

|
| 1. To strengthen the administration of trials is an inevitable demand for practicing the guiding thought of “three top priorities” and the working theme of “serving the primary objectives and administering justice for the people” and implementing the work policies of “being strict in administering the people's courts, ensuring public trust in the people's courts and building up the people's courts through science and technology”, and an important measure to promote the three major tasks and realize the scientific development of the work of people's courts in the new era. The people's courts at all levels shall, guided by the spirit of being highly responsible for the Party and the people, for the Constitution, the law and for the trial cause, intensify their consciousness of administration, and make more efforts to give full play to the role of trial administration in regulating, guaranteeing, promoting and serving trials. | | 1．加强审判管理，是践行“三个至上”工作指导思想和“为大局服务，为人民司法”工作主题，落实“从严治院、公信立院、科技强院”工作方针的必然要求，是推进三项重点工作，实现新时期人民法院工作科学发展的重要举措。各级人民法院要本着对党和人民高度负责、对宪法法律高度负责、对审判事业高度负责的精神，强化管理意识，加大工作力度，充分发挥审判管理规范、保障、促进、服务审判的作用。 |

| 2. The people's courts shall, when carrying out trial administration, apply such methods as organization, leading, guidance, evaluation, supervision, restriction, etc., properly arrange the judicial work, strictly normalize the judicial process, scientifically appraise the quality and efficiency of the judicial work, and effectively integrate the judicial resources so as to ensure judicial impartiality, honesty and high-efficiency. | | 2．人民法院开展审判管理，要运用组织、领导、指导、评价、监督、制约等方法，对审判工作进行合理安排，对审判过程进行严格规范，对审判质效进行科学考评，对司法资源进行有效整合，确保司法公正、廉洁、高效。 |

| II. Basic requirements for trial administration | | 二、审判管理基本要求 |

| 3. We shall, when carrying out trial administration, base the administration on law, determine the duties relating to trial administration in strict accordance with the laws and judicial interpretations, strike a balance between administration and trial, and avoid intervention in the lawful handling of cases by the specific trial departments and judicial personnel by going beyond the laws while strengthening the supervision and restriction over the trial activities. We shall, in the process of trial administration, correctly define the scope of management functions and other functions so as to ensure that the administration is carried out into full effect but without overstepping the duties of administration, and have the courage to manage the matters which fall under the duties of trial administration. The matters involving the management of other functional departments in the trial administration shall be handled by the other functional departments. | | 3．开展审判管理，要坚持以法律为依据，严格依照法律、司法解释的规定确定审判管理的职责，处理好管理与审判的关系，既要加强对审判活动的监督与制约，又要防止超越法律规定干预审判业务部门及审判人员依法办案。开展审判管理，要正确界定管理职能与其他职能的职责范围，管理既要到位，又不能越位，属于审判管理的职责事项要大胆管理，审判管理中涉及其他职能部门管理的事项，应当由其他职能部门处理。 |

| 4. The trial administration shall be carried out under the guidance of the Scientific Outlook on Development and by adhering to overall planning with all factors being considered. The administration shall cover all staff members, under which the presidents, divisional chief judges, presiding judges and judicial personnel are all subjects of trial administration whose rights, obligations and job responsibilities shall be clarified. We shall adhere to the whole-process administration, manage and supervise each link in the judicial process from case-filing to the dispatch of cases, time arrangement, court sessions, judgment and enforcement, and guarantee that the judicial process is rigorous, standard, open and transparent, and the trial results are impartial and efficient. We shall adhere to all-round administration, strengthen the administration of trial effects while strengthening the administration of the quality and efficiency of trial, strive to resolve all issues upon closing a case, and realize the organic unification of the legal effects and social effects of case handling. | | 4．开展审判管理，要以科学发展观为指导，坚持统筹兼顾。要坚持全员管理，院长、庭长、审判长以及审判人员都是审判管理的主体，各个管理主体都要明确权利义务和岗位职责。要坚持全程管理，从立案到分案、排期、开庭、裁判、执行等各个审判环节都应当进行管理和监督，确保审判过程严谨规范、公开透明，审判结果公正高效。要坚持全面管理，既要加强审判质量和效率的管理，又要加强审判效果的管理，努力做到案结事了，实现办案的法律效果与社会效果的有机统一。 |

| 5. We shall make efforts to improve the hierarchical management system of the internal people's courts in carrying out trial administration. The judicial committees and presidents shall be responsible for the macroscopic administration of the judicial work, correctly research and judge the trend of the judicial work, sum up judicial experiences, and timely find out and handle the problems emerged in the judicial work. The presidents, divisional chief judges and presiding judges shall be effectively responsible for managing the judges and cases at the same time of supervising and guiding the case handling according to law, and implement all systems and work requirements for managing the trial quality, trial efficiency and trial effects in each link of the trial of cases. | | 5．开展审判管理，要着力完善人民法院内部的层级管理体系。审判委员会、院长要承担对审判工作进行宏观管理的职责，准确研判审判工作运行态势，总结审判经验，及时发现并处理审判工作中出现的问题。院长、庭长、审判长要在依法监督指导办案的同时，切实承担起管理法官、管理案件的职责，要把审判质量管理、审判效率管理和审判效果管理等各项制度和工作要求落实到案件审理的各个环节之中。 |

6. We shall, when carrying out trial administration, effectively strengthen the administration of the level of trial of the people's courts at lower levels, and improve the overall effectiveness of the judicial work of the people's courts. The people's courts at higher levels shall make in-depth analysis and research of the general situation of the judicial work within their own jurisdictions, strengthen the macroscopic guidance to the people's courts at lower levels, and promote the concerted development of the judicial work. We shall, by reviewing cases, holding trial business meetings and deliberating typical cases, timely sum up experiences, unify the application of law, unify the standards for judgment, and improve the overall judicial level.
．．．．．． | | 6．开展审判管理，要切实加强对下级人民法院的审级管理，提高人民法院审判工作的整体效能。上级人民法院要深入分析研究辖区内审判工作的整体态势，加强对下级人民法院的宏观指导，推动审判工作协调发展。要通过审理案件、召开审判业务会议、研讨典型案件等形式，及时总结经验，统一法律适用，统一裁判尺度，提高整体司法水平。
