To enhance the development and utilization of renewable energy, and according to the Renewable Energy Law of the People's Republic of China, the National Development and Reform Commission (NDRC) has formulated the Trial Measures for the Management of Prices and Allocation of Costs for Electricity Generated from Renewable Energy, which are hereby issued to you for your compliance and implementation. Please report to the NDRC without delay if you have any problem in the course of implementation. | |
为促进可再生能源的开发利用，根据《中华人民共和国可再生能源法》，我委研究制定了《可再生能源发电价格和费用分摊管理试行办法》，现印发你们，请按照执行。对执行中出现问题，请及时报告我委。 |

| Chapter I General Provisions | | 第一章 总则 |

| Article 1 To enhance the development of the renewable energy power generation industry, these Measures are formulated pursuant to the Renewable Energy Law of the People's Republic of China and the Price Law. | | 第一条 为促进可再生能源发电产业的发展，依据《中华人民共和国可再生能源法》和《价格法》，特制定本办法。 |

| Article 2 These Measures apply to wind power generation, biomass power generation (including power generation through direct combustion and gasification of agricultural and forest waste, garbage incineration and landfill gas power generation, and biogas power generation), solar power generation, ocean energy power generation and geothermal power generation. The price of electricity generated by hyrdopower shall, for the time being, be governed by the existing provisions. | | 第二条 本办法的适用范围为：风力发电、生物质发电（包括农林废弃物直接燃烧和气化发电、垃圾焚烧和垃圾填埋气发电、沼气发电）、太阳能发电、海洋能发电和地热能发电。水力发电价格暂按现行规定执行。 |

| Article 3 Renewable energy power generation projects within the territory of the People's Republic of China, if approved or ratified by the competent authorities of the government in or after 2006, shall be governed by these Measures. Those approved or ratified before December 31, 2005 shall continue to be governed by the existing provisions. | | 第三条 中华人民共和国境内的可再生能源发电项目，2006年及以后获得政府主管部门批准或核准建设的，执行本办法；2005年12月31日前获得政府主管部门批准或核准建设的，仍执行现行有关规定。 |

| Article 4 The standards for the pricing of electricity generated from renewable energy and the allocation of costs shall be made on the principles of promoting development, raising efficiency, standardizing management and realizing fair burden sharing. | | 第四条 可再生能源发电价格和费用分摊标准本着促进发展、提高效率、规范管理、公平负担的原则制定。 |

| Article 5 The price of electricity generated from renewable energy takes the two forms of government-fixed pricing and government-guided pricing. The government-guided price is the bid-winning price determined by bidding. | | 第五条 可再生能源发电价格实行政府定价和政府指导价两种形式。政府指导价即通过招标确定的中标价格。 |
If the price of electricity generated from renewable energy is higher than the benchmark price of local on-grid electricity generated from desulfurized coal generators, the difference in price shall be allocated nationwide through the electricity sold by power grids at or above the provincial level. | |
可再生能源发电价格高于当地脱硫燃煤机组标杆上网电价的差额部分，在全国省级及以上电网销售电量中分摊。 |

Article 6 The on-grid electricity price for wind power generation projects shall be subject to government-guided pricing, and the price shall be determined by the price department of the State Council based on the price formed by bidding.
