| Chapter I General Provisions | | 第一章 总则 |
| Article 1 In order to effectively strengthen and further standardize the administration of direct investment projects within central budget, improve the scientific and democratic investment decision-making mechanism, and increase investment returns, these Measures are formulated in accordance with the Decision of the State Council on Reforming the Investment System and relevant laws and regulations. | | 第一条 为切实加强和进一步规范中央预算内直接投资项目管理，健全科学、民主的投资决策机制，提高投资效益，依据《国务院关于投资体制改革的决定》和有关法律法规，制定本办法。 |
| Article 2 For the purpose of these Measures, “direct investment projects within central budget (hereinafter referred to as “direct investment projects” or “projects”)” means non-productive fixed-asset investment projects of the Central Finance (including central departments and the local offices, entities subject to vertical administration and subordinate public institutions thereof) invested in and constructed within central budget as arranged by the National Development and Reform Commission (“NDRC”). | | 第二条 本办法所称中央预算内直接投资项目（以下简称直接投资项目或者项目），是指国家发展改革委安排中央预算内投资建设的中央本级（包括中央部门及其派出机构、垂直管理单位、所属事业单位）非经营性固定资产投资项目。 |
| The construction projects of office buildings of party and government organs shall be strictly administered in accordance with the provisions of the CPC Central Committee and the State Council. | | 党政机关办公楼建设项目按照党中央、国务院规定严格管理。 |
| Article 3 Direct investment projects shall be subject to the examination and approval system which includes the approval of proposals, feasibility study reports and preliminary designs. For projects to be constructed under special circumstances or with great impacts, construction start reports need to be approved in addition. | | 第三条 直接投资项目实行审批制，包括审批项目建议书、可行性研究报告、初步设计。情况特殊、影响重大的项目，需要审批开工报告。 |
| For projects approved by the State Council and the NDRC, which have been determined in special plans, live up to the requirements of project proposals in terms of preliminary work depth, and feature simple construction content and small investment scale, feasibility study reports may be prepared directly, or project proposals may be prepared in a consolidated manner. | | 国务院、国家发展改革委批准的专项规划中已经明确、前期工作深度达到项目建议书要求、建设内容简单、投资规模较小的项目，可以直接编报可行性研究报告，或者合并编报项目建议书。 |
| Article 4 To apply for the arrangement of the projects with central budgetary investment of 30 million yuan or more, as well as the projects for which overall arrangements need to be madeamong different regions, different departments and different fields, the application shall be examined and approved by the NDRC or by the relevant central department as authorized by the NDRC, and the particularly important projects among them shall be examined by the NDRC and then reported to the State Council for approval. The other projects shall be examined and approved by the relevant central departments according to the affiliation, after which a copy thereof shall be sent to the NDRC. | | 第四条 申请安排中央预算内投资 3000 万元及以上的项目，以及需要跨地区、跨部门、跨领域统筹的项目，由国家发展改革委审批或者由国家发展改革委委托中央有关部门审批，其中特别重大项目由国家发展改革委核报国务院批准；其余项目按照隶属关系，由中央有关部门审批后抄送国家发展改革委。 |
| For projects approved in accordance with prescribed authorities and procedures, the NDRC shall, in the process of preparation of annual plans, make overall arrangements of the investments within central budget. | | 按照规定权限和程序批准的项目，国家发展改革委在编制年度计划时统筹安排中央预算内投资。 |
| Article 5 In the examination and approval of direct investment projects, engineering consulting agencies with corresponding qualification shall generally be authorized to evaluate project proposals and feasibility study reports. Particularly important projects shall be subject to the expert appraisal system. | | 第五条 审批直接投资项目时，一般应当委托具备相应资质的工程咨询机构对项目建议书、可行性研究报告进行评估。特别重大的项目实行专家评议制度。 |
| Article 6 Direct investment projects shall comply with the relevant construction standards and norms of the state in the process of the preparation, examination and approval of feasibility study reports, preliminary designs and investment budgetary estimates and of the project construction. | | 第六条 直接投资项目在可行性研究报告、初步设计及投资概算的编制、审批以及建设过程中，应当符合国家有关建设标准和规范。 |
| Article 7 The NDRC shall establish the joint and cooperative mechanism with public finance, urban and rural planning, land and resources, environmental protection, financial regulation, industrial management and other departments to achieve information sharing. | | 第七条 发展改革委与财政、城乡规划、国土资源、环境保护、金融监管、行业管理等部门建立联动机制，实现信息共享。 |
| With respect to any direct investment project that does not involve national security and state secrets or its disclosure is not prohibited by any law or regulation, the examination and approval department shall, in accordance with the relevant provisions on disclosure of government information, disclose to the public the information on the approval thereof. | | 凡不涉及国家安全和国家秘密、法律法规未禁止公开的直接投资项目，审批部门应当按照政府信息公开的有关规定，将项目审批情况向社会公开。 |

| Chapter II Project Decision-making | | 第二章 项目决策 |
| Article 8 The NDRC and relevant central departments shall prepare special plans for projects in the fields where the preparation of plans is appropriate. The special plans approved according to prescribed authorities and procedures shall serve as an important basis for project decision-making. | | 第八条 适宜编制规划的领域，国家发展改革委和中央有关部门应当编制专项规划。按照规定权限和程序批准的专项规划，是项目决策的重要依据。 |
| Article 9 The NDRC shall, in conjunction with relevant departments, establish the projects repository which serves as an important basis for project decision-making and annual plans and arrangements. | | 第九条 国家发展改革委会同有关部门建立项目储备库，作为项目决策和年度计划安排的重要依据。 |
| Article 10 A project proposal shall conduct preliminary analysis on the necessity of project construction, main construction contents, the site and scale of the project to be constructed, rough calculation of investment, fund raising, social benefits and economic returns, among others, and attach relevant documents and materials. The preparation format for and the contents and depth of a project proposal shall meet the prescribed requirements. | | 第十条 项目建议书要对项目建设的必要性、主要建设内容、拟建地点、拟建规模、投资匡算、资金筹措以及社会效益和经济效益等进行初步分析，并附相关文件资料。项目建议书的编制格式、内容和深度应当达到规定要求。 |
| The proposal for a project which shall be examined and approved by the NDRC shall be prepared by aGrade A engineering consulting agency with corresponding qualification. | | 由国家发展改革委负责审批的项目，其项目建议书应当由具备相应资质的甲级工程咨询机构编制。 |
| Article 11 After the completion of preparation of a project proposal, the project entity shall submit it to the project examination and approval department for approval according to prescribed procedures. A project examination and approval department shall approve the proposal of a project which complies with relevant provisions and is truly necessary to be constructed, and send a copy of the approval document to the urban and rural planning, land and resources, environmental protection and other departments. | | 第十一条 |
| A project examination and approval department may provide for, in the approval document for a project proposal, the valid period of the approval document. | | 项目审批部门可以在项目建议书批复文件中规定批复文件的有效期。 |
| Article 12 Project entities shall, according to the approval documents for project proposals, organize the implementation of feasibility studies, and apply to urban and rural planning, land and resources, environmental protection and other departments for handling the planning and site selection,pre-examination of land use, environmental impact assessment and other approval formalities in accordance with the provisions. | | 第十二条 项目单位依据项目建议书批复文件，组织开展可行性研究，并按照规定向城乡规划、国土资源、环境保护等部门申请办理规划选址、用地预审、环境影响评价等审批手续。 |
| Article 13 Project examination and approval departments shall, after approving project proposals, publicize them in accordance with relevant provisions. The main opinions and suggestions solicited during the publicity period shall serve as important references for the preparation and approval of feasibility study reports of projects. | | 第十三条 项目审批部门在批准项目建议书之后，应当按照有关规定进行公示。公示期间征集到的主要意见和建议，作为编制和审批项目可行性研究报告的重要参考。 |
Article 14 After obtaining the approval of project proposals, project entities shall authorize engineering consulting agencies to prepare feasibility study reports, conduct an comprehensive analysis and demonstration on the project feasibility in terms of technology and economy and on social benefits, energy conservation, comprehensive utilization of resources, ecological environmental impacts and social stability risks, among others, and implement various guarantee conditions for construction and operation, and shall obtain relevant licenses and examination opinions in accordance with relevant provisions. The preparation formats for and the contents and the depths of feasibility study reports shall meet the prescribed requirements.
