| Publication of the Application Conditions and Procedures for the Indium and Tin Export Quotas in 2016 | | （2015年第50号） |
| In order to protect resources and environment, coordinate with the state's industry policies, further strengthen the export administration of rare metal, and regulate the order of export trade, the Application Conditions and Procedures for the Indium and Tin Export Quotas in 2016 are hereby published in accordance with the relevant provisions of the Foreign Trade Law of the People's Republic of China and the Regulation of the People's Republic of China on the Administration of the Import and Export of Goods. | | 公布《2016年铟、锡出口配额申报条件及申报程序》为保护资源和环境，配合国家产业政策，加强稀有金属出口管理，规范出口经营秩序，根据《中华人民共和国对外贸易法》、《中华人民共和国货物进出口管理条例》的有关规定，现公布《2016年铟、锡出口配额申报条件及申报程序》。 |
| I. Application Conditions for an Export Quota of Indium | | 一、铟出口配额申报条件 |
| (1) A production enterprise | | （一）生产企业。 |
| An enterprise holding an export quota in 2015 or a new applicant may apply for an export quota of indium in 2016 if it meets the following conditions: | | 已获得2015年出口配额的企业及新申请企业，如符合以下条件可申请2016年铟出口配额： |
| (a) Its production has been approved by the relevant authorities, and it complies with industry policies, has been qualified to engage in the import and export trade or has undergone the recordation and registration as a foreign trade business, and is an independent legal entity. | | 1.有关部门批准生产、符合产业政策、获得进出口经营资格或办理对外贸易经营者备案登记、具有独立法人资格的企业。 |
| (b) As a new applicant, its average outputs from 2012 to 2014 are up to the following standards: above 12 tons for lead, zinc, copper, tin and antimony smelting enterprises; above 18 tons for zinc chemical production enterprises; and above 22 tons for independent recovery processing enterprises. The output data are those reviewed by industry organizations. | | 2.新申请企业以2012-2014年三年平均产量为准：铅、锌、铜、锡、锑冶炼企业12吨以上；锌化工生产企业18吨以上；独立回收加工企业22吨以上。产量以经行业组织复核的数据为准。 |
| (c) As an independent recovery processing enterprise, the processing of crude indium and the processing of refined indium shall be completed within the same legal person. | | 3.独立回收加工企业粗铟加工和精铟加工过程必须在同一法人企业完成。 |
| (d)Its product quality meets the current industry standards, and it has passed the ISO9000 quality management system certification and the ISO14000 environmental management system certification. | | 4.产品质量达到现行行业标准，并通过ISO9000系列质量体系认证和ISO14000系列环境管理体系认证。 |
| (e) Its industrial dust, waste water, exhaust, and other emissions meet the current national standards, including: | | 5.工业粉尘、废水、废气排放等达到国家现行标准，包括： |
| (i) achieving zero discharge of waste water in smelting process; and reaching the national level-I emission standards for sulfur dioxide (SO2) and arsenic hydride (AsH3); | | （1）冶炼工艺废水达到零排放；二氧化硫（SO2）、砷化氢（AsH3） 等达到国家一级排放标准； |
| (ii) being equipped with a comprehensive recovery system for the treatment of smelting waste slag, without the discharge of “three wastes”; and | | （2）冶炼废渣处理有配套的综合回收系统，无三废排放； |
| (iii) as a smelting enterprise, not transferring smelting waste water and slag containing indium to any third party. | | （3）冶炼企业不能向第三方转移含铟冶炼废水和废渣。 |
| (f) Its recovery rate of indium from main metal residues is not less than 80%. | | 6.主产金属废渣中提取铟的回收率不小于80％。 |
| (g) Its processes and equipment for production and environmental protection are advanced, and its major devices, apparatuses and instruments are manufactured after 1995. | | 7.生产和环保的工艺、装备先进，主要设备、仪器、仪表为1995年后制造。 |
| (h) As a smelting enterprise, its concentrate and primary raw materials are all purchased from mining enterprises holding mining licenses, and relevant documents on completion of required legal formalities shall be provided for the imported raw materials used by it. | | 8.冶炼企业所采购的精矿及初级原料均是来自取得采矿许可证的开采企业，其所用进口原料需提供相关合法手续。 |
| (i)As an independent recovery enterprise, proof of legal sources shall be provided for the raw materials purchased by it. | | 9.独立回收企业所采购的原料需提供其合法来源证明。 |
| (j) If its products are those listed in theExport HYPERLINK "javascript:ESLC(27005,0)" Catalogue of High-Tech Products in China issued by the Ministry of Science and Technology, the Ministry of Commerce, the Ministry of Finance, the State Administration of Taxation and the General Administration of Customs or the Catalogue of Chinese High-Tech Products issued by the Ministry of Science and Technology or are high-tech products certified by the Ministry of Science and Technology, the standard in subparagraph (b) above shall be lowered appropriately according to the specific circumstances. | | 10.企业所产产品为科技部、商务部、财政部、税务总局、海关总署发布的《中国高新技术产品出口目录》或科技部发布的《中国高新技术产品目录》中所列产品，或经科技部认定的高新技术产品，视具体情况适当降低以上第2款标准。 |
| (k) It complies with the relevant laws and regulations of the state and the relevant provisions issued by the local government, and as legally required, participates in endowment, unemployment, medical, work-related injury, maternity, and other social insurance, with social insurance premiums fully paid on time; and provide relevant certificates showing its full payment of various social insurance premiums on time as issued by the local human resources and social security department at or above the prefectural level. | | 11.遵守国家有关法律法规和当地政府的有关规定，依法参加养老、失业、医疗、工伤、生育等各项社会保险并按期足额缴纳社会保险费，并提供所在地地级以上人力资源社会保障部门出具的已按期时足额缴纳各项社会保险费的相关证明。 |
| (l)It did not commit any violation of the relevant laws and regulations of the state from 2012 to 2014. | | 12.2012-2014年无违反国家有关法律法规的行为。 |
| (2) A circulation enterprise | | （二）流通企业。 |
(a) It has held the import and export trade qualification or maintained its recordation and registration status as a foreign trade business and existed as an independent legal entity for more than five years.
