| In order to effectively guarantee that the defense lawyers of defendants in death penalty review cases exercise their rights to defense according to law and ensure the quality of death penalty review cases, these Measures are formulated in accordance with the Criminal Procedure Law of the People's Republic of China, the Lawyers Law of the People's Republic of China, and other relevant laws and regulations. | | 为切实保障死刑复核案件被告人的辩护律师依法行使辩护权，确保死刑复核案件质量，根据《中华人民共和国刑事诉讼法》《中华人民共和国律师法》和有关法律规定，制定本办法。 |
| Article 1 The defense lawyer in a death penalty review case may consult case filing information with the Case Acceptance Tribunal of the Supreme People's Court. In the consultation, the defense lawyer shall provide his or her name, the title of his or her law firm, the name of the defendant, the cause of action as well as the name of the higher people's court that submits the case for review and the case number. | | 第一条 死刑复核案件的辩护律师可以向最高人民法院立案庭查询立案信息。辩护律师查询时，应当提供本人姓名、律师事务所名称、被告人姓名、案由，以及报请复核的高级人民法院的名称及案号。 |
| Where the Case Acceptance Tribunal of the Supreme People's Court is capable of replying immediately, it shall reply immediately; if it fails to do so, it shall reply within two workdays and the reply shall cover whether the case can be placed on file and the trial tribunal handling the case. | | 最高人民法院立案庭能够立即答复的，应当立即答复，不能立即答复的，应当在二个工作日内答复，答复内容为案件是否立案及承办案件的审判庭。 |
Article 2 Where a lawyer serves as the defense lawyer in a death penalty review case upon authorization of a defendant or the close relatives thereof or upon designation of a legal aid institution, the lawyer shall, within three workday as of the date when he or she accepts the authorization or is designated, handle the relevant formalities at the relevant trial tribunals of the Supreme People's Court.
