The Military Personnel Insurance Law of the People's Republic of China, as adopted at the 26th meeting of the Standing Committee of the 11th National People's Congress of the People's Republic of China on April 27, 2012, is hereby issued and shall come into force on July 1, 2012. | |

| Article 1 This Law is formulated in order to regulate the insurance relationships of military personnel, protect the lawful rights and interests of military personnel, and promote the development of national defense and armed forces. | | 第一条 为了规范军人保险关系，维护军人合法权益，促进国防和军队建设，制定本法。 |

| Article 2 The state establishes an insurance system for military personnel. | | 第二条 国家建立军人保险制度。 |
The establishment, payment of premiums, and transfer and continuation of casualty insurance for military personnel, pensions for veterans, medical insurance for veterans, and insurance for unemployed accompanying spouses of military personnel shall be governed by this Law. | |
军人伤亡保险、退役养老保险、退役医疗保险和随军未就业的军人配偶保险的建立、缴费和转移接续等适用本法。 |

| Article 3 The military personnel insurance system shall reflect the occupational characteristics of military personnel, be linked to the social insurance system, and adapt to the level of economic and social development. | | 第三条 军人保险制度应当体现军人职业特点，与社会保险制度相衔接，与经济社会发展水平相适应。 |
The state shall, based on the development of the social insurance system, supplement and improve the military personnel insurance system at appropriate time. | |
国家根据社会保险制度的发展，适时补充完善军人保险制度。 |

| Article 4 The state promotes the development of military personnel insurance and provides fiscal appropriations and policy support for military personnel insurance. | | 第四条 国家促进军人保险事业的发展，为军人保险提供财政拨款和政策支持。 |

| Article 5 The military personnel insurance department of the Chinese People's Liberation Army (“PLA”) shall be responsible for military personnel insurance work of the entire armed forces. The social insurance administrative department and the financial department of the State Council and other relevant departments of the military shall be responsible for the relevant military personnel insurance work within their respective functions. | | 第五条 中国人民解放军军人保险主管部门负责全军的军人保险工作。国务院社会保险行政部门、财政部门和军队其他有关部门在各自职责范围内负责有关的军人保险工作。 |
The financial departments of the logistics (joint logistics) organs of the military shall be responsible for handling the registration of military personnel insurance, maintaining personal benefit records for military personnel, and paying insurance benefits to military personnel. | |
军队后勤（联勤）机关财务部门负责承办军人保险登记、个人权益记录、军人保险待遇支付等工作。 |
The financial departments of the logistics (joint logistics) organs of the military and the local social insurance agencies shall, within their respective functions, handle the transfer and continuation procedures for military personnel insurance and social insurance relationships. | |
军队后勤（联勤）机关财务部门和地方社会保险经办机构，按照各自职责办理军人保险与社会保险关系转移接续手续。 |

| Article 6 Military personnel shall, in accordance with law, participate in military personnel insurance and enjoy the corresponding insurance benefits. | | 第六条 军人依法参加军人保险并享受相应的保险待遇。 |
Military personnel shall have the right to consult and check their individual payment records and personal benefit records and have the right to require that the financial departments of the logistics (joint logistics) organs of the military and the local social insurance agencies handle, in accordance with law, the transfer and continuation procedures for pension, medical insurance, and other insurance relationships and provide consulting and other related services regarding military personnel insurance and social insurance. | |
军人有权查询、核对个人缴费记录和个人权益记录，要求军队后勤（联勤）机关财务部门和地方社会保险经办机构依法办理养老、医疗等保险关系转移接续手续，提供军人保险和社会保险咨询等相关服务。 |

| Chapter II Casualty Insurance for Military Personnel | | 第二章 军人伤亡保险 |

| Article 7 The death benefits for military personnel who die in war or in line of duty shall be paid according to the determined nature of death and the corresponding insurance benefit standards. | | 第七条 军人因战、因公死亡的，按照认定的死亡性质和相应的保险金标准，给付军人死亡保险金。 |
| |
|
| Article 8 The disability benefits for military personnel who are disabled in war, in line of duty, or for any disease shall be paid according to the assessed disability grade and the corresponding insurance benefit standards. | | 第八条 军人因战、因公、因病致残的，按照评定的残疾等级和相应的保险金标准，给付军人残疾保险金。 |

| Article 9 The determination of the nature of death or disability, the assessment of disability grade, and the corresponding insurance benefit standards shall be governed by the relevant provisions of the state and the military. | | 第九条 军人死亡和残疾的性质认定、残疾等级评定和相应的保险金标准，按照国家和军队有关规定执行。 |

| Article 10 Military personnel who die or become disabled for any of the following circumstances may not enjoy the casualty insurance benefits for military personnel: | | 第十条 军人因下列情形之一死亡或者致残的，不享受军人伤亡保险待遇： |
| |
|
| 1. intentionally committing a crime; | | （一）故意犯罪的； |
| |
|
| 2. being under the influence of alcohol or drugs; | | （二）醉酒或者吸毒的； |
| |
|
| 3. sustaining any self-inflicted injury or committing suicide; or | | （三）自残或者自杀的； |
| |
|
| 4. any other circumstances as prescribed by laws, administrative regulations, or military regulations. | | （四）法律、行政法规和军事法规规定的其他情形。 |
| |
|
| Article 11 Military personnel whose disability grades have been assessed after becoming disabled in war or in line of duty shall enjoy corresponding work injury benefits in accordance with law if their pre-existing injuries recur while working after retirement from active service, | | 第十一条 已经评定残疾等级的因战、因公致残的军人退出现役参加工作后旧伤复发的，依法享受相应的工伤待遇。 |

| Article 12 Funds needed for casualty insurance for military personnel shall be paid by the state, and individuals need not pay insurance premiums. | | 第十二条 军人伤亡保险所需资金由国家承担，个人不缴纳保险费。 |

| Chapter III Pensions for Veterans | |

| Article 13 The state provides veteran pension subsidies for military personnel who participate in the basic pension plan after retiring from active service. | | 第十三条 军人退出现役参加基本养老保险的，国家给予退役养老保险补助。 |
| |
|
| Article 14 The pension subsidy standards for veterans shall be proposed by the General Logistics Department of the PLA in conjunction with the relevant departments of the State Council on the basis of the basic pension premium rates set out by the state, the wage level of military personnel, and other relevant factors and be submitted to the State Council and the Central Military Commission for approval. | | 第十四条 军人退役养老保险补助标准，由中国人民解放军总后勤部会同国务院有关部门，按照国家规定的基本养老保险缴费标准、军人工资水平等因素拟订，报国务院、中央军事委员会批准。 |

| Article 15 For military personnel who have participated in the basic pension plan before joining the military, the local social insurance agencies and the financial departments of the logistics (joint logistics) organs of the military shall be responsible for handling the transfer and continuation procedures for their basic pension plan relationships. | | 第十五条 军人入伍前已经参加基本养老保险的，由地方社会保险经办机构和军队后勤（联勤）机关财务部门办理基本养老保险关系转移接续手续。 |

Article 16 For military personnel who participate in the basic employee pension plan after retiring from active service, the financial departments of the logistics (joint logistics) organs of the military shall transfer their veteran pension relationships and the corresponding funds to the local social insurance agencies, and the local insurance agencies shall handle relevant transfer and continuation procedures.
