| Article 1 In order to promote the optimization and upgrading of industrial structure, promote the implementation of intellectual property strategies of the state, and accelerate the construction of an innovation-oriented country, these Measures are formulated in accordance with the relevant provisions of the Patent Law of the People's Republic of China and the Detailed Rules for the Implementation of the Patent Law of the People's Republic of China. | | 第一条 为了促进产业结构优化升级，推进国家知识产权战略实施，加快建设创新型国家，根据《中华人民共和国专利法》和《中华人民共和国专利法实施细则》的有关规定，制定本办法。 |

| Article 2 Upon an applicant's request, the State Intellectual Property Office (“SIPO”) shall give priority to the examination of invention patent applications that satisfy relevant conditions, which shall be concluded within one year of the approval of the applicant's priority examination request. | | 第二条 国家知识产权局根据申请人的请求对符合条件的发明专利申请予以优先审查，自优先审查请求获得同意之日起一年内结案。 |

| Article 3 These Measures shall not apply to the priority examination to be conducted in accordance with the relevant provisions of bilateral or multilateral agreements concluded between the SIPO and patent examination organizations of other countries or regions. | | |
