The Regulations of Shaanxi Province on Conservation of Energy Sources adopted at the 27th Meeting of the Standing Committee of the 10th People's Congress of Shaanxi Province on September 28th, 2006, and are now promulgated and shall be in force as of December 1st, 2006.
 
《陕西省节约能源条例》已于2006年9月28日经陕西省第十届人民代表大会常务委员会第二十七次会议通过,现予公布,自2006年12月1日起施行。

Chapter I General Provisions 第一章 总则

 
Article 1 These Regulations have been formulated for the purpose of promoting energy conservation in the whole society, improving energy utilization efficiency and economic benefits, developing circular economy, protecting environment, constructing the conservation-typed society, guaranteeing the sustainable development of national economy and society, in accordance with the Law of the People's Republic of China on Conservation of Energy Sources and other related laws, administrative regulations, and in combination with the actual circumstances of Shaanxi Province.   第一条 为了推进全社会节约能源,提高能源利用效率和经济效益,发展循环经济,保护环境,建设节约型社会,保障国民经济和社会可持续发展,根据《中华人民共和国节约能源法》和其他有关法律、行政法规,结合本省实际,制定本条例。

 
Article 2 The term “Energy Sources” as called in these Regulations means a variety of useful resources such as the coal, crude oil, natural gas, electric power, coke, coal gas, heating power, product oil, liquefied petroleum gas, biomass energy and other available energies acquired directly or via the processing and conversion.   第二条 本条例所称能源,是指煤炭、原油、天然气、电力、焦炭、煤气、热力、成品油、液化石油气、生物质能和其他直接或者通过加工、转换而取得有用能的各种资源。

 
Article 3 The term “Energy Conservation” as called in these Regulations means strengthening the administration in the development and use of Energy Sources, adopting measures that are technologically feasible, economically reasonable, and environmentally and socially bearable, reducing the losses and wastes at every stage from the production through to the consumption of Energy Sources, and making use of Energy Sources efficiently and reasonably.   第三条 本条例所称的节能,是指加强开发和使用能源的管理,采取技术上可行、经济上合理以及环境和社会可以承受的措施,减少从能源生产到消费各个环节中的损失和浪费,有效、合理地利用能源。

 
Article 4 Theses Regulations shall apply to the actions such as the development, the management, the utilization, and the administration of Energy Sources and so on within the administrative region of Shaanxi Province.   第四条 本省行政区域内从事能源的开发、经营、利用、管理等活动,适用本条例。

 
Article 5 Energy Conservation shall follow the guidelines of simultaneous act on the the conservation of Energy Sources and the development of Energy Sources, and Energy Conservation having the priority, efficiency being the root; and persist in the principles of macroscopic readjustment and control, market-orientation, policy incentives, technological promotion, and enterprises the priority and the whole society to participate.   第五条 节能遵循能源节约与能源开发并举、节能优先、效率为本的方针,坚持宏观调控、市场引导、政策激励、技术推进和企业为主、全社会参与的原则。

 
Article 6 The people's governments at or above county levels shall strengthen the leadership in the Energy Conservation, bring the protection of Energy Conservation into the economic and social development programming within their own administrative regions, adjust reasonably the production framework, the industrial structure, and the energy using structure, strengthen the works of Energy Conservation in the key fields such as the industry, building industry, traffic and transportation industry, agriculture, commerce and of government departments, advance the technological progress for Energy Conservation, establish and perfect the guarantee mechanism for Energy Conservation, and promote the advancing of the utilization efficiency of Energy Sources and the reasonable use of Energy Sources in the whole society.   第六条 县级以上人民政府应当加强对节能工作的领导,将节能工作纳入本行政区国民经济和社会发展规划,合理调整产业结构、工业结构、用能结构,加强工业、建筑业、交通运输业、农业、商业等重点领域和政府机构的节能工作,推进节能技术进步,建立健全节能保障机制,促进能源利用效率的提高和全社会的合理用能。

 
Article 7 The development and reform administrative department of the people's government of Shaanxi Province shall be the administrative superintending departments for Energy Conservation in Shaanxi Province, take charge for the administration and supervision of Energy Conservation in Shaanxi Province, the monitoring and inspection department affiliated to the Province shall be specifically in charge of the supervision of Energy Conservation.   第七条 省人民政府发展和改革行政部门是本省节能行政主管部门,负责全省节能的监督管理工作,其所属的节能监测检查机构具体负责节能监察工作。

The administrative superintending departments of Energy Conservation of the people's governments of cities with districts, counties (cities, districts) shall be in charge of the supervision and administration of Energy Conservation within their respective administrative regions.
 
设区的市、县(市、区)人民政府节能行政主管部门负责本行政区域内的节能监督管理工作。

The related departments of the people's governments at or above county levels shall be in charge of the work of the supervision and administration of Energy Conservation in accordance with the provisions of laws and regulations.
 
县级以上人民政府有关部门按照法律法规规定的职责负责节能监督管理工作。

 
Article 8 The people's governments at or above county levels and their related departments shall carry on the propaganda and education activities on Energy Conservation and popularize the scientific knowledge of Energy Conservation.   第八条 县级以上人民政府及其有关部门应当开展节能宣传和教育活动,普及节能科学知识。

The news media should strengthen the guidance and supervision of public opinions of Energy Conservation; publicize the laws and regulations on Energy Conservation, construct the social atmosphere for Energy Conservation.
 
新闻媒体应当加强对节能的舆论引导和监督,宣传节能法律、法规,营造节能的社会氛围。

Every unit and individual should enhance the consciousness of Energy Conservation and fulfill their obligations of Energy Conservation.
 
任何单位和个人都应当增强节能意识,履行节能义务。

 
Article 9 The people's governments at or above county levels and their relevant departments should bestow honors and rewards to the units and individuals that have made notable achievements in the work of the administration, the researches on the scientific technology, and the promotion of Energy Conservation.   第九条 县级以上人民政府及其有关部门对在节能管理、节能科学技术研究和推广工作中取得显著成绩的单位和个人应当给予表彰和奖励。

 
Chapter II Administration of Energy Conservation 

第二章 节能管理


 
Article 10 The Energy Conservation administrative superintending departments of Shaanxi Province shall work out the programming and the annual plan of Energy Conservation of the Province, according to the State's goal of Energy Conservation and the real situation of energy use in Shaanxi Province, and make the implementation after submitting to the provincial people's government for approval. The other administrative departments of the people's government of Shaanxi Province should establish the special programming and the annual plan of Energy Conservation in accordance with the programming and the annual plan of Energy Conservation of the whole Province as well as organize the implementation. The afore said special programming and the annual plan of Energy Conservation should be submitted to the Energy Conservation administrative department of Shaanxi Province to put on records.   第十条 省节能行政主管部门应当根据国家节能目标和本省用能的实际,编制本省的节能规划和年度计划,报省人民政府批准后实施。省人民政府其他行政部门应当根据全省节能规划和年度计划,制定本行业的节能专项规划和年度计划并组织实施。节能专项规划和年度计划应当报省节能行政主管部门备案。

The Energy Conservation administrative departments of the people's governments of cities with districts, counties (cities, districts) should work out the Energy Conservation programming and the annual plan within their administrative regions, according to the provincial Energy Conservation programming and the annual plan, and organize the implementation after being approved by the people's government at the same level, as well as submit to the Energy Conservation administrative department at a higher level to put on records.
 
设区的市、县(市、区)节能行政主管部门应当根据省节能规划和年度计划编制本行政区域的节能规划和年度计划,经本级人民政府批准后组织实施,并报上一级节能行政主管部门备案。

 
Article 11 The people's governments at or above county levels shall carry out the responsibility system of Energy Conservation target, establish the testing and evaluating system for Energy Conservation. The people's government at a higher level shall sign the responsibility letter of Energy Conservation target with the people's government at a lower level, the Energy Conservation administrative superintending departments should sign the responsibility letter of Energy Conservation target with the key energy-using units.   第十一条 县级以上人民政府应当实行节能目标责任制,建立节能评价考核体系。上级人民政府应当和下一级人民政府签订节能目标责任书,节能行政主管部门应当和重点用能单位签订节能目标责任书。

 
Article 12 The people's governments at or above county levels shall optimize the industrial framework, plan reasonably the industrial and regional layout, renovate the traditional industry, develop the circular economy, and engender the energy-saving type industrial system with low investment, low energy consumption, low emission but high efficiency, in accordance with the Guidance List of Industrial Framework Restructuring of the State Council, in combination with the actual circumstances of their administrative regions, and according to the guideline of Energy Conservation being the priority.   第十二条 县级以上人民政府应当根据国务院《产业结构调整指导目录》,结合本行政区实际,按照节能优先的方针,优化产业结构,合理规划产业和地区布局,改造传统产业,发展循环经济,形成低投入、低能耗、低排放和高效率的节能型产业体系。

 
Article 13 The people's governments at or above county levels shall adjust their industrial structures according to their local practical situations so as to encourage and support the high-value-added and low-energy-consumption projects.   第十三条 县级以上人民政府应当根据本地区实际,调整工业结构,鼓励和支持发展高附加值、低耗能的项目。

The people's governments at or above county levels shall speed up the technical innovation of the enterprises with high energy consumption, reduce the energy consumption, eliminate the out -dated production processes, technologies, and equipment within time limit.
 
县级以上人民政府应当对高耗能的企业,加快技术改造,降低能耗,限期淘汰落后的生产工艺、技术和设备。

Do not construct new industrial projects that are technically outdated, highly energy-consuming, and prodigiously wasting energy, which is prohibited explicitly by the State Regulations.
 
不得新建国家明令禁止的技术落后、能耗过高、严重浪费能源的工业项目。

 
Article 14 The people's governments at or above county levels shall give play to the superiority of service industry in low energy consumption and less pollution, raise the proportion of service industry to national economy, optimize service industry structure, promote the development of the service industry. The large and medium sized cities, if conditions permit, shall progressively form the industrial structure of service-based economy.   第十四条 县级以上人民政府应当发挥服务业能耗低、污染少的优势,提高服务业在国民经济中的比重,优化服务业结构,促进服务业发展。有条件的大中城市应当逐步形成以服务经济为主的产业结构。

 
Article 15 The feasibility study report on fixed asset investment project shall include special demonstration of reasonable use of energy. The special demonstration shall contain energy consumption, the index of unit comprehensive energy consumption and energy saving measures of main products.   第十五条 固定资产投资项目的可行性研究报告,应当包括合理用能的专题论证。专题论证中应当包括能耗量、主要产品的单位产品综合能耗指标和节能措施等内容。

The administrative departments of development and reform at or above county level shall inspect the special demonstration on reasonable use of energy, the examination and approval authorities shall not approve the project which can not conform to the standard of reasonable use of energy and the design requirement of Energy Conservation; after the project has been completed, it shall not put into service if it fails to conform to the standard of reasonable use of energy and the design requirement of Energy Conservation.
 
县级以上发展和改革行政部门应当对合理用能专题论证进行审查。达不到合理用能标准和节能设计规范要求的项目,审批机关不得批准建设;项目建成后,达不到合理用能标准和节能设计规范要求的,不得投入使用。

The fixed asset investment project with annual comprehensive total energy consumption of more than 3000 ton of standard coal shall be subject to energy audit according to the national regulations.
 
年综合能源消费总量在三千吨标准煤以上的固定资产投资项目,应当按照国家有关规定进行节能评估。

 
Article 16 The energy-using unit whose annual comprehensive total energy consumption of more than 5000 ton of standard coal shall be considered as the key energy-using unit.   第十六条 年综合能源消费总量在五千吨标准煤以上的用能单位为重点用能单位。

The administrative departments of the Energy Conservation at city, county level (city, district) shall strengthen the supervision and administration of the energy using unit whose annual comprehensive total energy consumption of more than 3000t but less than 5000t of standard coal according to their local practical situation.
 
设区的市、县(市、区)节能行政主管部门应当根据本地区实际,加强对年综合能源消费总量在三千吨以上不满五千吨标准煤的用能单位的监督管理。

The limits of authority of the supervision and administration on the energy-using unit shall be determined by the provincial administrative departments of energy consumption.
 
对用能单位监督管理的权限,由省节能行政主管部门确定。

 
Article 17 The Energy Conservation administrative departments of Shaanxi Province, in conjunction with the departments concerned shall set quotas for energy consumption per unit product in Shaanxi Province, for products which consume excessive amounts of energy in the course of production on the principle of the science and reasonablization.   第十七条 省节能行政主管部门应当会同有关部门根据科学、合理的原则,对本省生产过程中耗能较高的产品制定单位产品能耗限额。

If there is no national, industrial standards of Energy Conservation, the provincial administrative departments of standardization shall organize and formulate local standards of Energy Conservation according to the principle of technical advancement and economic reasonability, which shall be revised and improved continuously.
