To punish the criminal activities of internet gambling according to law, we hereby, in accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Interpretation of the Supreme People's Court and Supreme People's Procuratorate on Several Issues concerning the Specific Application of Law in the Handling of Gambling Criminal Cases and other relevant provisions, and in light of judicial practice, put forward the following opinions on several issues concerning the application of law in the handling of criminal cases of internet gambling: | |
为依法惩治网络赌博犯罪活动，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》和最高人民法院、最高人民检察院《关于办理赌博刑事案件具体应用法律若干问题的解释》等有关规定，结合司法实践，现就办理网络赌博犯罪案件适用法律的若干问题，提出如下意见： |

| I. Conviction and sentencing criteria for the crime of running an online gambling house | | 一、关于网上开设赌场犯罪的定罪量刑标准 |
Whoever transmits gambling video or data and organizes gambling activities via internet, mobile communication terminals, etc., and falls under any of the following circumstances shall be deemed to have “run a gambling house” as mentioned in Paragraph 2 of Article 303 of the Criminal Law: | |
利用互联网、移动通讯终端等传输赌博视频、数据，组织赌博活动，具有下列情形之一的，属于刑法第三百零三条第二款规定的“开设赌场”行为： |

| (1) establishing a gambling website and accepting bets; | | （一）建立赌博网站并接受投注的； |
| |
|
| (2) establishing a gambling website and providing it for others to organize gambling; | | （二）建立赌博网站并提供给他人组织赌博的； |
| |
|
| (3) acting as an agent of a gambling website and accepting bets; or | | （三）为赌博网站担任代理并接受投注的； |
| |
|
| (4) participating in the profit sharing of a gambling website. | | （四）参与赌博网站利润分成的。 |
Any of the following circumstances, when one commits any of the acts as mentioned in the preceding Paragraph, shall be deemed as a “serious circumstance” as mentioned in Paragraph 2 of Article 303 of the Criminal Law: | |
实施前款规定的行为，具有下列情形之一的，应当认定为刑法第三百零三条第二款规定的“情节严重”： |

| (1) he reaps easy gains in an accumulative amount of more than 30,000 yuan by taking a percentage from the stakes; | | （一）抽头渔利数额累计达到3万元以上的； |
| |
|
| (2) the accumulative amount of stakes is more than 300, 000 yuan; | | （二）赌资数额累计达到30万元以上的； |
| |
|
| (3) the accumulative number of gamblers is more than 120; | | （三）参赌人数累计达到120人以上的； |
| |
|
| (4) he establishes a gambling website and provides it for others to organize gambling, and the amount of illegal gains he obtains therefrom is more than 30,000 yuan; | | （四）建立赌博网站后通过提供给他人组织赌博，违法所得数额在3万元以上的； |
| |
|
(5) he participates in the profit sharing of a gambling website and the amount of illegal gains he obtains therefrom is more than 30,000 yuan;
