For purposes of implementing in depth the spirit of the 18th National Congress of the Communist Party of China ("CPC") and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee and fully using the significant role of lawyers in protecting the lawful rights and interests of the people, resolving conflicts and disputes and promoting social harmony and stability, in accordance with the arrangements and requirements of the CPC Central Committee and the provisions of the Lawyers Law | | 为深入贯彻党的十八大和十八届三中、四中、五中、六中全会精神，充分发挥律师在维护群众合法权益、化解矛盾纠纷、促进社会和谐稳定中的重要作用，根据中央部署要求和《律师法》、《信访条例》等法律法规规定，现就深入开展律师参与信访工作提出如下意见。 |
| I. Significance of deepening the participation of lawyers in public complaints and proposal work | | 一、深入开展律师参与信访工作的重要意义 |
| Lawyers are socialist legal workers and an important force of the comprehensive rule of law. Over recent years, some local governments and departments have introduced lawyers in the participation in public complaints and proposal work and achieved positive social effect. Deepening the participation of lawyers in public complaints and proposal work is helpful to advancing the building of transparent, responsible and legal public complaints and proposals and improving the credibility of public complaints and proposal work; to fully using the occupational advantages of lawyers and third-party role and guiding the people filing public complaints and proposals in expressing their appeals through statutory procedures, solving disputes by legal means and using legal weapons to protect their lawful rights and interests; and to improving the capacity of relevant departments to solve problems and resolve conflicts by legal thinking and methods and enhancing their voluntariness to handle matters in accordance with the law. Justice administrative authorities and public compliant and proposal departments at all levels shall, from the perspective of the comprehensive rule of law and advancement of legal orientation of public complaints and proposals, fully recognize the significance of the participation of lawyers in public complaints and proposal work, vigorously create conditions for the participation of lawyers in public complaints and proposal work, and solidly advance the in depth conduct of the work. | | 律师是社会主义法治工作者，是全面依法治国的重要力量。近年来，一些地方和部门积极引入律师参与信访工作，取得良好的社会效果。深入开展律师参与信访工作，有利于推进阳光信访、责任信访、法治信访建设，提高信访工作公信力；有利于充分发挥律师职业优势和第三方作用，引导信访群众通过法定程序表达诉求、依靠法律手段解决纠纷、运用法律武器维护自身合法权益；有利于提高相关部门运用法治思维和法治方式解决问题、化解矛盾的能力，增强依法办事的自觉性。各级司法行政机关和信访部门要从全面依法治国和推进信访工作法治化的高度，充分认识律师参与信访工作的重要意义，积极为律师参与信访工作创造条件，扎实推动此项工作的深入开展。 |
| II. General requirements | | 二、总体要求 |
| (1) Guiding ideology. We shall comprehensively implement the spirit of the 18th CPC National Congress and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, carry out in depth the spirit of a series of important speeches delivered by General Secretary Xi Jinping, follow the arrangements and requirements made by the CPC Central Committee and the State Council as to the reform of the public complaint and proposal system and deepening the reform of the lawyer system, deepen the participation of lawyers in public complaints and proposal work, guide the people filing complaints and proposals in reasonably expressing appeals in accordance with the law, promote the inclusion of public complaints and proposal work in legal path for resolution, fully use the significant role of lawyers in resolving conflicts and disputes and maintaining social harmony and stability, and make efforts to make new contributions to the accomplishment of the Two Centenary Goals and the Chinese Dream of the great rejuvenation of Chinese nation. | | （一）指导思想。全面贯彻落实党的十八大和十八届三中、四中、五中、六中全会精神，深入贯彻落实习近平总书记系列重要讲话精神，按照中央关于信访工作制度改革和深化律师制度改革部署要求，深入开展律师参与信访工作，引导信访群众依法理性表达诉求，促进把信访纳入法治轨道解决，充分发挥律师在化解社会矛盾纠纷、维护社会和谐稳定中的重要作用，努力为实现“两个一百年”奋斗目标和中华民族伟大复兴的中国梦作出新的贡献。 |

The will of the people filing public complaints and proposals shall be fully respected, no legal services shall be forcibly provided, and no charges shall be collected from the people filing public complaints and proposals.
