| Chapter I General Provisions | | 第一章 总则 |
Article 1 For the purposes of strengthening the management of Internet information content and promoting the sound and orderly development of Internet news information services, these Provisions are developed in accordance with the Cybersecurity Law of the People's Republic of China, the Administrative Measures for Internet Information Services, and the Notice of the State Council on Authorizing the State Internet Information Office to Be Responsible for the Management of Internet Information Content | | 第一条 为加强互联网信息内容管理，促进互联网新闻信息服务健康有序发展，根据《中华人民共和国网络安全法》《互联网信息服务管理办法》《国务院关于授权国家互联网信息办公室负责互联网信息内容管理工作的通知》，制定本规定。 |
| Article 2 Internet news information services shall be governed by these Provisions within the territory of the People's Republic of China. | | 第二条 在中华人民共和国境内提供互联网新闻信息服务，适用本规定。 |
| For the purpose of these Provisions, news information includes the reports and comments on political, economic, military, diplomatic and other social and public affairs, and the reports and comments on relevant social emergencies. | | 本规定所称新闻信息，包括有关政治、经济、军事、外交等社会公共事务的报道、评论，以及有关社会突发事件的报道、评论。 |
| Article 3 Internet news information service providers shall comply with the Constitution, laws and administrative regulations, insist on the direction of serving the people and serving the socialism, adhere to the correct guidance of public opinions, play the supervisory role of public opinions, promote the formation of positive and sound cyber culture towards kindness, and protect national interests and public interests. | | 第三条 提供互联网新闻信息服务，应当遵守宪法、法律和行政法规，坚持为人民服务、为社会主义服务的方向，坚持正确舆论导向，发挥舆论监督作用，促进形成积极健康、向上向善的网络文化，维护国家利益和公共利益。 |
| Article 4 The Cyberspace Administration of China shall be responsible for the law enforcement work concerned in the supervision and administration of Internet news information services across the country according to their functions. The local cyberspace administrations shall be responsible for the law enforcement work concerned in the supervision and administration of Internet news information services within their respective administrative regions according to their functions. | | 第四条 国家互联网信息办公室负责全国互联网新闻信息服务的监督管理执法工作。地方互联网信息办公室依据职责负责本行政区域内互联网新闻信息服务的监督管理执法工作。 |
| Chapter II Permission | | 第二章 许可 |
| Article 5 To provide Internet news information services through Internet websites, apps, forums, blogs, microblogs, public accounts, instant communication tools, Internet broadcast and other forms to the public, a permit for Internet news information services shall be obtained, and activities of providing Internet news information services without a permit or beyond the scope permitted shall be prohibited. | | 第五条 通过互联网站、应用程序、论坛、博客、微博客、公众账号、即时通信工具、网络直播等形式向社会公众提供互联网新闻信息服务，应当取得互联网新闻信息服务许可，禁止未经许可或超越许可范围开展互联网新闻信息服务活动。 |
| For the purpose of the preceding paragraph, Internet news information services include the services of collecting, editing, issuing and transloading Internet news information and the services of transmission platforms. | | 前款所称互联网新闻信息服务，包括互联网新闻信息采编发布服务、转载服务、传播平台服务。 |
| Article 6 An applicant for a permit for Internet news information services shall meet the following conditions: | | 第六条 申请互联网新闻信息服务许可，应当具备下列条件： |
| (1) It shall be a legal person lawfully formed within the territory of the People's Republic of China. | | （一）在中华人民共和国境内依法设立的法人； |
| (2) Its primary person in charge and chief editor shall be Chinese citizens. | | （二）主要负责人、总编辑是中国公民； |
| (3) It has full-time news editors, content reviewers and technical support personnel who are suitable for the services. | | （三）有与服务相适应的专职新闻编辑人员、内容审核人员和技术保障人员； |
| (4) It has a sound Internet news information service management system. | | （四）有健全的互联网新闻信息服务管理制度； |
| (5) It has a sound information safety management system and safe and controllable technical support measures. | | （五）有健全的信息安全管理制度和安全可控的技术保障措施； |
| (6) It has places, facilities and funds that are compatible with the services. | | （六）有与服务相适应的场所、设施和资金。 |
| An applicant for a permit for Internet news information collecting, editing and issuing services shall be a news entity (including an entity in which it holds controlling shares) or an entity under the charge of the news publicity department. | | 申请互联网新闻信息采编发布服务许可的，应当是新闻单位（含其控股的单位）或新闻宣传部门主管的单位。 |
| Internet news information service providers meeting the said conditions shall implement the system of special management shares, and the specific implementation measures shall be separately developed by the Cyberspace Administration of China. | | 符合条件的互联网新闻信息服务提供者实行特殊管理股制度，具体实施办法由国家互联网信息办公室另行制定。 |
| To provide Internet news information services, an entity shall also undergo the formalities for permission or recordation of Internet information services with the competent telecommunications department according to the law. | | 提供互联网新闻信息服务，还应当依法向电信主管部门办理互联网信息服务许可或备案手续。 |
| Article 7 No organization may form any Sino-foreign equity joint venture, Sino-foreign cooperative joint venture or foreign-funded enterprise to provide Internet news information services. | | 第七条 任何组织不得设立中外合资经营、中外合作经营和外资经营的互联网新闻信息服务单位。 |
| An Internet news information service entity that cooperates with any domestic or foreign Sino-foreign equity joint venture, Sino-foreign cooperative joint venture and foreign-funded enterprise on businesses involving Internet news information services shall report to the Cyberspace Administration of China for safety assessment. | | 互联网新闻信息服务单位与境内外中外合资经营、中外合作经营和外资经营的企业进行涉及互联网新闻信息服务业务的合作，应当报经国家互联网信息办公室进行安全评估。 |
| Article 8 Internet news information service providers shall separate collecting and editing of news from their business operations, and non-public capital shall not intervene in the collecting or editing of Internet news information. | | 第八条 互联网新闻信息服务提供者的采编业务和经营业务应当分开，非公有资本不得介入互联网新闻信息采编业务。 |
Article 9 An application for a permit for Internet news information services filed by a press entity under the Central Government (including an entity in which it holds controlling shares) or an entity under the administration of a news publicity department under the Central Government shall be accepted and decided by the Cyberspace Administration of China; an application filed by a local news entity (including an entity in which it holds controlling shares) or an entity under the administration of a local news publicity department shall be accepted and decided by the cyberspace administration of the local province, autonomous region or municipality directly under the Central Government; and an application filed by any other entity shall be decided by the Cyberspace Administration of China after it is accepted and preliminarily reviewed by the cyberspace administration of a province, autonomous region or municipality directly under the Central Government at the place where it is located.
