| In order to implement the Several Opinions on Improving the Judicial Responsibility System of the People's Procuratorates and build the operating mechanism of procuratorial power with clear powers and responsibilities, and justice and effectiveness, the following guiding opinions on further improving the power list of public procurators are hereby raised as follows: | | 为贯彻落实《关于完善人民检察院司法责任制的若干意见》，构建权责明晰、公正高效的检察权运行机制，现就进一步完善检察官权力清单提出如下指导意见。 |
| I. The preparation of the power list of public procurators shall, according to the requirements of “whoever handles the case and makes a decision shall be responsible,” adhere to the combination of following the judicial rules and matching the characteristics of the procuratorial work, adhere to the unification of highlighting the dominant position of public procurators and guaranteeing the leadership of the chief procurator in the judicial case-handling work, keep a foothold of the functions and positioning of the people's procuratorates at various levels, and scientifically define the internal judicial case-handling power of the people's procuratorates. | | 一、制定检察官权力清单应当按照谁办案谁负责、谁决定谁负责的要求，坚持遵循司法规律和符合检察工作特点相结合，坚持突出检察官主体地位与保证检察长对司法办案工作的领导相统一，立足不同层级人民检察院的职能和定位，科学界定人民检察院内部司法办案权限。 |
| II. The power list of public procurators shall be prepared by the people's procuratorate at the provincial level. The people's procuratorate at the provincial level shall, in light of the actual local circumstances and according to the functions of the people's procuratorates at various levels, separately make stipulations on the judicial case-handling powers of public procurators of the people's procuratorates at three levels within its jurisdiction. | | 二、检察官权力清单由省级人民检察院制定。省级人民检察院应当结合本地实际，根据不同层级人民检察院的职能，对辖区内三级人民检察院检察官司法办案权限分别作出规定。 |
| III. The power list of public procurators shall specify the decision-making powers of the procuratorial committee, the chief procurator (deputy chief procurator), and the public procurators for case-handling matters. In principle, the case-handling duties, non-case-handling business, operational and transitional work as well as judicial responsibilities may not be listed in the power list. | | 三、检察官权力清单应当以明确检察委员会、检察长（副检察长）、检察官办案事项决定权为主要内容。办案职责、非办案业务、操作性及事务性工作以及司法责任等内容原则上不列入权力清单。 |
| IV. At the present stage, it is appropriate that the power list of public procurators shall specify the decision-making powers of the procuratorial committee, the chief procurator (deputy chief procurator), and the public procurators for case-handling matters. In the event of any possible unclear decision-making power in practice, the decision-making power shall be exercised by the chief procurator or the procuratorial committee, or the chief procurator may authorize public procurators of the same people's procuratorate to exercise the decision-making power in the form of a written order depending on the actual circumstances. | | 四、现阶段，检察官权力清单应当以具体列明检察委员会、检察长（副检察长）、检察官各自的办案事项决定权为宜。对实践中可能出现决定权限不明的，由检察长或检察委员会行使，也可以由本院检察长根据情况以书面指令形式委托检察官行使。 |
V. In the power list of public procurators, the scope of matters subject to the decision-making of public procurators shall be determined according to the case-handling duties of the people's procuratorates at various levels and the nature and characteristics of various business and by taking into full account of the degree of effects on the rights of the parties and other judicial organs of law enforcement, the materiality, complexity, and difficulty of the case handled, and other factors.
