In order to encourage domestic applicants to actively apply for patents abroad and protect the fruits of independent innovation, the central treasury has, since 2009, set up special funds for subsidizing e foreign patent applications and formulated the Interim Measures for the Administration of Special Funds for Subsidizing e Foreign Patent Applications (No. 567 [2009] of the Ministry of Finance). Based on the implementation circumstances in the last three years and in order to give full play to the efficiency of fiscal funds and strengthen the administration of fiscal funds, we have modified the Interim Measures for the Administration of Special Funds for Subsidizing Foreign Patent Applications and formulated the Measures for the Administration of Special Funds for Subsidizing Foreign Patent Applications, which are hereby issued to you for compliance and implementation. | |
为支持国内申请人积极向国外申请专利，保护自主创新成果，中央财政从2009年起设立资助向国外申请专利专项资金，并制定了《资助向国外申请专利专项资金管理暂行办法》（财建[2009]567号）。根据三年来的执行情况，为更好地发挥财政资金效益，加强财政资金管理，我们对《资助向国外申请专利专项资金管理暂行办法》做了修改，制定了《资助向国外申请专利专项资金管理办法》。现印发给你们，请遵照执行。 |

| Chapter I General Provisions | | 第一章 总则 |

| Article 1 The central treasury has set up special funds for subsidizing foreign patent applications (hereinafter referred to as "special funds") in accordance with the requirements of the State Council on implementing the national intellectual property strategy in order to encourage domestic applicants to actively apply for patents abroad and protect the fruits of independent innovation. In order to strengthen and regulate the administration of special funds and enhance the fund use benefits, these Measures are formulated in accordance with the relevant provisions of the Budget Law of the People's Republic of China and the detailed rules for its implementation. | | 第一条 根据国务院关于实施国家知识产权战略的要求，为支持国内申请人积极向国外申请专利，保护自主创新成果，中央财政设立资助向国外申请专利专项资金（以下简称专项资金）。为加强和规范专项资金的管理，提高资金使用效益，根据《中华人民共和国预算法》及其实施细则有关规定，制定本办法。 |

| Article 2 The term “domestic applicants” as mentioned in these Measures shall be limited to domestic small- and medium-sized enterprises, public institutions and scientific research institutions that conform with the laws and regulations of the state. The term “foreign patent applications” as mentioned in these Measures refers to the applications for patents abroad made through the Patent Cooperation Treaty (PCT) and the Paris Convention on the Protection of Industrial Property. | | 第二条 本办法所称“国内申请人”，限于符合国家法律法规规定的国内中小企业、事业单位及科研机构。本办法所称“向国外申请专利项目”是指通过专利合作条约（PCT）途径和巴黎公约途径提出的向国外专利申请。 |

| Article 3 Special funds shall be mainly used to subsidize domestic applicants in paying fees when making foreign patent applications, such as, official fees paid to the relevant patent examination institutions at the application stage and within three years from the year the patent is granted, retrieval fees paid to patent retrieval institutions and service fees paid to agencies. | | 第三条 专项资金主要用于资助国内申请人向国外申请专利时向有关专利审查机构缴纳的在申请阶段和授予专利权当年起三年内的官方规定费用、向专利检索机构支付的检索费用，以及向代理机构支付的服务费等。 |

Article 4 Special funds shall mainly support technical fields that comply with the requirements and orientation of the national intellectual property strategy, be conducive to improving independent innovation capabilities, and support the development of high-tech industries and emerging industries in China.
