On December 23, the UN Security Council unanimously adopted Resolution 2397 on the intercontinental ballistic missile launch conducted by the Democratic People's Republic of Korea (“the DPRK”) and further expanded sanctions against the DPRK based on its previous resolutions. The new measures mainly include: maintaining current levels of crude oil supplied to the DPRK; the refined petroleum products exported by member states to the DPRK shall be in the aggregate amount of up to 500,000 barrels each year; prohibiting the DPRK from exporting food and agricultural products (HS codes 12, 08, 07), machinery (HS code 84), electrical equipment (HS code 85), earth and stone including magnesite and magnesia (HS code 25), wood (HS code 44), and vessels (HS code 89), etc.; prohibiting all member states from the export to the DPRK of all industrial machinery (HS codes 84 and 85), transportation vehicles (HS codes 86 through 89), and iron, steel, and other metals (HS codes 72 through 83), etc.; prohibiting the DPRK from exporting seafood, including prohibiting the DPRK from selling or transferring fishing rights; requiring all member states to repatriate to the DPRK all DPRK workers within their territories no later than 24 months; requiring all member states to seize, inspect, and freeze (impound) or take other measures against any vessel engaged in the smuggling of petroleum or coal or other violations in their ports or in their territorial waters and not to provide such a vessel with any services including insurance, registration or classification services; prohibiting the export to the DPRK of any new or used vessels; and adding individuals and entities in the DPRK subject to sanctions.
