Measures for the Administration of the Examination and Submission for Approval of Construction Land 

建设用地审查报批管理办法

(issued by the Order No.3 of the Ministry of Land and Resources of the People's Republic of China, issued on March 2, 1999, amended for the first time on November 30, 2010, and amended for the second time according to the Decision of the Ministry of Land and Resources to Amend the Measures for the Administration of the Examination and Submission for Approval of Construction Land by the Order No.69 of the Ministry of Land and Resources on November 25, 2016) (1999年3月2日中华人民共和国国土资源部令第3号发布 2010年11月30日第一次修正 根据2016年11月25日国土资源部令第69号《国土资源部关于修改〈建设用地审查报批管理办法〉的决定》第二次修正)

Article 1 To strengthen land administration and regulate the examination and approval of the use of land for construction, these Measures are formulated in accordance with the Land Administration Law of the People's Republic of China (hereinafter referred to as the “Land Administration Law”) and the Regulation on the Implementation of the Land Administration Law of the People's Republic of China (hereinafter referred to as the “Regulation on the Implementation of the Land Administration Law”).   第一条 为加强土地管理,规范建设用地审查报批工作,根据《中华人民共和国土地管理法》(以下简称《土地管理法》)、《中华人民共和国土地管理法实施条例》(以下简称《土地管理法实施条例》),制定本办法。
Article 2 These Measures shall apply to the examination, approval and implementation of the applications for the use of land for construction which shall be reported to the State Council or the people's government of the provinces, autonomous regions or municipalities directly under the Central Government for approval according to law.   第二条 依法应当报国务院和省、自治区、直辖市人民政府批准的建设用地的申请、审查、报批和实施,适用本办法。
Article 3 The department of land and resources of the people's government at or above the county level shall be responsible for the acceptance, examination and approval of applications for the use of land for construction.   第三条 县级以上国土资源主管部门负责建设用地的申请受理、审查、报批工作。
Article 4 At the stage of approval, confirmation, or recordation of a construction project, the construction project owner shall apply for pre-examination of land used for the construction project to the department of land and resources at the same level of the construction project approval authority.   第四条 在建设项目审批、核准、备案阶段,建设单位应当向建设项目批准机关的同级国土资源主管部门提出建设项目用地预审申请。
The department of land and resource that accepts a pre-examination application shall, according to the comprehensive plan for land utilization, standards of land use, and the state's land supply policies, conduct pre-examination of the relevant matters on the construction project, and issue a pre-examination opinion on the land used for the construction project. 受理预审申请的国土资源主管部门应当依据土地利用总体规划、土地使用标准和国家土地供应政策,对建设项目的有关事项进行预审,出具建设项目用地预审意见。
Article 5 To use a piece of land for a construction project, which is selected separately beyond the scope of land used for urban construction as determined in the overall land use plan, the construction entity shall file a land use application with the department of land and resources of the people's government of the city or county where the land is located.   第五条 在土地利用总体规划确定的城市建设用地范围外单独选址的建设项目使用土地的,建设单位应当向土地所在地的市、县国土资源主管部门提出用地申请。
The construction project owner shall, when filing a land use application, complete an Application Form for Construction Land, with the following materials attached thereto: 建设单位提出用地申请时,应当填写《建设用地申请表》,并附具下列材料:
(1) Pre-examination opinion on the land used for the construction project; (一)建设项目用地预审意见;
(2) The approval, confirmation, or recordation document on the construction project; (二)建设项目批准、核准或者备案文件;
(3) The preliminary design approval or confirmation document for the construction project. (三)建设项目初步设计批准或者审核文件。
Where a construction project is to occupy arable land, a proposal on arable land replenishment shall also be submitted; or where a construction project is located in an area where geological hazards tend to occur, a geological hazard risk evaluation report shall also be provided. 建设项目拟占用耕地的,还应当提出补充耕地方案;建设项目位于地质灾害易发区的,还应当提供地质灾害危险性评估报告。
Article 6 For a unit construction with a controlled construction period and other constructions in urgent need of commencement due to a tight project schedule or seasonal effects under a key construction project of the state, the department of land and resources of a province, an autonomous region, or a municipality directly under the Central Government may apply to the Ministry of Land and Resources for land use in advance.   第六条 国家重点建设项目中的控制工期的单体工程和因工期紧或者受季节影响急需动工建设的其他工程,可以由省、自治区、直辖市国土资源主管部门向国土资源部申请先行用地。
that applies for land use in advance shall submit the following materials: 申请先行用地,应当提交下列材料:
(1) An application of the department of land and resources of the province, autonomous region, or municipality directly under the Central Government for land use in advance. (一)省、自治区、直辖市国土资源主管部门先行用地申请;
(2) The pre-examination opinion on the land used for the construction project. (二)建设项目用地预审意见;
(3) The approval, confirmation, or recordation document on the construction project. (三)建设项目批准、核准或者备案文件;
(4) The preliminary design approval or confirmation document on the construction project or the document of the relevant department to confirm the project construction. (四)建设项目初步设计批准文件、审核文件或者有关部门确认工程建设的文件;
(5) Other materials as required by the Ministry of Land and Resources. (五)国土资源部规定的其他材料。
If the land use in advance is approved, the submission and approval formalities for land use shall be completed during the specified period. 经批准先行用地的,应当在规定期限内完成用地报批手续。
Article 7 The department of land and resources of the people's government of a city or county shall accept a qualified application for the use of land for construction which are annexed with complete materials, and draft a agricultural land conversion plan, a plan for supplementing cultivated land plan, a land expropriation plan and a land supply plan within 30 days after receiving the application, prepare a statement on the use of land for the construction project, and upon the examination and approval of the people's government at the same level, submit it to the department of land and resources at the next higher level for examination.   第七条 市、县国土资源主管部门对材料齐全、符合条件的建设用地申请,应当受理,并在收到申请之日起30日内拟订农用地转用方案、补充耕地方案、征收土地方案和供地方案,编制建设项目用地呈报说明书,经同级人民政府审核同意后,报上一级国土资源主管部门审查。
Article 8 To occupy a piece of land for implementing the urban planning within the scope of land used for urban construction as determined in the overall land use plan, the department of land and resources of the people's government of a city or county shall draft an agricultural land conversion plan, a plan for supplementing cultivated land, and a land expropriation plan, prepare a statement on the use of land for the construction project, and upon the examination and approval of the people's government at the same level, submit it to the department of land and resources at the next higher level for examination.   第八条 在土地利用总体规划确定的城市建设用地范围内,为实施城市规划占用土地的,由市、县国土资源主管部门拟订农用地转用方案、补充耕地方案和征收土地方案,编制建设项目用地呈报说明书,经同级人民政府审核同意后,报上一级国土资源主管部门审查。
To occupy a piece of land for implementing the village or town planning within the scope of land used for the construction of villages or towns as determined in the overall land use plan, the department of land and resources of the people's government of a city or county shall draft a agricultural land conversion plan and a plan for supplementing cultivated land plan, prepare a statement on the use of land for a construction project, and upon the examination and approval of the people's government at the same level, submit it to the department of land and resources at the next higher level for examination.
