| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For the purposes of regulating the pricing activities of governments, making the pricing activities of governments more scientific, impartial and transparent, and protecting the lawful rights and interests of consumers and business operators, these Rules are developed in accordance with the Price Law of the People's Republic of China. | | 第一条 为规范政府制定价格行为，提高政府制定价格的科学性、公正性和透明度，保护消费者和经营者的合法权益，根据《中华人民共和国价格法》，制定本规则。 |
| Article 2 These Rules shall apply to the legal setting or adjustment of the prices of and the pricing mechanism for the commodities and services subject to government-guided prices and government pricing by the administrative department of pricing or any other relevant department of the State Council, the administrative department of pricing or any other department of the people's government of a province, autonomous region, or municipality directly under the Central Government, or the people's government of a city or county as authorized by the people's government of a province, autonomous region, or municipality directly under the Central Government (hereinafter referred to as the “pricing authority”). | | 第二条 国务院价格主管部门及有关部门，省、自治区、直辖市人民政府价格主管部门及有关部门，和经省、自治区、直辖市人民政府授权的市、县人民政府（以下简称定价机关）依法制定或者调整实行政府指导价、政府定价的商品和服务价格水平以及定价机制的行为，适用本规则。 |

| Article 3 The state implements and improves the mechanism in which the price is mainly determined by the market. Those subject to government pricing shall primarily include important public utilities, public-welfare services, and commodities and services under natural monopoly, among others, and the specific scope thereof shall be based on the central and regional pricing catalogues (hereinafter referred to as the “pricing catalogues”). | | 第三条 国家实行并完善主要由市场决定价格的机制。政府制定价格的范围主要为重要公用事业、公益性服务和自然垄断经营的商品和服务等，具体以中央定价目录和地方定价目录（以下简称定价目录）为准。 |
| The specific pricing activities of the government of a city or county which has been authorized by the people's government of a province, autonomous region, or municipality directly under the Central Government shall be put under the charge of its subordinate administrative department of pricing or any other relevant department. | | 经省、自治区、直辖市人民政府授权的市、县人民政府制定价格，具体工作由其所属价格主管部门或者有关部门负责。 |
| The pricing authority shall set prices according to its statutory power, and shall not overstep its power in pricing. | | 定价机关应当按照法定的权限制定价格，不得越权定价。 |
| Article 4 The pricing catalogue shall be developed in accordance with legal procedures, with pricing contents and the pricing authority specified item by item, and shall be adjusted at appropriate time according to the social and economic development, and be made public in a timely manner. | | 第四条 定价目录应当依照法定程序制定，逐项明确定价内容和定价机关，并根据经济社会发展情况适时调整，及时向社会公布。 |
| Article 5 The pricing activities shall be conducted under the principles of fairness, openness, impartiality and efficiency. | | 第五条 制定价格应当遵循公平、公开、公正和效率的原则。 |
| Article 6 The pricing activities shall be based on the social average costs of relevant commodities and services, the market demand and supply situation, the requirements for national economy and social development as well as social affordability. Where the price of any commodity or service is closely related to its counterpart in the international market or the price of the substitute, the relevant price may be referred to. | | 第六条 制定价格应当依据有关商品和服务的社会平均成本、市场供求状况、国民经济与社会发展要求以及社会承受能力。商品和服务价格与国际市场价格、替代商品和服务价格联系紧密的，可以参考相关价格。 |
| The price at the link ofnetwork-basednaturalmonopoly shall be set under the principle of “allowablecost plus reasonable income.” | | 网络型自然垄断环节价格，按照“准许成本加合理收益”的原则制定。 |
| Article 7 The administrative department of pricing and other relevant departments of the State Council and the administrative departments of pricing and other relevant departments of the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government shall, according to the characteristics of different industries, gradually establish the pricing mechanisms for commodities and services, and form the price adjustment mechanisms for commodities and prices. | | 第七条 国务院价格主管部门及有关部门，省、自治区、直辖市人民政府价格主管部门及有关部门应当根据不同行业特点，逐步建立商品和服务的定价机制，实现商品和服务价格调整机制化。 |
| Chapter II Pricing Procedures | | 第二章 制定价格的程序 |
| Article 8 The pricing authority shall set prices at appropriate time according to the situation of economic and social development, the feedback from all walks of life and the price execution periods, among others. | | 第八条 定价机关应当根据经济社会发展情况、社会各方面的反映以及价格执行期限等，适时制定价格。 |
| Article 9 The pricing authority shall, when setting prices, undergo such procedures as price investigation, cost supervision and examination or cost investigation, solicitation of social opinions, legitimacy examination, collective deliberation, and decision on pricing, among others. | | 第九条 定价机关制定价格，应当履行价格调查、成本监审或者成本调查、听取社会意见、合法性审查、集体审议、作出制定价格的决定等程序。 |
| The cost supervision and examination, expert argumentation, price hearings and risk evaluation as required by law shall be carried out according to the relevant provisions. | | 依法应当开展成本监审、专家论证、价格听证、风险评估的，按照有关规定执行。 |
| Where the pricing mechanism has been developed in accordance with the law, the pricing authority shall determine the specific prices according to the pricing mechanism. | | 已经依法制定定价机制的，定价机关应当按照定价机制确定具体价格水平。 |
| Article 10 The pricing authority may, when setting prices, require the relevant business operators, industry organizations and relevant government departments to provide the relevant materials as required by the pricing. | | 第十条 定价机关制定价格，可以要求相关经营者、行业组织、政府有关部门提供制定价格所需的资料。 |
Article 11 The pricing authority shall, when setting prices, conduct an investigation into the market supply and demand as well as social affordability, and analyze the impacts on the relevant industries and consumers.
