Measures for the Administration of Examination and Approval of the Use of Land for Construction 

建设用地审查报批管理办法


(No.3 of the Ministry of Land and Resources of the People's Republic of China, issued on March 2, 1999, and amended according to the Decision of the Ministry of Land and Resources on Amending Some Regulations issued on November 30, 2010)
 
(1999年3月2日中华人民共和国国土资源部令第3号公布 根据2010年11月30日《国土资源部关于修改部分规章的决定》修正)


   第一条 为加强土地管理,规范建设用地审查报批工作,根据《中华人民共和国土地管理法》(以下简称《土地管理法》)、《中华人民共和国土地管理法实施条例》(以下简称《土地管理法实施条例》),制定本办法。
Article 1 To strengthen land administration and regulate the examination and approval of the use of land for construction, these Measures are formulated in accordance with the Land Administration Law of the People's Republic of China (hereinafter referred to as the “Land Administration Law”) and the Regulation on the Implementation of the Land Administration Law of the People's Republic of China (hereinafter referred to as the “Regulation on the Implementation of the Land Administration Law”). 

   第二条 依法应当报国务院和省、自治区、直辖市人民政府批准的建设用地的申请、审查、报批和实施,适用本办法。
Article 2 These Measures shall apply to the examination, approval and implementation of the applications for the use of land for construction which shall be reported to the State Council or the people's government of the provinces, autonomous regions or municipalities directly under the Central Government for approval according to law. 

   第三条 县级以上人民政府土地行政主管部门负责建设用地的申请受理、审查、报批工作。
Article 3 The land administrative department of the people's government at or above the county level shall be responsible for the acceptance, examination and approval of applications for the use of land for construction. 

   第四条 建设项目可行性研究论证时,建设单位应当向建设项目批准机关的同级土地行政主管部门提出建设用地预申请。
Article 4 When conducting feasibility study and demonstration of a construction project, the construction entity shall file a preliminary application for the use of land for construction with the land administrative department at the same level of the organ that approved the construction project. 
受理预申请的土地行政主管部门应当依据土地利用总体规划和国家土地供应政策,对建设项目的有关事项进行预审,出具建设项目用地预审报告。

The land administrative department which accepts the preliminary application shall, according to the overall land use plan and the state's land supply policies, conduct a pre-examination of the relevant matters on the construction project and issue a report on the pre-examination of the use of land for the construction project.
 

   第五条 在土地利用总体规划确定的城市建设用地范围外单独选址的建设项目使用土地的,建设单位应当向土地所在地的市、县人民政府土地行政主管部门提出用地申请。
Article 5 To use a piece of land for a construction project, which is selected separately beyond the scope of land used for urban construction as determined in the overall land use plan, the construction entity shall file a land use application with the land administrative department of the people's government of the city or county where the land is located. 
建设单位提出用地申请时,应当填写《建设用地申请表》,并附具下列材料:

To file a land use application, a construction entity shall fill out an Application Form for the Use of Land for Construction, and attach the following materials:
 

 (一)建设单位有关资质证明;
1. the relevant qualification certificate of the construction entity; 

 (二)项目可行性研究报告批复或者其他有关批准文件;
2. reply to the project feasibility study report or other relevant approval documents; 

 (三)土地行政主管部门出具的建设项目用地预审报告;
3. the report on the pre-examination of land for the construction project as issued by the land administrative department; 

 (四)初步设计或者其他有关批准文件;
4. preliminary design or other relevant approval documents; 

 (五)建设项目总平面布置图;
5. general layout of the construction project; 

 (六)占用耕地的,必须提出补充耕地方案;
6. a plan for supplementing cultivated land must be provided where cultivated land is to be occupied; and 

 (七)建设项目位于地质灾害易发区的,应当提供地质灾害危险性评估报告。
7. Where a construction project is located in an area where geological disasters are likely to occur, a geological disaster risk appraisal report shall be provided. 

   第六条 市、县人民政府土地行政主管部门对材料齐全、符合条件的建设用地申请,应当受理,并在收到申请之日起30日内拟订农用地转用方案、补充耕地方案、征收土地方案和供地方案,编制建设项目用地呈报说明书,经同级人民政府审核同意后,报上一级土地行政主管部门审查。
Article 6 The land administrative department of the people's government of a city or county shall accept a qualified application for the use of land for construction which are annexed with complete materials, and draft a agricultural land conversion plan, a plan for supplementing cultivated land plan, a land expropriation plan and a land supply plan within 30 days after receiving the application, prepare a statement on the use of land for the construction project, and upon the examination and approval of the people's government at the same level, submit it to the land administrative department at the next higher level for examination. 

   第七条 在土地利用总体规划确定的城市建设用地范围内,为实施城市规划占用土地的,由市、县人民政府土地行政主管部门拟订农用地转用方案、补充耕地方案和征收土地方案,编制建设项目用地呈报说明书,经同级人民政府审核同意后,报上一级土地行政主管部门审查。
Article 7 To occupy a piece of land for implementing the urban planning within the scope of land used for urban construction as determined in the overall land use plan, the land administrative department of the people's government of a city or county shall draft an agricultural land conversion plan, a plan for supplementing cultivated land, and a land expropriation plan, prepare a statement on the use of land for the construction project, and upon the examination and approval of the people's government at the same level, submit it to the land administrative department at the next higher level for examination. 
在土地利用总体规划确定的村庄和集镇建设用地范围内,为实施村庄和集镇规划占用土地的,由市、县人民政府土地行政主管部门拟订农用地转用方案、补充耕地方案,编制建设项目用地呈报说明书,经同级人民政府审核同意后,报上一级土地行政主管部门审查。

To occupy a piece of land for implementing the village or town planning within the scope of land used for the construction of villages or towns as determined in the overall land use plan, the land administrative department of the people's government of a city or county shall draft a agricultural land conversion plan and a plan for supplementing cultivated land plan, prepare a statement on the use of land for a construction project, and upon the examination and approval of the people's government at the same level, submit it to the land administrative department at the next higher level for examination.
 

   第八条 建设只占用国有农用地的,市、县人民政府土地行政主管部门只需拟订农用地转用方案、补充耕地方案和供地方案。
Article 8 To occupy only state-owned agricultural land for construction, the land administrative department of the people's government of a city or county only needs to draft an agricultural land conversion plan, a plan for supplementing cultivated land plan and a land supply plan. 
建设只占用农民集体所有建设用地的,市、县人民政府土地行政主管部门只需拟订征收土地方案和供地方案。

To occupy only land collectively-owned by farmers for construction, the land administrative department of the people's government of a city or county only needs to draft a land expropriation plan and a land supply plan.

建设只占用国有未利用地,按照《土地管理法实施条例》二十四条规定应由国务院批准的,市、县人民政府土地行政主管部门只需拟订供地方案;其他建设项目使用国有未利用地的,按照省、自治区、直辖市的规定办理。
