Building pilot free trade zones is a strategic measure of the CPC Central Committee and the State Council to comprehensively deepen reform and further open up under new conditions. Since the launch of China (Fujian) Pilot Free Trade Zone (hereinafter referred to as the “FTZ”), process achievements have been made in the building, and expected objectives have been generally accomplished. For the purposes of implementing the decisions and arrangements of the CPC Central Committee and the State Council, further deepening the reform and opening up of the FTZ, and expanding the cross-strait exchange and cooperation in economy and culture, this Plan was developed. 建设自由贸易试验区是党中央、国务院在新形势下全面深化改革和扩大开放的战略举措。中国(福建)自由贸易试验区(以下简称自贸试验区)运行以来,建设取得阶段性成果,总体达到预期目标。为贯彻落实党中央、国务院决策部署,进一步深化自贸试验区改革开放,扩大两岸经济文化交流合作,制定本方案。
I. General requirements   一、总体要求
1. Guiding ideology. The great banner of socialism with Chinese characteristics shall be held high, the spirit of the 19th CPC National Congress shall be fully implemented, Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era shall be regarded as guidance, the decisions and arrangements of the CPC Central Committee and the State Council shall be carried out, the overall advancement of the overall layout for "economic, political, cultural, social, and ecological progress" and the coordinated advancement of the Four-Pronged Comprehensive Strategy shall be conducted, the general work keynote of seeking progress while keeping performance stable shall be adhered to, the new development concept shall be firmly practiced, the supply-side structural reform shall be adhered to as the main line, system innovation shall be used as the core, risk prevention and control shall be taken as the bottom line, the mind shall continue to be liberated, pilot programs shall be conducted, international advanced rules shall be benchmarked against, the FTZ shall be given greater autonomy in the reform, reform, development, and innovation shall be promoted by opening up, and the establishment of a new pattern of opening up shall be boosted; the establishment of a government management system commensurate with the market shall be accelerated, and the level of government governance shall be further raised; the advantages in proximity to the sea and Taiwan shall be used, and a greater role in deepening cross-strait economic cooperation and boosting the building of the 21st Century Maritime Silk Road shall be played; and the integration of reform systems shall be reinforced, and it shall be striven to gain more system innovations susceptible to replication and promotion, so as to better serve the big picture of the nationwide reform and opening up. (一)指导思想。高举中国特色社会主义伟大旗帜,全面贯彻党的十九大精神,以习近平新时代中国特色社会主义思想为指导,贯彻落实党中央、国务院决策部署,统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,坚持稳中求进工作总基调,坚定践行新发展理念,坚持以供给侧结构性改革为主线,以制度创新为核心,以风险防控为底线,继续解放思想、先行先试,对标国际先进规则,赋予自贸试验区更大改革自主权,以开放促改革、促发展、促创新,推动形成全面开放新格局;加快建立与市场化相适应的政府管理体系,进一步提升政府治理水平;发挥沿海近台优势,在深化两岸经济合作、推动21世纪海上丝绸之路建设方面发挥更大作用;加强改革系统集成,力争取得更多可复制可推广的制度创新成果,更好服务全国改革开放大局。
2. Building objectives. By 2020, a system of regimes connected to generally accepted international investment and trade rules will have been first developed, a law-based, internationalized, and facilitating business environment will have been created, and a comprehensive reform pilot zone integrating opening up with innovation, a demonstration zone for deepening cross-strait economic cooperation, and a new opening up and cooperation height oriented to countries and regions along the 21st Century Maritime Silk Road will have been built. The interaction between the reform in the FTZ and that in Fujian province will have been enhanced, and all tasks of the reform pilot programs with good conditions will have been comprehensively implemented in Fuzhou City, Xiamen City, and Pingtan Comprehensive Pilot Zone or promoted on a trial basis in Fujian province. (二)建设目标。到2020年,率先建立同国际投资和贸易通行规则相衔接的制度体系,形成法治化、国际化、便利化营商环境,打造开放和创新融为一体的综合改革试验区、深化两岸经济合作示范区和面向21世纪海上丝绸之路沿线国家和地区开放合作新高地。强化自贸试验区改革同福建省改革的联动,各项改革试点任务具备条件的在福州市、厦门市和平潭综合实验区范围内全面实施,或在福建省推广试验。
II. Benchmarking against international advanced rules and advancing the reform and innovation in various fields in depth   二、对标国际先进规则,深入推进各领域改革创新
3. Further relaxing investment access. The pre-access national treatment plus negative list administration system for foreign investment shall be further improved, market access shall be greatly relaxed, the service sector shall be further opened up, the openness and transparency of the foreign investment negative list of the FTZ shall be enhanced, and priority shall be given to establishing an interim and ex-post regulation system commensurate with the negative list administrative mode. Differentiated treatment in the aspects such as qualification attainment, bidding and protection of rights and interests shall be reviewed and canceled, so as to enable various market participants to lawfully and equally access related industries, fields and business. National security review, anti-monopoly review, and other relevant work shall be effectively conducted in cooperation. (三)进一步放宽投资准入。进一步完善外商投资准入前国民待遇加负面清单管理制度,大幅度放宽市场准入,扩大服务业对外开放,提高自贸试验区外商投资负面清单的开放度和透明度,着力构建与负面清单管理方式相适应的事中事后监管制度。清理和取消资质资格获取、招投标、权益保护等方面存在的差别化待遇,实现各类市场主体依法平等准入相关行业、领域和业务。配合做好国家安全审查、反垄断审查等相关工作。
4. Improving international trade facilitation. A more facilitating processing trade write-off system shall be explored, and a new type of processing trade regulatory mode with the supply chain as units shall be established. The classification regulation of cargo status shall be put into action in depth, the expansion of the pilot program from logistics and warehousing enterprises to trade, production, and processing enterprises shall be researched, and when conditions are met, the pilot program shall be promoted and implemented in other qualified areas under special customs supervision in Fujian province. The ATA Carnet system shall be promoted and applied. The establishment of a national inspection pilot zone shall be supported to innovate the comprehensive reform measures for integrated inspection and quarantine. The scope of goods with respect to the admission of third-party inspection results shall be expanded. The building of a quality traceability system for import and export products shall be forwarded to achieve the traceability of the information on priority sensitive products in the entire process. The pilot program of the implementation of the mechanism for maritime, transport, and ship inspection departments to jointly grant ship certificates shall be launched. The law enforcement cooperation between port administrative departments shall be strengthened and "one-stop operations" shall be expanded. Two to three qualified enterprises in the FTZ Crude shall be granted qualifications for and quotas on crude oil importation. (四)提升国际贸易便利化水平。探索更为便利的加工贸易核销制度,建立以供应链为单元的新型加工贸易监管模式。深入实施货物状态分类监管,研究将试点从物流仓储企业扩大到贸易、生产加工企业,具备条件时,在福建省其他符合条件的海关特殊监管区域推广实施。推广应用货物暂准进口单证册制度。支持设立国检试验区,创新集成检验检疫综合性改革措施。扩大第三方检验检测结果采信商品范围。推进进出口产品质量追溯体系建设,实现重点敏感产品全过程信息可追溯。试点实施海事、交通、船检三部门联合办理船舶证书机制。加强口岸管理部门执法合作,拓展“一站式作业”。赋予自贸试验区内符合条件的2-3家企业原油进口资质和配额。
5. Creating a high-standard international business environment. With reference to generally accepted international assessment indicators for business environment, reorganization and benchmarking shall be conducted in the establishment of enterprises, work permitting, property rights registration, credit acquisition, investor protection, tax payment, bankruptcy and liquidation, and other aspects, weaknesses shall be found, the reform shall be intensified, and the focus shall be on building a stable, equitable, transparent, predictable, and first-class business environment. (五)打造高标准的国际化营商环境。参照国际通行营商环境评价指标,从企业开办、施工许可、产权登记、信贷获取、投资者保护、纳税、破产清算等方面梳理和对标,查找薄弱环节,加大改革力度,着力构建稳定、公平、透明、可预期的一流营商环境。
6. Further deepening the opening up of and the innovation in the regulation of finance. The Guiding Opinions of the People's Bank of China on Providing Financial Support for China (Fujian) Pilot Free Trade Zone shall be implemented in an active and orderly manner, and the issuance of the implementation plan to support the FTZ in deepening financial opening up and innovation shall be researched. Qualified transnational corporations in the FTZ may, as needed for their own operations, carry out in-house group RMB two-way cross-border currency capital pooling business on a filing basis. The establishment of an account administration system commensurate with the reform and opening up of the FTZ shall be explored. The building of a national fund management service platform focusing on project investment and financing services, among others, shall be supported. The banking financial institutions in the FTZ shall be supported on the premise of compliance and controllable risks in extending credit loans to enterprises. The exchange and cooperation in the financial field with countries and regions along the Belt and Road shall be intensified. The financial regulatory system shall be refined, and the bottom line of non-occurrence of systematic financial risks shall be held. Cross-border fund monitoring systems and mechanisms shall be bettered, the anti-money laundering, anti-terrorist financing, and anti-tax evasion work shall be tightened, cross-border money laundering and terrorist financing risks shall be discovered in a timely manner, and the use of cross-border trade to engage in the criminal activities of money laundering shall be prevented. Local governments shall strengthen the territorial responsibility for risk disposition in accordance with the unified rules of the Central Government on the premise that financial administration is mainly the power of the Central Government. (六)进一步深化金融开放和监管创新。积极有序实施《中国人民银行关于金融支持中国(福建)自由贸易试验区的指导意见》,研究出台支持自贸试验区深化金融开放创新实施方案。自贸试验区内符合条件的跨国公司可根据自身经营需要备案开展集团内跨境双向人民币资金池业务。探索建立与自贸试验区改革开放相适应的账户管理体系。支持建设以项目投融资服务等为重点的全国性基金管理服务平台。支持自贸试验区内银行业金融机构在依法合规、风险可控的前提下,向企业发放信用贷款。加强与“一带一路”沿线国家和地区在金融领域的交流合作。健全金融监管体系,守住不发生系统性金融风险的底线。完善跨境资金监控体制机制,强化反洗钱、反恐怖融资、反逃税工作,及时发现跨境洗钱和恐怖融资风险,防范利用跨境贸易从事洗钱犯罪活动。地方政府要在坚持金融管理主要是中央事权的前提下,按照中央统一规则,强化属地风险处置责任。
7. Reinforcing the support for innovative factors. An error tolerance and correction and positive incentive mechanism shall be established to encourage reform and innovation. The pilot program of "all-in card" of the services for high-level foreign talents shall be launched. The measures such as facilitating the entry and exit, work, stay and residence in China, and permanent residence of high-level foreign talents shall be implemented. The entry and exit visa procedures for business personnel and high-level talents shall be simplified. The reform of the comprehensive management of intellectual property rights shall be explored, the intellectual property right ownership system conducive to encouraging innovation shall be improved, and the system of protection and use of intellectual property rights shall be bettered. (七)强化创新要素支撑。建立容错纠错和正向激励机制,鼓励改革创新。开展外国高层次人才服务“一卡通”试点。实施便利外籍高层次人才出入境、工作、在华停居留、永久居留等措施。简化商务人员、高层次人才出入境签证手续。探索知识产权综合管理改革,完善有利于激励创新的知识产权归属制度,健全知识产权保护和运用体系。
III. Continuing to promote the simplification of administrative procedures and delegation of powers and further raising the level of government governance   三、持续推进简政放权,进一步提升政府治理水平
8. Making government services standard and transparent. The mode of the devolution of provincial administrative power shall be adjusted and improved, and the cancellation, devolution, or delegation of the entire chain of related or similar categories of approval items shall be promoted. More ex-post approval items shall be changed from sequential approval to parallel approval, and more single-item examination and acceptance shall be changed to consolidated examination and acceptance to further reduce inspection, testing, certification, and certification items. The reform of the market access negative list regime shall be deepened. The Comprehensive Approval Information Platform and the National Enterprise Credit Information Publication System shall be improved, the standardization and modularization of administrative approval shall be promoted, and the information sharing and business collaboration among departments shall be strengthened, so as to achieve "one-time collection and one-file management" of the same information. Primary-level supporting materials shall be reviewed and regulated, any such materials shall be canceled if there is no basis in laws and regulations for them, and any such materials required to be retained shall be placed under the list management. The disclosure of decision making, implementation, administration, services, and results and the disclosure of government information in priority fields shall be fully forwarded.

 (八)推进政府服务标准化、透明化。调整完善省级管理权限下放方式,推动关联、相近类别审批事项全链条取消、下放或委托。将更多后置审批事项由串联审批改为并联审批,将更多单项审查与验收改为综合审查与验收,进一步减少检验、检测、认定、认证事项。深化市场准入负面清单制度改革。健全综合审批信息平台和国家企业信用信息公示系统,推行行政审批标准化、模块化,加强部门间信息共享和业务协同,实现相同信息“一次采集、一档管理”。清理规范基层证明材料,没有法律法规依据的一律取消,对确需保留的实行清单管理。全面推进决策、执行、管理、服务、结果公开和重点领域政府信息公开。
