生活饮用水卫生监督管理办法

(Issued by Order No. 53 of the Ministry of Construction and the Ministry of Health on September 1, 1996,amended for the first time in accordance with the Notice of the Ministry of Health on Amending Certain Contents of the Detailed Rules for the Implementation of the Regulation on the Administration of Sanitation in Public Places and Other Regulatory Documents on February 12, 2010, and amended for the second time in accordance with theDecision of the Ministry of Housing and Urban-Rural Development and the National Health and Family Planning on Amending the Measures for the Supervision and Administration of the Sanitation of Domestic Drinking Water issued by Order No. 31 of the Ministry of Housing and Urban-Rural Development and the National Health and Family Planning Commission on April 17, 2016) (1996年9月1日建设部、卫生部令第53号发布,根据2010年2月12日《卫生部关于修改<公共场所卫生管理条例实施细则>等规范性文件部分内容的通知》第一次修改,根据2016年4月17日住房城乡建设部、国家卫生计生委令第31号《住房城乡建设部、国家卫生计生委关于修改〈生活饮用水卫生监督管理办法〉的决定》第二次修改)

Chapter I General Provisions 

第一章 总 则

Article 1 In order to guarantee thesanitation and safety of domestic drinking water(hereinafter referred to as “drinking water”), and guarantee human health, these Measures are developed in accordance with the relevant provisions of the Law of the People's Republic of China on Prevention and Treatment of Infectious Diseases and the Regulation on Urban Water Supply.   第一条 为保证生活饮用水(以下简称饮用水)卫生安全,保障人体健康,根据《中华人民共和国传染病防治法》及《城市供水条例》的有关规定,制定本办法。
Article 2 These Measures shall apply to the supervision and administration of the sanitation of central water supply and secondary water supply entities (hereinafter referred to as “water supply entities”) and products involving the sanitation and safety of drinking water.   第二条 本办法适用于集中式供水、二次供水单位(以下简称供水单位)和涉及饮用水卫生安全的产品的卫生监督管理。
All entities and individuals within the territory of the People's Republic of China shall abide by these Measures. 凡在中华人民共和国领域内的任何单位和个人均应遵守本办法。
Article 3 The competent department of health and family planning of the State Council shall take charge of the supervision of the sanitation of drinking water nationwide. The competent departments of health and family planning of the local people's governments at and above the county level shall take charge of the supervision of the sanitation of drinking water within their respective administrative regions.   第三条 国务院卫生计生主管部门主管全国饮用水卫生监督工作。县级以上地方人民政府卫生计生主管部门主管本行政区域内饮用水卫生监督工作。
The competent department of housing and urban-rural development of the State Council shall take charge of the administration of the sanitation of drinking water nationwide. The construction administrative departments of the local people's governments at and above the county level shall take charge of the administration of the sanitation of urban drinking water within their respective administrative regions. 国务院住房城乡建设主管部门主管全国城市饮用水卫生管理工作。县级以上地方人民政府建设行政主管部门主管本行政区域内城镇饮用水卫生管理工作。
Article 4 The state shall implement the sanitary licensing system for water supply entities and products involving the sanitation and safety of drinking water.   第四条 国家对供水单位和涉及饮用水卫生安全的产品实行卫生许可制度。
Article 5 The state shall encourage the research and development as well as popularization and application ofnew products, new technologies and new processes that are beneficial to the sanitation and safety of drinking water.   第五条 国家鼓励有益于饮用水卫生安全的新产品、新技术、新工艺的研制开发和推广应用。
Chapter II Sanitation Administration 

第二章 卫生管理

Article 6 The drinking water supplied by water supply entities shall comply with the state sanitary standards for domestic drinking water.   第六条 供水单位供应的饮用水必须符合国家生活饮用水卫生标准
Article 7 After obtaining the business license issued by the administrative department for industry and commerce, a central water supply entity shall also obtain the sanitary license issued by the competent department of health and family planning of the local people's government at or above the county level before supplying water.   第七条 集中式供水单位取得工商行政管理部门颁发的营业执照后,还应当取得县级以上地方人民政府卫生计生主管部门颁发的卫生许可证,方可供水。
Article 8 The drinking water supply projects newly constructed, reconstructed or expanded by water supply entities shall comply with the sanitary requirements, and the site selection, design review and as-built inspection thereof shall be conducted with the participation of the competent departments of construction, health and family planning.   第八条 供水单位新建、改建、扩建的饮用水供水工程项目,应当符合卫生要求,选址和设计审查、竣工验收必须有建设卫生计生主管部门参加。
For newly constructed, reconstructed or expanded urban public drinking water supply projects, the construction administrative departments shall take charge of organizing the site selection, design review and as-built inspection thereof, with the participation of the competent departments of health and family planning. 新建、改建、扩建的城市公共饮用水供水工程项目由建设行政主管部门负责组织选址、设计审查和竣工验收, 卫生计生主管部门参加。
Article 9 Water supply entities shall establish the rules and regulations on the sanitation administration of drinking water, and appoint full-time or part-time personnel to take charge of the sanitation administration of drinking water.   第九条 供水单位应建立饮用水卫生管理规章制度,配备专职或兼职人员,负责饮用水卫生管理工作。
Article 10 Central water supply entities shall have water quality purification and disinfection facilities and necessary water quality inspection instruments, equipment and personnel to conduct routine inspections of water quality and submit inspection materials to the competent departments of health and family planning and construction administrative departments of the local people's governments.   第十条 集中式供水单位必须有水质净化消毒设施及必要的水质检验仪器、设备和人员,对水质进行日常性检验,并向当地人民政府卫生计生主管部门和建设行政主管部门报送检测资料。
Urban construction administrative departments shall take charge of the administration of the establishment and implementation of the production management rules, job qualifications of employees, and routine water quality inspections of urban running water supply enterprises and enterprises supplying water to others through self-built facilities. 城市自来水供水企业和自建设施对外供水的企业,其生产管理制度的建立和执行、人员上岗的资格和水质日常检测工作由城市建设行政主管部门负责管理。
Article 11 The personnel directly engaging in water supply and managementmay not hold their positions until they have obtained health certificates, and shall be subject to health examination once each year.   第十一条 直接从事供、管水的人员必须取得体检合格证后方可上岗工作,并每年进行一次健康检查。
Those suffering from diarrhea, typhoid fever, viral hepatitis A, viral hepatitis E, active tuberculosis, suppurative or exudative dermatosis or other diseases that may affect the sanitation of drinking water and pathogen carriers shall not directly engage in water supply or management.

 凡患有痢疾、伤寒、甲型病毒性肝炎、戊型病毒性肝炎、活动性肺结核、化脓性或渗出性皮肤病及其他有碍饮用水卫生的疾病的和病原携带者,不得直接从事供、管水工作。
