Article 1 For the purposes of regulating and promoting people's procuratorates' assignment and retainment of persons with expertise to participate in case handling, these Provisions are developed in accordance with the provisions of the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China | | 第一条 为了规范和促进人民检察院指派、聘请有专门知识的人参与办案，根据《中华人民共和国刑事诉讼法》《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》等法律规定，结合检察工作实际，制定本规定。 |
| Article 2 For the purposes of these Provisions, “person with expertise” means a person who uses expertise to participate in the case handling activities of the people's procuratorate, and assists in resolving special issues or offers opinions, excluding any person who participates in case handling as the identification expert. | | 第二条 本规定所称“有专门知识的人”，是指运用专门知识参与人民检察院的办案活动，协助解决专门性问题或者提出意见的人，但不包括以鉴定人身份参与办案的人。 |
| For the purposes of these Provisions, “expertise” means the professional and technical knowledge and experience, among others, understood and mastered by personnel in specific fields. | | 本规定所称“专门知识”，是指特定领域内的人员理解和掌握的、具有专业技术性的认识和经验等。 |
| Article 3 The people's procuratorate may assign or retain a person qualified for identification or any other person with professional competence upon the examination of this court to participate in the handling of a case as a person with expertise. | | 第三条 人民检察院可以指派、聘请有鉴定资格的人员，或者经本院审查具备专业能力的其他人员，作为有专门知识的人参与办案。 |
| A person falling under any of the following circumstances shall not participate in the handling of a case as a person with expertise: | | 有下列情形之一的人员，不得作为有专门知识的人参与办案： |
| (1) The identification qualification of the person is canceled, the registration of the identification expert is revoked, any other practicing qualification is revoked, or the person is imposed on the practice suspension punishment in the last three years by the competent department for the violation of professional ethics. | | （一）因违反职业道德，被主管部门注销鉴定资格、撤销鉴定人登记，或者吊销其他执业资格、近三年以内被处以停止执业处罚的； |
| (2) The person has no civil conduct capacity or has limited civil conduct capacity. | | （二）无民事行为能力或者限制民事行为能力的； |
| (3) The person violates any provision of Articles 18 to 21 of these Provisions in the last three years. | | （三）近三年以内违反本规定第十八条至第二十一条规定的； |
| (4) The person has participated in the handling of a case as the case handling person or in any other identity. | | （四）以办案人员等身份参与过本案办理工作的； |
| (5) Any other circumstance where it is inappropriate for a person with expertise to participate in case handling. | | （五）不宜作为有专门知识的人参与办案的其他情形。 |
| Article 4 Where a people's procuratorate retains any person other than the procuratorial authority to participate in the handling of a case as the person with expertise, it shall verify his or her valid identity certificate and the materials which are able to prove that the person satisfies the requirements of paragraph 1, Article 3 of these Provisions. | | 第四条 人民检察院聘请检察机关以外的人员作为有专门知识的人参与办案，应当核实其有效身份证件和能够证明符合本规定第三条第一款要求的材料。 |
| Article 5 Where conditions permit, the people's procuratorate may designate a specific department to be responsible for establishing a list of recommended persons with expertise. | | 第五条 具备条件的人民检察院可以明确专门部门，负责建立有专门知识的人推荐名单库。 |
Article 6 The provisions of the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China, and other laws on the withdrawal of identification experts shall apply to the withdrawal of the person with expertise.
