| Article 1. These Regulations are formulated to strengthen the administration of the cooperative design of engineering and construction projects by Chinese and foreign design organisations (hereinafter referred to as cooperative design) and to promote the development of cooperative design activities. | | 第一条 为了加强对中国设计机构同外国设计机构合作设计工程项目（以下简称合作设计）的管理，促进合作设计活动的开展，特制定本规定。 |

| Article 2. In cases where it is necessary for the engineering or construction project design work in projects financed by Chinese investment, Sino-foreign joint equity investment or foreign loans to be entrusted to foreign design organisations, a Chinese design organisation shall also participate and carry out cooperative design. | | 第二条 中国投资或中外合资、外国贷款工程项目的设计，需要委托外国设计机构承担时，应有中国设计机构参加，进行合作设计。 |
Engineering and construction projects with Chinese investment, which can be designed by Chinese organisations, are not permitted to have their design work entrusted to foreign design organisations.However, some design technology relevant to the particular project may be imported or technical and economic advice sought from foreign design organisations. | |
中国投资的工程项目，中国设计机构能够设计的，不得委托外国设计机构承担设计，但可以引进与工程项目有关的部分设计技术或向外国设计机构进行技术经济咨询。 |
The design of engineering and construction projects in China involving foreign investments, in principle, shall also be undertaken by Chinese design organisations. Where the investor requires the design work to be undertaken by a foreign design organisation, Chinese design organisations shall also participate and the design shall be carried out on a cooperative basis. | |
外国在中国境内投资的工程项目，原则上也应由中国设计机构承担设计；如果投资方要求由外国设计机构承担设计，应有中国设计机构参加，进行合作设计。 |

| Article 3. In the case of engineering and construction projects requiring cooperative design, application for approval(including approval for the foreign exchange requirements of the cooperative design), shall be submitted by the competent department or construction unit, to the relevant level of administration, at the same time as the project proposal or the design work statements submitted, and only after approval may work involving the foreign party commence. In the case of small scale projects, approval may be granted by the competent department or by the planning commission of the province, autonomous region or municipality directly under the Central Government, depending upon the appropriate level of jurisdiction. In the case of large or medium scale projects, the competent department or the province,autonomous region or municipality, depending upon the appropriate level of jurisdiction, will submit a review and findings to the State Planning Commission for examination and approval. In the case of exceptionally large projects, the State Planning Commission will arrange for preliminary investigation and submit the findings of the investigation to the State Council for approval. | | 第三条 需要进行合作设计的工程项目（包括合作设计所需的外汇），按照项目管理权限，由主管部门或建设单位在上报项目建议书或设计任务书的同时，提出申请，经批准后方可对外开展工作。小型项目，按隶属关系由主管部门或省、自治区、直辖市计划委员会批准。大中型项目，按隶属关系由主管部门或省、市、自治区、直辖市提出审查意见，报国家计划委员会审批；其中特大型项目，由国家计划委员会组织初审，提出审核意见，报国务院批准。 |
At the same time as the competent department or the construction unit is selecting the preferred foreign design organisation, it shall select a Chinese cooperative design organisation. | |

Article 4.Only foreign design organisations whose design qualifications have been examined and found to be of an acceptable standard may undertake the design of a Chinese engineering or construction project. The investigation to determine the acceptability of the qualifications of the foreign design or ganisation will be carried out by the competent department in charge of the project.
