| The administrations of press, publication, radio, film and television of all provinces, autonomous regions, and municipalities directly under the Central Government; and the Administration of Press, Publication, Radio, Film and Television of Xinjiang Production and Construction Corps: | | 各省、自治区、直辖市新闻出版广电局，新疆生产建设兵团广播电视局： |
| In accordance with the Regulation on Radio and Television Administration (Order No. 228 of the State Council), the Provisions on the Administration of Internet Audio-Visual Program Services (Order No. 56 of the State Administration of Radio, Film and Television and the Ministry of Information Industry), the Notice of the State Administration of Radio, Film and Television on Strengthening the Administration of Films and Television Plays Disseminated through Internet (No. 122 [2007], State Administration of Radio, Film and Television), and other relevant regulations and provisions, foreign films and television plays for dissemination through the Internet and other information networks shall obtain the Permit for Public Projection of Films or the Permit for Distribution of Television Plays according to the law. In order to develop and thrive cyber culture, inherit and carry forward China's excellent traditional culture, and positively absorb outstanding cultural achievements around the world, you are hereby notified of the relevant provisions on further implementing the administration of foreign films and television plays disseminated through information networks (hereinafter referred to as “online foreign films and television plays”) as follows: | | 根据《广播电视管理条例》（国务院令第228号）、《互联网视听节目服务管理规定》（广电总局、信息产业部令第56号）、国家广电总局《关于加强互联网传播影视剧管理的通知》（广发〔2007〕122号）等有关法规和规定，用于互联网等信息网络传播的境外影视剧应依法取得《电影片公映许可证》或《电视剧发行许可证》。为发展繁荣网络文化，在继承和弘扬中华优秀文化传统的同时，积极吸收世界优秀文化成果，现就进一步落实信息网络传播境外影视剧（以下简称网上境外影视剧）管理的有关规定，通知如下： |
| I. While safeguarding the dominant position of China's ethnic culture, foreign films and television plays shall be appropriately introduced for dissemination through information networks, so as to satisfy the increasing spiritual and cultural needs of the people. Qualified websites providing services for Internet audio-visual programs shall be encouraged to introduce and broadcast foreign films and televisions plays with healthy content, good workmanship, and promotion of all things good and true. | | 一、在维护我国民族文化主体地位的同时，适量引进境外影视剧供信息网络传播，满足人民群众日益增长的精神文化需求。鼓励符合条件的互联网视听节目服务网站引进播出内容健康、制作精良、弘扬真善美的境外影视剧。 |
| II. Foreign films and television plays broadcast online shall obtain such approval documents issued by administrations of press, publication, radio, film and television as the Permit for Public Projection of Films and the Permit for Distribution of Television Plays and obtain the right to disseminate through information network granted by copyright owners. None of the foreign films and television plays that fail to obtain the Permit for Public Projection of Films or the Permit for Distribution of Television Plays may be broadcast online. | | 二、网上播出的境外电影、电视剧，应依法取得新闻出版广电部门颁发的《电影片公映许可证》或《电视剧发行许可证》等批准文件，并取得著作权人授予的信息网络传播权。未取得《电影片公映许可证》或《电视剧发行许可证》的境外影视剧一律不得上网播放。 |
| III. Websites that have legally obtained the Permit for Audio-Visual Programs Disseminated through Information Networks issued by the State Administration of Press, Publication, Radio, Film and Television (“SAPPRFT”) and whose licensing items include “item (5) under Internet audio-visual program services of second category: compiling and broadcast business of such audio-visual programs as films, television plays, and animations” may introduce foreign films and television plays specially for dissemination through information networks. | | 三、依法取得国家新闻出版广电总局颁发的《信息网络传播视听节目许可证》，且许可项目含有“第二类互联网视听节目服务第五项：电影、电视剧、动画片类视听节目的汇集、播出业务”的网站，可以引进专门用于信息网络传播的境外影视剧。 |
| All websites are only allowed to introduce foreign films and television plays that are broadcast on their own websites and at the same time of broadcasting such foreign films and television plays on their own websites, where copyright conditions are met, they may sell them to other certified websites with qualification of broadcasting films and television plays. No website may introduce foreign films and television plays and specially sell them to other websites for broadcasting. | | 各网站只能引进用于本网站播放的境外影视剧，也可在本网站播放的同时，在符合版权要求的情况下，销售给其他具有影视剧播放资质的持证网站播放。各网站不能引进境外影视剧专门销售给其他网站播放。 |
The total volume of foreign films and television plays annually introduced by a single website may not exceed 30% of that of domestic films and television plays purchased or broadcast by the website in the previous year.
