| To legally promote the reform of the administrative approval system and the transformation of government functions, maximize the advantages of local governments in direct contact with the common people, promote and ensure the shift of more prior administrative approval to interim and ex post supervision, and further stimulate vitality and momentum in markets and creativity in society, in accordance with the Decision of the State Council on a Group of Administrative Approval Items to Be Cancelled or Delegated to Lower Levels as issued by the State Council on January 28, 2014, the State Council has reviewed the administrative regulations relating to the administrative approval items to be cancelled or delegated to lower levels. Upon review, it decides to amend some clauses of 21 administrative regulations. | | 为了依法推进行政审批制度改革和政府职能转变，发挥好地方政府贴近基层的优势，促进和保障政府管理由事前审批更多地转为事中事后监管，进一步激发市场活力、发展动力和社会创造力，根据2014年1月28日国务院公布的《国务院关于取消和下放一批行政审批项目的决定》，国务院对取消和下放的行政审批项目涉及的行政法规进行了清理。经过清理，国务院决定：对21部行政法规的部分条款予以修改。 |
| 1. Article 8 of the Interim Provisions of the State Council on the Administration of General Aviation is amended to read: “An enterprise engaged in general aviation may undertake general aviation business activities outside of China, provided that it has undergone the relevant procedure in accordance with the relevant provisions of the state.” | | 一、将《国务院关于通用航空管理的暂行规定》第八条修改为：“经营通用航空业务的企业，可以承担中国境外通用航空业务，但是应当按照国家有关规定办理相关手续。” |
| 2. Item 3, paragraph 3, Article 6 of the Interim Regulation on the Higher Education Examination for Self-taught Students is amended to read: “making plans for majors open to the higher education examination for self-taught students, and approving undergraduate majors open to such examination.” | | 二、将《高等教育自学考试暂行条例》第六条第三款第三项修改为：“制定高等教育自学考试开考专业的规划，审批开考本科专业”。 |
| Article 11 is amended to read: “The new associate majors open to the higher education examination for self-taught students shall be determined by the examination committees at the provincial level. For any new undergraduate major open to such examination, an education committee at the provincial level shall organize the relevant departments and experts to conduct demonstration, prepare an application, and submit it to the National Examination Committee for approval.” | | 第十一条修改为：“高等教育自学考试开考专科新专业，由省考委确定；开考本科新专业，由省考委组织有关部门和专家进行论证，并提出申请，报全国考委审批。” |
| 3. Paragraph 1, Article 7 of the Regulation of the People's Republic of China on the Registration of Ships is deleted. | | 三、删去《中华人民共和国船舶登记条例》第七条第一款。 |
| In Article 53, “employing foreign seafarers without approval or” is deleted. | | 删去第五十三条中的“擅自雇用外国籍船员或者”。 |
| 4. In Article 26 of the Regulation of the People's Republic of China on Protection of New Varieties of Plants, “registration shall be made with the examining and approving organs” is replaced by “registration shall be made with the administrative department of agriculture or forestry of the provincial people's government, depending on the division of functions between them.” | | 四、将《中华人民共和国植物新品种保护条例》第二十六条中的“向审批机关登记”修改为“按照职责分工向省级人民政府农业、林业行政部门登记”。 |
| 5. In paragraph 1, Article 13 of the Measures for the Administration of Area Registration for the Exploration of Mineral Resources, “determined upon appraisal” is deleted. | | 五、删去《矿产资源勘查区块登记管理办法》第十三条第一款中的“经评估确认的”。 |
| Paragraph 2, Article 13 is amended to read: “The purchase price of the mineral prospecting right resulting from explorations financed by the state shall be subject to the appraisal of an appraisal agency qualified for appraisal of mining rights, and the appraisal report shall be submitted to the registration organ for recordation.” | | 第十三条第二款修改为：“国家出资勘查形成的探矿权价款，由具有矿业权评估资质的评估机构进行评估；评估报告报登记管理机关备案。” |
| Article 38 is amended to read: “In a Chinese-foreign cooperative prospecting of mineral resources, the Chinese partner shall, after entering into a cooperation contract, submit the contract to the original license-issuing organ for recordation.” | | 第三十八条修改为：“中外合作勘查矿产资源的，中方合作者应当在签订合同后，将合同向原发证机关备案。” |
| Article 40 is deleted. | | 删去第四十条。 |
| 6. In paragraph 1, Article 10 of the Measures for the Registration Administration of the Exploitation of Mineral Resources, “determined upon appraisal” is deleted. | | 六、删去《矿产资源开采登记管理办法》第十条第一款中的“经评估确认的”。 |
| Paragraph 2, Article 10 is amended to read: “The purchase price of the mineral prospecting right resulting from explorations financed by the state shall be subject to the appraisal of an appraisal agency qualified for appraisal of mining rights, and the appraisal report shall be submitted to the registration organ for recordation.” | | 第十条第二款修改为：“国家出资勘查形成的采矿权价款，由具有矿业权评估资质的评估机构进行评估；评估报告报登记管理机关备案。” |
| Article 29 is amended to read: “In a Chinese-foreign cooperative exploration of mineral resources, the Chinese partner shall, after entering into a cooperation contract, submit the contract to the original license-issuing organ for recordation.” | | 第二十九条修改为：“中外合作开采矿产资源的，中方合作者应当在签订合同后，将合同向原发证机关备案。” |

Paragraph 2, Article 9 of the Measures for the Administration of the Transfer of Mineral Prospecting Right and Mining Right is amended to read: “The purchase price of the mineral prospecting right or mining right resulting from explorations financed by the state shall be subject to the appraisal of an appraisal agency qualified for appraisal of mining rights, and the appraisal report shall be submitted to the mineral prospecting right or mining right registration organ for recordation.” | | 七、将《探矿权采矿权转让管理办法》第九条第二款修改为：“国家出资勘查形成的探矿权、采矿权价款，由具有矿业权评估资质的评估机构进行评估；评估报告报探矿权、采矿权登记管理机关备案。” |
| 8. Paragraph 2, Article 17 of the Regulation on the Implementation of the Land Administration Law of the People's Republic of China is amended to read: “Whoever engages in the development of any state-owned barren hill, barren land or barren shoal the land use right of which has not been established for planting, forestry, animal husbandry or fishery production in a land reclamation zone determined by the overall land utilization plan should file an application with the land administrative department of the local people's government at or above the county level at the locality of the land, which shall be subject to the approval of the local people's government at or above the county level according to the limits of powers determined by the province, autonomous region or municipality directly under the Central Government.” | | 八、将《中华人民共和国土地管理法实施条例》第十七条第二款修改为：“在土地利用总体规划确定的土地开垦区内，开发未确定土地使用权的国有荒山、荒地、荒滩从事种植业、林业、畜牧业、渔业生产的，应当向土地所在地的县级以上地方人民政府土地行政主管部门提出申请，按照省、自治区、直辖市规定的权限，由县级以上地方人民政府批准。” |

9. Article 13 of the Regulation of the People's Republic of China on the Administration of RMB is amended to read: “Except for enterprises authorized by the People's Bank of China to print RMB, no entity or individual may make research, make, imitate, import, sell, purchase or use the anti-forgery materials, anti-forgery technologies, anti-forgery processes and special equipment exclusively used for the printing of RMB. The relevant administrative measures shall be separately developed by the People's Bank of China.”
