People's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all ministries and commissions of the State Council and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Employment is crucial to the people's livelihood, and the top priority under economic development. At present, the employment situation in China remains stable in general, but economic operation is steadily changing, economic downward pressure is increasing, and its influence on employment needs close attention. Efforts shall be made to put the stability of employment at a more prominent position, deeply promote the spirit of Xi Jinping's socialist thought with Chinese characteristics in the new era and the 19th National Congress of the Communist Party of China, comprehensively implement the decisions and arrangements of the Central Committee of the Communist Party of China and the State Council on the stability of employment, persist in the implementation of the “employment first” strategy and more active employment policies, support enterprises to stabilize posts, promote employment and entreprenuership, strengthen training services, and ensure the completion of employment objectives and tasks and the continuous stability of the employment situation in the current and future time periods. To this end, the opinions are hereby given as below: 就业是最大的民生,也是经济发展的重中之重。当前,我国就业局势保持总体稳定,但经济运行稳中有变,经济下行压力有所加大,对就业的影响应高度重视。必须把稳就业放在更加突出位置,深入贯彻习近平新时代中国特色社会主义思想和党的十九大精神,全面落实党中央、国务院关于稳就业工作的决策部署,坚持实施就业优先战略和更加积极的就业政策,支持企业稳定岗位,促进就业创业,强化培训服务,确保当前和今后一个时期就业目标任务完成和就业局势持续稳定。为此,提出以下意见:
I. Supporting the Stable Development of Enterprises   一、支持企业稳定发展
1. Intensifying supports for stable employment. For enterprises joining the social insurance scheme, 50% of the actual amounts of unemployment insurance premiums they made in the preceding year may be refunded, provided that they do not lay off employees or reduce staff members only on a small scale. From January 1, 2019 to December 31, 2019, concerning those temporarily haunted by production and business difficulties but expected to recover and not to lay off employees or reduce staff members only on a small scale, the refund standard may be determined based on the local monthly per capita unemployment insurance premiums and the number of employees joining the social insurance scheme in the preceding six months or 50% of the social insurance premiums payable by enterprises and their employees in the preceding six months. The aforesaid capital shall be appropriated from unemployment insurance funds. (The Ministry of Human Resources and Social Security ("MOHRSS") and the Ministry of Finance ("MOF") shall be responsible; and the first one shall take the lead, the same below) (一)加大稳岗支持力度。对不裁员或少裁员的参保企业,可返还其上年度实际缴纳失业保险费的50%。2019年1月1日至12月31日,对面临暂时性生产经营困难且恢复有望、坚持不裁员或少裁员的参保企业,返还标准可按6个月的当地月人均失业保险金和参保职工人数确定,或按6个月的企业及其职工应缴纳社会保险费50%的标准确定。上述资金由失业保险基金列支。(人力资源社会保障部、财政部负责。列第一位者为牵头单位,下同)
2. Giving play to the role of government financing guarantee institutions in supporting small- and micro-sized enterprises. Measures shall be taken to maximize the role of the State's financing guarantee funds, and guide more financial resources to support entrepreneurship and employment. Government financing guarantee funds of all places shall provide low-rate guarantees first for qualified small- and micro-sized enterprises, and enhance such enterprises' accessibility to loans. (The MOF, the Ministry of Industry and Information Technology, the People's Bank of China ("PBC") and the China Banking and Insurance Regulatory Commission ("CBIRC") shall be responsible) (二)发挥政府性融资担保机构作用支持小微企业。充分发挥国家融资担保基金作用,引导更多金融资源支持创业就业。各地政府性融资担保基金应优先为符合条件的小微企业提供低费率的担保支持,提高小微企业贷款可获得性。(财政部、工业和信息化部、人民银行、银保监会负责)
II. Encouraging and Supporting Employment and Entrepreneurship   二、鼓励支持就业创业
3. Intensifying supports for entrepreneurship guarantee loans with discounted interest and reward and subsidy policies. Where a person meeting the application conditions of entrepreneurship guarantee loans starts a business on his own, he may apply for an entrepreneurship loan of not more than RMB150,000. Where the number of persons meeting the application conditions of entrepreneurship guarantee loans as newly employed by a small- and micro-sized enterprise reaches 25% of the existing in-service employees thereof (or 15% for a small- and micro-sized enterprise with its staff number exceeding 100) and concludes a labor contract with a term exceeding one year with the enterprise, the said enterprise may apply for an entrepreneurship guarantee loan of not more than RMB3 million. All local authorities may properly relax the application conditions of entrepreneurship guarantee loans, with interest discount funds arising therefrom to be borne by local finance. Efforts shall be made to promote the practical implementation of reward and subsidy policies, reward entities such as operation and management institutions of entrepreneurship guarantee loans by a certain percentage of the total amount of entrepreneurship guarantee loans newly provided in corresponding places in the current year, inspiring their initiative of further improving services for entrepreneurship and employment. (The MOF, the MOHRSS, the PBC and the CBIRC shall be responsible) (三)加大创业担保贷款贴息及奖补政策支持力度。符合创业担保贷款申请条件的人员自主创业的,可申请最高不超过15万元的创业担保贷款。小微企业当年新招用符合创业担保贷款申请条件的人员数量达到企业现有在职职工人数25%(超过100人的企业达到15%)并与其签订1年以上劳动合同的,可申请最高不超过300万元的创业担保贷款。各地可因地制宜适当放宽创业担保贷款申请条件,由此产生的贴息资金由地方财政承担。推动奖补政策落到实处,按各地当年新发放创业担保贷款总额的一定比例,奖励创业担保贷款基金运营管理机构等单位,引导其进一步提高服务创业就业的积极性。(财政部、人力资源社会保障部、人民银行、银保监会负责)
4. Providing better conditions for business startups. Encouragement shall be given to target groups in rapidly establishing business incubation bases, to entrepreneurs with low-cost operation sites, guidance services and policy supports, and to business incubation bases with rewards and subsidies according to the number of entities therein, incubation effects and employment driving effects. Support shall be offered to the regions with a high pressure for employment stability in providing business premises free-of-charge for the independent entrepreneurship of unemployed persons. (The MOHRSS, the Ministry of Science and Technology, the MOF, the Ministry of Housing and Urban-Rural Development and the State Administration for Market Regulation and all provincial people's governments shall be responsible based on the division of duties)

 (四)支持创业载体建设。鼓励各地加快建设重点群体创业孵化载体,为创业者提供低成本场地支持、指导服务和政策扶持,根据入驻实体数量、孵化效果和带动就业成效,对创业孵化基地给予一定奖补。支持稳定就业压力较大地区为失业人员自主创业免费提供经营场地。(人力资源社会保障部、科技部、财政部、住房城乡建设部、市场监管总局,各省级人民政府按职责分工负责)
