The Decision of the Standing Committee of the National People's Congress on Amendingthe Road Traffic Safety Law of the People's Republic of China, which was adopted at the 31st Session of the Standing Committee of the 10th National People's Congress of the People's Republic of China on December 29, 2007, is hereby promulgated and shall come into force from May 1, 2008.
 
《全国人民代表大会常务委员会关于修改<中华人民共和国道路交通安全法>的决定》已由中华人民共和国第十届全国人民代表大会常务委员会第三十一次会议于2007年12月29日通过,现予公布,自2008年5月1日起施行。

The 31st Session of the Standing Committee of the 10th National People's Congress has decided to amend the Road Traffic SafetyLaw of the People's Republic of China as follows:
 
第十届全国人民代表大会常务委员会第三十一次会议决定对《中华人民共和国道路交通安全法》作如下修改:

 
Article 76shall be amended as: “Where a motor vehicle meets with a traffic accident and causes personal injury or death or any property loss, the insurance company shall pay indemnity within the limit of the compulsory third party liability insurance liability for the motor vehicle. The part in excess of the liability limit shall be indemnified according to the following provisions: 第七十六条修改为:“机动车发生交通事故造成人身伤亡、财产损失的,由保险公司在机动车第三者责任强制保险责任限额范围内予以赔偿;不足的部分,按照下列规定承担赔偿责任:

 
1. Where a traffic accident occurs between motor vehicles, the faulty party shall bear the liabilities; if both parties are in fault, they shall each bear their proper share of the liabilities; and “(一)机动车之间发生交通事故的,由有过错的一方承担赔偿责任;双方都有过错的,按照各自过错的比例分担责任。

 
2. Where a traffic accident occurs between a motor vehicle and a non-motor vehicle driver or a pedestrian, if the non-motor vehicle driver or pedestrian is not in fault, the motor vehicle driver shall bear the liabilities; however, if there is any evidence to prove that the non-motor vehicle driver or the pedestrian is in fault, the motor vehicle driver's liabilities may be properly mitigated in light of the degree of fault; and if the motor vehicle is not in fault at all, the motor vehicle driver shall bear no more than 10% of compensation liabilities. “(二)机动车与非机动车驾驶人、行人之间发生交通事故,非机动车驾驶人、行人没有过错的,由机动车一方承担赔偿责任;有证据证明非机动车驾驶人、行人有过错的,根据过错程度适当减轻机动车一方的赔偿责任;机动车一方没有过错的,承担不超过百分之十的赔偿责任。

Where the losses of the traffic accident are caused by the deliberate collision of the motor vehicle by a non-motor vehicle driver or a pedestrian, the motor vehicle driver shall bear no liabilities.”
 
“交通事故的损失是由非机动车驾驶人、行人故意碰撞机动车造成的,机动车一方不承担赔偿责任。”

This Decision shall come into force from May 1, 2008.
 
本决定自2008年5月1日起施行。

The Road Traffic Safety Law of the People's Republic of Chinashall be re-promulgated after having been correspondingly amended according to this Decision.
 
中华人民共和国道路交通安全法》根据本决定作相应修改,重新公布。
