| Construction guarantee is one of the important measures to transfer, share, prevent and dissolve risks in construction projects. It provides not only a strong support for the market credit system, but also an effective means of construction quality and safety guarantee. With the existing problems of poor risk resistance, frequent occurrences of performance disputes, and failed attempts to prohibit project arrears and unpaid wages in the construction market, there is a dire need to solve these problems through a complete construction guarantee system. Therefore, the opinions are hereby offered on accelerating the implementation of construction guarantee system in house building and municipal infrastructure projects in order to implement the Notice of the General Office of the State Council on Reviewing and Regulating the Security Payment in the Construction Industry (No. 49 [2016] of the General Office of the State Council), the Opinions of the General Office of the State Council on Promoting the Sustained and Sound Development of the Construction Industry (No. 19 [2017] of the General Office of the State Council), the Opinions of the General Office of the State Council on the Implementation of the Comprehensive Reform in Approval System of Construction Projects (No. 11 [2019] of the General Office of the State Council), further optimize the business environment, strengthen the interim and ex post supervision, and protect the lawful rights and interests of all parties to a construction project. | | 工程担保是转移、分担、防范和化解工程风险的重要措施，是市场信用体系的主要支撑，是保障工程质量安全的有效手段。当前建筑市场存在着工程防风险能力不强，履约纠纷频发，工程欠款、欠薪屡禁不止等问题，亟需通过完善工程担保应用机制加以解决。为贯彻落实《国务院办公厅关于清理规范工程建设领域保证金的通知》（国办发〔2016〕49号）、《国务院办公厅关于促进建筑业持续健康发展的意见》（国办发〔2017〕19号）、《国务院办公厅关于全面开展工程建设项目审批制度改革的实施意见》（国办发〔2019〕11号），进一步优化营商环境，强化事中事后监管，保障工程建设各方主体合法权益，现就加快推进房屋建筑和市政基础设施工程实行工程担保制度提出如下意见。 |
