反对劫持人质国际公约*

 (注*:该公约于1979年12月18日订于纽约,1983年6月3日生效。1992年12月28日中华人民共和国第七届全国人民代表大会常务委员会第二十九次会议决定加入本公约,同时声明对公约第十六条第1款予以保留。1993年1月26日本公约对我生效。)

 THE STATES PARTES to this Convention. 本公约各缔约国
 HAVING IN MIND the purposes and principles of the Charter of the United Nations concerning the maintenance of international peace and security and the promotion of friendly relations and co—operation among States, 铭记着《联合国宪章》中有关维持国际和平与安全及促进各国间友好关系与合作的宗旨及原则,
 RECOGNIZING in particular that everyone has the right to life,liberty and security of person,as set out in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, 特别认识到人人享有《世界人权宣言》和《公民权利和政治权利国际公约》所规定的生命、自由和人身安全的权利,
 REAFFIRMING the principle of equal rights and self—determination of peoples as enshrined in the Charter of the United Nations and the Declaration on Principles of International Law concerning Friendly Relations and Co—operation among States in accordance with the Charter of the United Nations.as well as in other relevant resolutions of the General Assembly, 重申《联合国宪章》和《关于各国依联合国宪章建立友好关系和合作的国际法原则宣言》以及大会其他有关决议所阐明的各国人民的平等权利和自决原则,
 CONSIDERING that the taking of hostages is an offence of grave concern to the international community and that,in accordance with the provisions of this Convention,any person committing an act of hostage taking shall either be prosecuted or extradited, 考虑到劫持人质是引起国际社会严重关切的罪行,按照本公约的规定,对任何犯劫持人质罪行者必须予以起诉或引渡,
 BEING CONVINCED that it is urgently necessary to develop international co—operation between States in devising and adopting effective measures for the prevention,prosecution and punishment of all acts of taking of hostages as manifestations of international terrorism, 深信迫切需要在各国之间发展国际合作,制订和采取有效措施,以防止作为国际恐怖主义的表现的一切劫持人质行为,并对犯有此项罪行者予以起诉和惩罚,
 HAVE AGREED AS FOLLOWS: 已达成协议如下:
ARTICLE 1   第一条
1. Any person who seizes or detains and threatens to kill,to injure or to continue to detain another person(hereinafter referred to as the“hostage”)in order to compel a third party,namely,a State,an international intergovernmental organization,a natural or juridical person,or a group of persons,to do or abstain from doing any act as an explicit or implicit condition for the release of the hostage commits the offence of taking of hostages(“hostage—taking”) within the meaning of this Convention. 1.任何人如劫持或扣押并以杀死、伤害或继续扣押另一个人(以下称“人质”)为威胁,以强迫第三方,即某个国家、某个国际政府间组织、某个自然人或法人或某一群人,作或不作某种行为,作为释放人质的明示或暗示条件,即为犯本公约意义范围内的劫持人质罪行。
2. Any person who: 2.任何人
(a)attempts to commit an act of hostage—taking,or (a)图谋劫持人质,或
(b)participates as an accomplice of anyone who commits or attempts to commit an act of hostage—taking likewise commits an offence for the purposes of this Convention. (b)与实行或图谋劫持人质者同谋而参与其事,也同样犯有本公约意义下的罪行。
ARTICLE 2 nbsp;Each State Party shall make the offences set forth in article 1 punishable by appropriate penalties which take into account the grave nature of those offences.   第二条 每一缔约国应按照第一条所称罪行的严重性处以适当的惩罚。
ARTICLE 3   第三条
1.The State Party in the territory of which the hostage is held by the offender shall take all measures it considers appropriate to ease the situation of the hostage,in particular,to secure his release and,after his release,to facilitate,when relevant,his departure. 1.罪犯在其领土内劫持人质的缔约国,应采取它认为适当的一切措施,以期缓和人质的处境,特别是设法使人质获得释放,并于人质获释后,如有必要,便利人质离开。
2.If any object which the offender has obtained as a result of the taking of hostages comes into the custody of a State Party,that State Party shall return it as soon as possible to the hostage or the third party referred to in article 1,as me case may be.or to the appropriate authorities thereof. 2.如缔约国已将罪犯因劫持人质而获得的物品收管,该缔约国应尽快将该物品归还人质本人或第一条所称第三方,或归还其适当当局。
ARTICLE 4 nbsp;States Parties shall co—operate in the prevention of the offences set forth in article 1,particularly by:   第四条 各缔约国应合作防止第一条所称罪行,特别是:
(a)taking all practicable measures to prevent preparations in their respective territories for the commission of those offences within or outside their territories,including measures to prohibit in their territories illegal activities of persons,groups and organizations that encourage,instigate,organize or engage in the perpetration of acts of taking of hostages; (a)采取一切实际可行的措施,以防止为在其领土内外进行此等犯罪行为而在其领土内所作的准备,包括禁止鼓励、煽动、筹划或参与劫持人质行为的个人、团体和组织在其领土内从事非法活动的措施
(b) exchanging information and co—ordinating the taking of administrative and other measures as appropriate to prevent the commission of those offences. (b)交换情报并协同采取行政和其他适当措施,以防止此等罪行的发生。
ARTICLE 5   第五条
1.Each State Party shall take such measures as may be necessary to establish its jurisdiction over any of the offences set forth in article 1 which are committed: 1.每一缔约国应采取必要的措施来确立该国对第一条所称任何罪行的管辖权,如果犯罪行为是:
(a)in its territory or on board a ship or aircraft registered in that State; (a)发生在该国领土内或在该国登记的船只或飞机上;
(b)by any of its nationals or,if that State considers it appropriate,by those stateless persons who have their habitual residence in its territory; (b)该国任何一个国民所犯的罪行,或经常居住于其领土内的无国籍人(如该国认为恰当时)所犯的罪行;
(c)in order to compel that State to do or abstain from doing any act;or (c)为了强迫该国作或不作某种行为;
(d) with respect to a hostage who is a national of that State,if that State considers it appropriate. (d)以该国国民为人质,而该国认为适当时。
2.Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 1 in cases where the alleged offender is present in its territory and it does not extradite him to any of the States mentioned in paragraph 1 of this article. 2.每一缔约国于嫌疑犯在本国领土内,而不将该嫌疑犯引渡至本条第1款所指的任何国家时,也应采取必要措施,对第一条所称的罪行确立其管辖权。
3.This Convention does not exclude any criminal jurisdiction exercised in accordance with internal law. 3.本公约不排除按照国内法行使的任何刑事管辖权。
ARTICLE 6   第六条
1.Upon being satisfied that the circumstances so warrant,any State Party in the territory of which the alleged offender is present shall.in accordance with its laws,take him into custody or take other measures to ensure his presence for such time as is necessary to enable any criminal or extradition proceedings to be instituted.That State Party shall immediately make a preliminary inquiry into the facts. 1.任何缔约国,如嫌疑犯在其领土内,当判明情况有此需要时,应按照该国法律,在进行刑事诉讼或引渡程序所需要的时间内扣留该人或采取其他措施,以保证其留在该国境内。该缔约国应立即进行初步调查,以查明事实。
2.The custody or other measures referred to in paragraph 1 of this article shall be notified without delay directly or through the Secretary—General of the United Nations to: 2.本条第1款所指的扣留或其他措施,应立即直接通知或经由联合国秘书长通知:
(a)the State where the offence was committed; (a)犯罪地国家;
(b)the State against which compulsion has been directed or attempted;
