| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 For purposes of strengthening the protection, supervision and administration of the soil environment of agricultural land, protecting the soil environment of agricultural land, managing and controlling the soil environmental risks of the agricultural land, and guaranteeing the quality and safety of agricultural products, these Measures are developed in accordance with the Environmental Protection Law of the People's Republic of China, the Law of the People's Republic of China on Agricultural Product Quality Safety and other laws and regulations, as well as the Action Plan for the Prevention and Control of Soil Pollution. | | 第一条 为了加强农用地土壤环境保护监督管理，保护农用地土壤环境，管控农用地土壤环境风险，保障农产品质量安全，根据《中华人民共和国环境保护法》《中华人民共和国农产品质量安全法》等法律法规和《土壤污染防治行动计划》，制定本办法。 |
| Article 2 The relevant activities of preventing and controlling soil pollution of agricultural land and the supervision and administration thereof shall be governed by these Measures. | | 第二条 农用地土壤污染防治相关活动及其监督管理适用本办法。 |
| For the purpose of the preceding paragraph, relevant activities of preventing and controlling the soil pollution of agricultural land means the prevention of soil pollution, investigation of soil pollution, environmental monitoring, environmental quality category division, categorized management and other activities. | | 前款所指的农用地土壤污染防治相关活动，是指对农用地开展的土壤污染预防、土壤污染状况调查、环境监测、环境质量类别划分、分类管理等活动。 |
| For the purpose of these Measures, the quality category division and categorized management of the soil environment of agricultural land shall be mainly applicable to cultivated land. Gardens, grasslands and woodlands may be governed, mutatis mutandis, to these Measures. | | 本办法所称的农用地土壤环境质量类别划分和分类管理，主要适用于耕地。园地、草地、林地可参照本办法。 |
| Article 3 The Ministry of Environmental Protection (“MEP”) shall implement unified supervision and administration of the soil environmental protection of agricultural land; and the local competent environmental protection departments at or above the county level shall implement unified supervision and administration of the relevant activities of preventing and controlling soil pollution of agricultural land within their respective administrative regions. | | 第三条 环境保护部对全国农用地土壤环境保护工作实施统一监督管理；县级以上地方环境保护主管部门对本行政区域内农用地土壤污染防治相关活动实施统一监督管理。 |
| The Ministry of Agriculture (“MOA”) shall implement supervision and administration of the safe utilization, strict management and control, treatment and recovery and other work of the soil of agricultural land across the country; and the local competent agricultural departments at or above the county level shall be responsible for organizing the implementation of the safe utilization, strict management and control, treatment and recovery and other work of the soil of agricultural land within their respective administrative regions. | | 农业部对全国农用地土壤安全利用、严格管控、治理与修复等工作实施监督管理；县级以上地方农业主管部门负责本行政区域内农用地土壤安全利用、严格管控、治理与修复等工作的组织实施。 |
| The competent environmental protection departments and competent agricultural departments at or above the county level shall, according to the relevant provisions of these Measures, organize the implementation of the prevention of soil pollution of agricultural land, investigation of soil pollution, environmental monitoring, environmental quality category division, preferential protection of soil of agricultural land, supervision and administration and other work. | | 农用地土壤污染预防、土壤污染状况调查、环境监测、环境质量类别划分、农用地土壤优先保护、监督管理等工作，由县级以上环境保护和农业主管部门按照本办法有关规定组织实施。 |
| Article 4 The MEP shall, in conjunction with the MOA, develop the technical rules on the investigation of soil pollution of agricultural land, environmental monitoring, and environmental quality category division, among others. | | 第四条 环境保护部会同农业部制定农用地土壤污染状况调查、环境监测、环境质量类别划分等技术规范。 |
| The MOA shall, in conjunction with the MEP, develop the technical rules on the safe utilization, strict management and control, treatment and recovery, and treatment and recovery effect assessment, among others, of the soil of agricultural land. | | 农业部会同环境保护部制定农用地土壤安全利用、严格管控、治理与修复、治理与修复效果评估等技术规范。 |
| Article 5 The local competent environmental protection departments and competent agricultural departments at or above the county level shall include the prevention and treatment of soil pollution of agricultural land in the environmental protection plans and agricultural development plans within their respective administrative regions. | | 第五条 县级以上地方环境保护和农业主管部门在编制本行政区域的环境保护规划和农业发展规划时，应当包含农用地土壤污染防治工作的内容。 |
| Article 6 The MEP shall, in conjunction with the MOA and other departments, organize the establishment of the national soil environment management information system for agricultural land (hereinafter referred to as the “environmental information system for agricultural land”), to implement information sharing. | | 第六条 环境保护部会同农业部等部门组织建立全国农用地土壤环境管理信息系统（以下简称农用地环境信息系统），实行信息共享。 |
| The local competent environmental protection departments and competent agricultural departments at or above the county level shall, in accordance with the relevant provisions issued by the state, organize the establishment and utilization of the environmental information system for agricultural land within their respective administrative regions, strengthen the data statistics of the soil environment of agricultural land, improve the files of soil environment of agricultural land, and upload them to the environmental information system for agricultural land on a regular basis, to implement information sharing. | | 县级以上地方环境保护主管部门、农业主管部门应当按照国家有关规定，在本行政区域内组织建设和应用农用地环境信息系统，并加强农用地土壤环境信息统计工作，健全农用地土壤环境信息档案，定期上传农用地环境信息系统，实行信息共享。 |
| Article 7 A professional institution entrusted with the carrying out of the relevant activities of preventing and controlling soil pollution of agricultural land and a third-party institution entrusted with the engagement in treatment and recovery effect assessment shall comply with the relevant environmental protection standards and technical rules, and be responsible for the authenticity, accuracy and completeness of the technical documents issued by them. | | 第七条 受委托从事农用地土壤污染防治相关活动的专业机构，以及受委托从事治理与修复效果评估的第三方机构，应当遵守有关环境保护标准和技术规范，并对其出具的技术文件的真实性、准确性、完整性负责。 |
| A professional institution entrusted with the engagement in treatment and recovery shall comply with the relevant environmental protection standards and technical rules of the state, carry out work within the scope as agreed in the contract, and be responsible for the treatment and recovery activities and the effects thereof. | | 受委托从事治理与修复的专业机构，应当遵守国家有关环境保护标准和技术规范，在合同约定范围内开展工作，对治理与修复活动及其效果负责。 |
| A professional institution entrusted with the engagement in treatment and recovery that practices fraud in treatment and recovery activities and assumes liability for the environmental pollution and ecological damage caused shall assume joint and several liability with other parties responsible for the environmental pollution and ecological damage caused, according to the law, besides accepting penalties according to the relevant laws and regulations. | | 受委托从事治理与修复的专业机构在治理与修复活动中弄虚作假，对造成的环境污染和生态破坏负有责任的，除依照有关法律法规接受处罚外，还应当依法与造成环境污染和生态破坏的其他责任者承担连带责任。 |
| Chapter II Prevention of Soil Pollution | | 第二章 土壤污染预防 |
| Article 8 Enterprises and public institutions and other producers and dealers that discharge pollutants shall take effective measures to ensure that the treatment and disposal of waste water, exhaust emissions and solid waste satisfy the relevant provisions issued by the state and prevent pollution to soil of the surrounding agricultural land. | | 第八条 排放污染物的企业事业单位和其他生产经营者应当采取有效措施，确保废水、废气排放和固体废物处理、处置符合国家有关规定要求，防止对周边农用地土壤造成污染。 |
| Enterprises engaging in storage, transportation and disposal of solid wastes and chemicals shall take measures to prevent leakage, casting and scattering of solid wastes and chemicals to contaminate agricultural land. | | 从事固体废物和化学品储存、运输、处置的企业，应当采取措施防止固体废物和化学品的泄露、渗漏、遗撒、扬散污染农用地。 |
Article 9 The local competent environmental protection departments at or above the county level shall strengthen supervision of the pollution discharge behavior of enterprises, public institutions and other producers and operators, and regard the prevention and control of soil pollution as an important part of environmental law enforcement.
