最高人民法院关于印发《人民法院有关部门配合监察部门核查违纪违法线索暂行办法》的通知

全国地方各级人民法院、各级军事法院、各铁路运输中级法院和基层法院、各海事法院、新疆生产建设兵团各级法院：
现将《人民法院有关部门配合监察部门核查违纪违法线索暂行办法》印发给你们，望认真贯彻落实，执行中有何问题请向我院报告。

人民法院有关部门配合监察部门
核查违纪违法线索暂行办法
　　第一条　为健全人民法院有关部门与监察部门相互配合的工作机制，促进审判监督与纪律监督的有机结合，根据《人民法院监察工作条例》，制定本办法。
　　第二条　监察部门对违纪违法线索实行统一管理。人民法院有关部门及工作人员收到的违纪违法线索材料，应当交由监察部门统一处理。
有关部门在案件立案、审理、执行及案件再审、案件复查、案件评查等工作中发现的违纪违法线索，应当经部门领导签字后出具线索移送函，连同相关线索材料一并移送监察部门处理。
　　第三条　监察部门对收到的违纪违法线索，可以抽调有关部门的人员参与监察部门的核查，也可以交由本院有关部门协助核查。
参加核查工作的人员，应该保守秘密、注意方式方法，减少对审判执行工作和法院工作人员的不良影响。
　　第四条　监察部门将违纪违法线索交由有关部门协助核查时，应当经监察部门负责人批准；需要抽调有关部门人员参与核查的，应当经院领导批准。
　　第五条　有关部门收到监察部门交由本部门协助核查的违纪违法线索后，原则上应当交由廉政监察员牵头办理，尚未配备廉政监察员的部门，可以由部门主要负责人指定专人牵头办理；有关部门收到监察部门商请参与核查的通知后，应当按监察部门的要求指定廉政监察员或者其他人员予以配合。
