《中华人民共和国军品出口管理条例》的决定 |
For the purposes of further strengthening the unified administration of arms export and improving the system for arms export, it is decided to amend the Regulations of the People's Republic of China on Administration of Arms Export as follows: | |
为了进一步加强对军品出口的统一管理，完善军品出口管理制度，决定对《中华人民共和国军品出口管理条例》作如下修改： |

| I. One paragraph is added to Article 2 as the second paragraph: "Arms export referred to in the preceding paragraph shall be included in the arms export administration list. The arms export administration list shall be formulated, adjusted and published by the competent arms export department of the StateI. " | | 一、第二条增加一款，作为第二款：“前款所称军品出口，纳入军品出口管理清单。军品出口管理清单由国家军品出口主管部门制定、调整并公布。” |

| II. Article 3 is amended as follows: "The competent arms export department of the State shall, under the leadership of the State Council and the Central Military Commission, take charge of the arms export work throughout the country and exercise supervision and administration of arms export throughout the country." | | 二、第三条修改为：“国家军品出口主管部门在国务院、中央军事委员会的领导下，主管全国的军品出口工作，对全国的军品出口实施监督管理。” |

| III. Article 8 is amended as follows: "The business operations right for arms export shall be examined and approved by the competent arms export department of the State. Specific measures shall be formulated by the competent arms export department of the State." | | 三、第八条修改为：“军品出口经营权由国家军品出口主管部门审查批准。具体办法由国家军品出口主管部门规定。” |

| IV. Article 11 is amended as follows: "In accordance with the provisions of the competent arms export department of the State, an arms trading company shall truthfully present the documents and data pertinent to its arms export business activities. The competent arms export department of the State shall keep business secrets of the arms trading company and protect its lawful rights and interests." | | 四、第十一条修改为：“军品贸易公司应当按照国家军品出口主管部门的规定，如实提交与其军品出口经营活动有关的文件及资料。国家军品出口主管部门应当为军品贸易公司保守商业秘密，维护军品贸易公司的合法权益。” |

| V. Article 12 is amended as follows: "An arms trading company may entrust an approved transportation enterprise for arms export with the transportation of arms for export and related business matters. Specific measures shall be formulated by the competent arms export department of the State." | | 五、第十二条修改为：“军品贸易公司可以委托经批准的军品出口运输企业，办理军品出口运输及相关业务。具体办法由国家军品出口主管部门规定。” |

| VI. Article 14 is amended as follows: "Proposals for arms export shall be examined and approved by the competent arms export department of the State, or by the competent arms export department of the State jointly with the relevant departments of the State Council and the Central Military Commission." | | 六、第十四条修改为：“军品出口项目，由国家军品出口主管部门或者由国家军品出口主管部门会同国务院、中央军事委员会的有关部门审查批准。” |

VII. Article 15 is amended as follows: "When proposals for arms export are approved, an arms trading company may conclude contracts for arms export with the foreign side. After a contract for arms export is concluded, it shall file an application with the competent arms export department of the State for examination and approval; the competent arms export department of the State shall make a decision thereon within 20 days from the date of receipt of the application. A contract for arms export shall become effective only after it is approved.
