| To implement the Opinions of the Ministry of Industry and Information Technology and the Shanghai Municipal People's Government on Further Opening up the Value-Added Telecommunications Business in China (Shanghai) Pilot Free Trade Zone (No. 410 [2013] of the Ministry of Industry and Information Technology), and promote the opening-up of the pilot value-added telecommunications business in China (Shanghai) Pilot Free Trade Zone, the Ministry of Industry and Information Technology has developed the Administrative Measures for the Pilot Operation of the Value-Added Telecommunications Business by Foreign Investors in China (Shanghai) Pilot Free Trade Zone, which are hereby issued. | | 为贯彻落实《工业和信息化部、上海市人民政府关于中国（上海）自由贸易试验区进一步对外开放增值电信业务的意见》（工信部联通[2013]410号），推进中国（上海）自由贸易试验区增值电信业务试点开放工作，我部制定了《中国（上海）自由贸易试验区外商投资经营增值电信业务试点管理办法》，现予印发。 |

| Administrative Measures for the Pilot Operation of the Value-Added Telecommunications Business by Foreign Investors in China (Shanghai) Pilot Free Trade Zone | | 中国（上海）自由贸易试验区外商投资经营增值电信业务试点管理办法 |
| Article 1 To satisfy the requirements for the operation of the value-added telecommunications business by foreign investors in China (Shanghai) Pilot Free Trade Zone (hereinafter referred to as “SHFTZ”), these Measures are developed in accordance with the Regulation on Telecommunications of the People's Republic of China, the Provisions on the Administration of Foreign-Funded Telecommunications Enterprises, the Decision of the State Council on Temporarily Adjusting the Relevant Administrative Approval Items Prescribed in the Relevant Administrative Regulations and Documents of the State Council or Special Access Management Measures in China (Shanghai) Pilot Free Trade Zone, the Opinions of the Ministry of Industry and Information Technology and the Shanghai Municipal People's Government on Further Opening up the Value-Added Telecommunications Business in China (Shanghai) Pilot Free Trade Zone, and other relevant provisions. | | 第一条 为了适应中国（上海）自由贸易试验区（以下简称试验区）外商投资经营增值电信业务的需要，根据《中华人民共和国电信条例》、《外商投资电信企业管理规定》、《国务院关于在中国（上海）自由贸易试验区内暂时调整有关行政法规和国务院文件规定的行政审批或者准入特别管理措施的决定》及《工业和信息化部、上海市人民政府关于中国（上海）自由贸易试验区进一步对外开放增值电信业务的意见》等有关规定，制定本办法。 |
| Article 2 The value-added telecommunications business that may be operated by foreign-funded enterprises in SHFTZ and the proportion of capital contribution made by foreign investors shall be determined by the Ministry of Industry and Information Technology in accordance with the relevant provisions. | | 第二条 试验区外商投资企业可以经营的增值电信业务及外方投资者的出资比例，由工业和信息化部根据有关规定确定。 |
| Article 3 A foreign-funded enterprise in SHFTZ that applies for engaging in the value-added telecommunications business shall meet the following conditions: | | 第三条 试验区外商投资企业申请经营增值电信业务的，应当符合下列条件： |
| (1) The operator is a company legally established in SHFTZ. | | （一）经营者为在试验区依法设立的公司。 |
| (2) It has the funds and professionals appropriate for its business activities. | | （二）有与开展经营活动相适应的资金和专业人员。 |
| (3) It has the reputation for or capability of providing users with long-term services. | | （三）有为用户提供长期服务的信誉或者能力。 |
| (4) Its registered capital is not less than one million yuan. | | （四）注册资本最低限额为100万元人民币。 |
| (5) It has necessary premises, facilities, technical plans and network and information security guarantee rules and measures, and its service facilities are all located in SHFTZ. | | （五）有必要的场地、设施、技术方案以及网络与信息安全保障制度和措施，其中服务设施须设在试验区内。 |
| (6) The company and its major investors and major business managers have no record of violation of telecommunications supervision and administration rules during the past three years. | | （六）公司及其主要投资者和主要经营管理人员三年内无违反电信监督管理制度的违法记录。 |
| (7) It meets other conditions as prescribed by the state. | | （七）国家规定的其他条件。 |
Article 4 A foreign-funded enterprise that applies for engaging in the value-added telecommunications business in SHFTZ shall file an application with the Shanghai Communications Administration and submit the following documents:
