| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 For the purposes of regulating the hearing procedures for administrative punishments by market regulatory departments, ensuring that market regulatory departments impose administrative punishments according to the law, and protecting the lawful rights and interests of natural persons, legal persons and other organizations, these Measures are developed according to the relevant provisions of the Law of the People's Republic of China on Administrative Penalty. | | 第一条 为了规范市场监督管理行政处罚听证程序，保障市场监督管理部门依法实施行政处罚，保护自然人、法人和其他组织的合法权益，根据《中华人民共和国行政处罚法》的有关规定，制定本办法。 |
| Article 2 These Measures shall apply to the holding of hearings for administrative punishments by market regulatory departments. | | 第二条 市场监督管理部门组织行政处罚听证，适用本办法。 |
| Article 3 When holding a hearing for administrative punishment, the market regulatory department shall follow the principles of openness, impartiality, and efficiency, and guarantee and facilitate the party's exercise of the right of statement and the right of defense in accordance with the law. | | 第三条 市场监督管理部门组织行政处罚听证，应当遵循公开、公正、效率的原则，保障和便利当事人依法行使陈述权和申辩权。 |
| Article 4 The disqualification system shall apply to the hearings for cases of administrative punishments imposed by market regulatory departments. The hearing presider, hearing officer, recorder, or interpreter that has a direct interest relationship with the party shall be disqualified. | | 第四条 市场监督管理部门行政处罚案件听证实行回避制度。听证主持人、听证员、记录员、翻译人员与当事人有直接利害关系的，应当回避。 |
| The disqualification of the hearing officer, recorder or interpreter shall be decided by the hearing presider; and the disqualification of the hearing presider shall be decided by the person in charge of the market regulatory department. | | 听证员、记录员、翻译人员的回避，由听证主持人决定；听证主持人的回避，由市场监督管理部门负责人决定。 |
| Chapter II Application and Acceptance | | 第二章 申请和受理 |
| Article 5 Before making any of the following decisions on administrative punishments, the market regulatory department shall notify the party of the right to request a hearing: | | 第五条 市场监督管理部门作出下列行政处罚决定之前，应当告知当事人有要求举行听证的权利： |
| (1) Ordering suspension of production and business operations. | | （一）责令停产停业； |
| (2) Revoking the permit or license. | | （二）吊销许可证或者执照； |
| (3) Imposing a fine of not less than 10,000 upon a natural person, or imposing a fine of not less than 100,000 upon a legal person or any other organization. | | （三）对自然人处以一万元以上、对法人或者其他组织处以十万元以上罚款； |
| (4) Imposing an administrative punishment of confiscating illegal income and illegal property with value reaching the amount set forth in subparagraph (3) upon a natural person, legal person or any other organization. | | （四）对自然人、法人或者其他组织作出没收违法所得和非法财物价值达到第三项所列数额的行政处罚。 |
| Where there are specific provisions issued by the standing committee of the people's congress or the people's government of the province, autonomous region or municipality directly under the Central Government on the amount of penalty and confiscated property set forth in subparagraphs (3) and (4) of the preceding paragraph, such provisions may apply. | | 各省、自治区、直辖市人大常委会或者人民政府对前款第三项、第四项所列罚没数额有具体规定的，可以从其规定。 |
| Article 6 When notifying the party of the right to a hearing, the market regulatory department shall notify the party in writing of the facts, grounds and basis for the administrative punishment to be imposed. | | 第六条 向当事人告知听证权利时，应当书面告知当事人拟作出行政处罚的事实、理由和依据。 |
| Article 7 The party requesting a hearing may sign its or his opinions on the proof of service of a notification and offer opinions within three working days of receipt of a notification. Where the opinions are offered by the party verbally, the case-handling personnel shall record the situation in the transcript and the party shall affix its or his signature or seal to the transcript. | | 第七条 当事人要求听证的，可以在告知书送达回证上签署意见，也可以自收到告知书之日起三个工作日内提出。当事人以口头形式提出的，办案人员应当将情况记入笔录，并由当事人在笔录上签名或者盖章。 |
| Where the party fails to request a hearing within three working days of service of a notification, the party shall be deemed to have waived the right. | | 当事人自告知书送达之日起三个工作日内，未要求举行听证的，视为放弃此权利。 |
| Where the party requests a hearing within the prescribed time limit, the market regulatory department shall organize a hearing in accordance with the provisions of these Measures. | | 当事人在规定期限内要求举行听证的，市场监督管理部门应当依照本办法的规定组织听证。 |
| Chapter III Hearing Organizers, Hearing Personnel and Hearing Participants | | 第三章 听证组织机构、听证人员和听证参加人 |
| Article 8 A hearing shall be organized by the legislative affairs office or any other body of the market regulatory department. | | 第八条 听证由市场监督管理部门法制机构或者其他机构负责组织。 |
| Article 9 Hearing personnel shall include hearing presiders, hearing officers, and recorders. | | 第九条 听证人员包括听证主持人、听证员和记录员。 |
| Article 10 Hearing participants shall include the party and its or his agents, third parties, case-handling personnel, witnesses, interpreters, authentication experts, and other relevant personnel. | | 第十条 听证参加人包括当事人及其代理人、第三人、办案人员、证人、翻译人员、鉴定人以及其他有关人员。 |
| Article 11 A hearing presider shall be designated by the person in charge of the market regulatory department. If necessary, one or two hearing officers may be set to assist the hearing presider in holding a hearing. | | 第十一条 听证主持人由市场监督管理部门负责人指定。必要时，可以设一至二名听证员，协助听证主持人进行听证。 |
| A recorder shall be designated by the hearing presider to undertake the preparation for and the recording work of a hearing. | | 记录员由听证主持人指定，具体承担听证准备和听证记录工作。 |
| Case-handling personnel shall not serve as hearing presider, hearing officer or recorder. | | 办案人员不得担任听证主持人、听证员和记录员。 |
| Article 12 The hearing presider shall perform the following duties during the hearing procedures: | | 第十二条 听证主持人在听证程序中行使下列职责： |
(1) Deciding the time and place of a hearing.
