全国地方各级人民法院、人民检察院，各级军事法院、检察院，各铁路运输中级法院和基层法院、检察院，各海事法院、检察院，新疆生产建设兵团各级法院、检察院： |
To implement and improve the rule of having the chief procurator or the deputy chief procurator entrusted by the chief procurator of the people's procuratorate observe the meeting of the judicial committee of the people's court is one of the reforms prescribed by document No.28 [2008] of the CCCPC. The Supreme People's Court and the Supreme People's Procuratorate have, based on thorough investigation and study, formulated the Opinions of the Supreme People's Court and the Supreme People's Procuratorate on Implementing the System of Having the Chief Procurator of the People's Procuratorate Observe the Meeting of the Judicial Committee of the People's Court, which have been deliberated and adopted at the 1475th session of the Judicial Committee of the Supreme People's Court on October 12, 2009 and the 17th session of the 11th Procuratorial Committee of the Supreme People's Procuratorate on August 11, 2009, are hereby issued and shall come into force on April 1, 2010. Please implement it in light of your local actualities and report the problems encountered in the implementation process to the Supreme People's Court and the Supreme People's Procuratorate respectively. | |
落实并完善人民检察院检察长、受检察长委托的副检察长列席人民法院审判委员会会议的规定，是中办[2008]28号文件规定的改革任务之一。最高人民法院、最高人民检察院在深入调研的基础上，制定了最高人民法院、最高人民检察院《关于人民检察院检察长列席人民法院审判委员会会议的实施意见》，已于2009年10月12日由最高人法院审判委员会第1475次会议、2009年8月11日由最高人民检察院第十一届检察委员会第17次会议讨论通过。现予以印发，自2010年4月1日起施行。请结合本地实际贯彻执行，在实施过程中如有问题，请分别向最高人民法院、最高人民检察院报告。 |
