| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 The Measures are developed to establish and improve the mechanism of coordination between administrative law enforcement and criminal justice in work safety, punish the illegal and criminal acts on work safety according to law, protect life and property safety of the people, and maintain social stability in accordance with such laws, administrative regulations, judicial interpretations and relevant provisions as the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Work Safety Law of the People's Republic of China, the Fire Protection Law of the People's Republic of China, the Provisions on the Transfer of Suspected Criminal Cases by Administrative Organs for Law Enforcement, the Regulations on the Reporting, Investigation and Disposition of Work Safety Accidents, and the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Application of Law in the Handling of Criminal Cases involving Crimes Endangering Production Safety. | | 第一条 为了建立健全安全生产行政执法与刑事司法衔接工作机制，依法惩治安全生产违法犯罪行为，保障人民群众生命财产安全和社会稳定，依据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》《中华人民共和国安全生产法》《中华人民共和国消防法》和《行政执法机关移送涉嫌犯罪案件的规定》《生产安全事故报告和调查处理条例》《最高人民法院 最高人民检察院关于办理危害生产安全刑事案件适用法律若干问题的解释》等法律、行政法规、司法解释及有关规定，制定本办法。 |
| Article 2 The Measures shall apply to the cases involving suspected work safety crime handled by the emergency management authorities, public security organs, the people's courts and the people's procuratorates. | | 第二条 本办法适用于应急管理部门、公安机关、人民法院、人民检察院办理的涉嫌安全生产犯罪案件。 |
| Other suspected criminal cases discovered by the emergency management authorities in investigating and punishing illegal acts shall be handled by reference to the Measures. | | 应急管理部门查处违法行为时发现的涉嫌其他犯罪案件，参照本办法办理。 |
| For the purpose of the Measures, “emergency management authorities” include coal mine safety administrations and fire-fighting agencies. | | 本办法所称应急管理部门，包括煤矿安全监察机构、消防机构。 |
| The cases involving suspected work safety crime that is committed by public officials exercising public power and should be investigated by the supervisory organs as provided in the Supervision Law of the People's Republic of China shall not be governed by the Measures, and shall be transferred to the supervisory organs in a timely manner according to law. | | 属于《中华人民共和国监察法》规定的公职人员在行使公权力过程中发生的依法由监察机关负责调查的涉嫌安全生产犯罪案件，不适用本办法，应当依法及时移送监察机关处理。 |
| Article 3 The cases involving suspected work safety crime mainly include the cases related to: | | 第三条 涉嫌安全生产犯罪案件主要包括下列案件： |
| 1. serious accidents caused by negligence; | | （一）重大责任事故案件； |
| 2. forced risky operation in violation of rules; | | （二）强令违章冒险作业案件； |
| 3. serious accidents in labor safety; | | （三）重大劳动安全事故案件； |
| 4. accidents caused by dangerous articles; | | （四）危险物品肇事案件； |
| 5. fire control incidents, and fire accidents; | | （五）消防责任事故、失火案件； |
| 6. concealment and false report of safety accidents; and | | （六）不报、谎报安全事故案件； |
| 7. illegal mining; illegal manufacturing, trading, and storage of explosives; illegal operation; and other criminal cases concerning production safety, such as forging, altering and trading of official documents, certificates and seals of government agencies. | | （七）非法采矿，非法制造、买卖、储存爆炸物，非法经营，伪造、变造、买卖国家机关公文、证件、印章等涉嫌安全生产的其他犯罪案件。 |
| Article 4 The people's procuratorates shall exercise legal supervision over the cases involving suspected work safety crime transferred by the emergency management authorities and the case-filing activities of the public security organs. | | 第四条 人民检察院对应急管理部门移送涉嫌安全生产犯罪案件和公安机关有关立案活动，依法实施法律监督。 |
| Article 5 All emergency management authorities, public security organs, people's procuratorates, and people's courts shall strengthen collaboration with each other, unify the application of laws, and continuously improve the mechanisms of case transfer, notice of cases, and information sharing. | | 第五条 各级应急管理部门、公安机关、人民检察院、人民法院应当加强协作，统一法律适用，不断完善案件移送、案情通报、信息共享等工作机制。 |
| Article 6 If the emergency management authorities discover the clues to the issues involving suspected work safety crime committed by public officials exercising public power, or if the emergency management authorities, public security organs, people's procuratorates, and people's courts discover the clues to the issues involving corruption, bribery, neglect of duty, malfeasance in office, and any other duty-related violations or duty-related crimes committed by public officials exercising public power, they shall transfer the clues to the supervisory organs in a timely manner according to law. | | 第六条 应急管理部门在行政执法过程中发现行使公权力的公职人员涉嫌安全生产犯罪的问题线索，或者应急管理部门、公安机关、人民检察院在查处有关违法犯罪行为过程中发现行使公权力的公职人员涉嫌贪污贿赂、失职渎职等职务违法或者职务犯罪的问题线索，应当依法及时移送监察机关处理。 |
| Chapter II Case Transfer and Legal Supervision in Regular Law Enforcement | | 第二章 日常执法中的案件移送与法律监督 |
| Article 7 If, in the process of investigating and punishing illegal acts, the emergency management authority discovers a case involving suspected work safety crime, it shall immediately designate two or more administrative law enforcement officers to set up a special task force, and put forward a written report on case transfer after verifying the circumstances. The chief principal or the person in charge shall, within three days after receiving the report, make the decision of whether to approve the transfer. If the transfer is approved, the case shall be transferred to the public security organ at the same level; and if otherwise, the reasons for not approving it shall be put on record. | | |
| Article 8 If the emergency management authority transfers a case involving suspected work safety crime to the public security organ, the following materials shall be attached, and the letter of transfer shall be copied to the people's procuratore at the same level. | | 第八条 应急管理部门向公安机关移送涉嫌安全生产犯罪案件，应当附下列材料，并将案件移送书抄送同级人民检察院。 |
1. A letter of transfer, on which the name of the emergency management authority transferring the case, suspected crime of the illegal act, principal person in charge of the case and his or her telephone number shall be stated. The letter of transfer shall be attached with a list of transferred materials and affixed with the official seal of the emergency management authority;
