内地与澳门关于建立更紧密经贸关系的安排


 
Preamble 

前言


The Mainlandi and the Macao Special Administrative Region (hereinafter referred to as the "two parties") decided to sign the Mainland and Macao Closer Economic Partnership Arrangement (hereinafter referred to as the Arrangement) for the purpose of bringing about economic prosperity and development in both of the two parties and strengthening trade and economic relations of the two parties with other countries and regions.
 
为促进内地①(注①:《安排》中,内地系指中华人民共和国的全部关税领土。)和澳门特别行政区(以下简称“双方”)经济的共同繁荣与发展,加强双方与其他国家和地区的经贸联系,双方决定签署《内地与澳门关于建立更紧密经贸关系的安排》》(以下简称“《安排》”)。

 
Chapter I General Provisions 

第一章 总则


   第一条 目标
Article 1Objectives 
通过采取以下措施,加强内地与澳门特别行政区(以下简称“澳门”)之间的贸易和投资合作,促进双方的共同发展:

To strengthen trade and investment cooperation between the Mainland and the Macao Special Administrative Region (hereinafter referred to as "Macao") and bring about joint development of the two parties through the implementation of the following measures:
 

 一、逐步减少或取消双方之间实质上所有货物贸易的关税和非关税壁垒;
(1)progressively reducing or eliminating tariff and non-tariff barriers on substantially all the trade in goods between the two parties; 

 二、逐步实现服务贸易自由化,减少或取消双方之间实质上所有歧视性措施;
(2)progressively realizing liberalization of trade in service through reduction or elimination of substantially all discriminatory measures; 

 三、促进贸易投资便利化。
(3)promoting trade and investment facilitation. 

   第二条 原则
Article 2Principles 
《安排》的达成、实施以及修正应遵照以下原则:

The conclusion, implementation and amendment of the Arrangement shall adhere to the following principles:
 

 一、遵循“一国两制”的方针;
(1)to abide by the principle of "one country, two systems"; 

 二、符合世界贸易组织的规则;
(2)to comply with the rules of World Trade Organization; 

 三、顺应双方产业结构调整和升级的需要,促进稳定和可持续发展;
(3)to accord with the needs of both parties to adjust and upgrade their industries and to promote steady and sustained development; 

 四、 实现互惠互利、优势互补、共同繁荣;
(4)to achieve reciprocity and mutual benefit, mutual complementary advantages and joint prosperity; 

 五、 先易后难,逐步推进。
(5)to take progressively action, dealing with the easier subjects before the more difficult ones. 

   第三条 建立与发展
Article 3Establishment and Development 

 一、双方自2004年1月1日起开始实施《安排》下货物贸易和服务贸易自由化的具体承诺。
(1)The two parties shall implement the specific commitments in liberalization of trade in goods and services under the Arrangement as of January 1, 2004. 

 二、双方将通过不断扩大相互之间的开放,增加和充实《安排》的内容。
(2)The two parties will broaden and enrich the content of the Arrangement through continuous and further reciprocal liberalization between each other. 

   第四条 中国加入世界贸易组织法律文件中特定条款的不适用
Article 4Non-application of specific provisions in China's WTO Accession Legal Documents 
双方认识到,内地经过20多年的改革开放,市场经济体制不断完善,内地企业的生产与经营活动已经符合市场经济的要求。双方同意《中国加入世界贸易组织议定书》第15条和第16条,以及《中国加入世界贸易组织工作组报告书》第242段的内容不再适用于内地与澳门之间的贸易。

The two parties recognize that through over two decades' reform and opening up, the market economy system the Mainland has been continuously improving, and the mode of production and operation of Mainland enterprises is in line with the requirements of a market economy. The two parties agree that Articles 15 and 16 of the Protocol on the Accession of the People's Republic of China to the World Trade Organization and Paragraph 242 of the Report of the Working Group on the Accession of the People's Republic of China to the World Trade Organization will not be applicable to trade between the two parties.
 

 

第二章 货物贸易

Chapter II Trade in Goods   第五条 关税

 
Article 5Tariffs 一、澳门将继续对原产内地的所有进口货物实行零关税。

 
(1)Macao will continue to apply zero tax to all imported goods of Mainland origin. 二、自2004年1月1日起,内地将对附件1中表1列明的原产澳门的进口货物实行零关税。

 
(2)The Mainland will apply zero tax to the imported goods of Macao origin listed in Table 1 of Annex 1 as of January 1, 2004. 三、不迟于2006年1月1日,内地将对附件1中表1以外的原产澳门的进口货物实行零关税。具体实施步骤载于附件1。

 
(3)The Mainland will apply zero tax to the imported goods of Macao origin that are not in Table 1 of Annex 1 no later than January 1, 2006. The detailed implementation procedures are set out in Annex 1. 四、任何根据本条第三款取消进口关税的货物应补充列入附件1中。

 
(4)Any goods whose import tariffs are eliminated in accordance with paragraph 3 of this Article shall be added to Annex 1.   第六条 关税配额和非关税措施

 
Article 6Tariff Rate Quota and Non-tariff Measures 一、一方将不对原产于另一方的进口货物采取与世界贸易组织规则不符的非关税措施。

 
(1)Neither party shall apply non-tariff measures that don't comply with the rules of the World Trade Organization to the imported goods originated from the other party. 二、内地将不对原产澳门的进口货物实行关税配额。

 
(2)The Mainland will not apply tariff rate quota to the imported goods of Macao origin.   第七条 反倾销措施

 
双方承诺一方将不对原产于另一方的进口货物采取反倾销措施。
Article 7Antidumping Measures 

The two parties undertake that neither party shall apply antidumping measures to the imported goods originated from the other party.
   第八条 补贴与反补贴措施

 
双方重申遵守世界贸易组织《补贴与反补贴措施协定》及《1994年关税与贸易总协定》第16条的规定,并承诺一方将不对原产于另一方的进口货物采取反补贴措施。
Article 8Subsidies and Countervailing Measures 

The two parties reiterate to comply with the Agreement on Subsidies and Countervailing Measures of the World Trade Organization and Article XVI of the General Agreement on Tariffs and Trade 1994, and undertake not to apply countervailing measures to the imported goods originated from each other.
   第九条 保障措施

 
如因《安排》的实施造成一方对列入附件1中的原产于另一方的某项产品的进口激增,并对该方生产同类或直接竞争产品的产业造成严重损害或严重损害威胁,该方可在以书面形式通知对方后临时性地中止该项产品的进口优惠,并应尽快应对方的要求,根据《安排》第十九条的规定开始磋商,以达成协议。
Article 9Safeguards 

If one party's import of one product listed in Annex 1 and originated from the other party increases sharply because of the implementation of the Arrangement and has caused serious injury or threat of serious injury to the affected side's domestic industry that produces like or directly competitive products, the affected party may temporarily suspend concessions on the import of the concerned product from the other party after giving written notice, and shall, at the request of the other party, promptly commence consultations under Article 19 of the Arrangement in order to reach an agreement.
 

第三章 原产地


   第十条 原产地规则
Chapter III Origin 

 一、适用于《安排》下货物贸易优惠措施的原产地规则载于附件2。
Article 10Rules of Origin 

 二、为保证货物贸易优惠措施的实施,双方决定建立和加强行政互助,包括制订和实施严格的原产地证签发程序,建立核查监管机制,实行双方发证和监管机关联网、电子数据交换等措施,具体内容载于附件3。
(1)The rules of origin applicable to preferential measures related to trade in goods under the Arrangement are set out in Annex 2. 

 

第四章 服务贸易

(2)In order to ensure the implementation of the preferential measures regarding trade in goods, the two parties decide to establish and strengthen mutual administrative assistance, including the establishment and strict implementation of the procedures for issuing certificates of origin, the establishment of auditing and regulatory mechanisms, the development of computer link and electronic data interchange between the issuing and regulatory authorities of both parties. Details are set out in Annex 3.   第十一条 市场准入

 
Chapter IV Trade in Services 一、一方将按照附件4列明的内容和时间对另一方的服务及服务提供者逐步减少或取消实行的限制性措施。

 
Article 11Market Access 二、应一方的要求,双方可通过协商,进一步推动双方服务贸易的自由化。

 
(1)Either party shall reduce gradually or eliminate existing restrictive measures against services or service suppliers of the other party in accordance with the content and timetable set out in Annex 4. 三、任何根据本条第二款实行的服务贸易自由化措施应补充列入附件4。

 
(2)At the request of either party, the two parties may further liberalization of trade in services between them through consultation.   第十二条 服务提供者

 
(3)Any measures on liberalization of trade in services implemented in accordance with paragraph 2 of this Article shall be added to Annex 4. 一、《安排》中“服务提供者”的定义及相关规定载于附件5。

 
Article 12Service Suppliers 二、任何世界贸易组织其他成员的服务提供者,如系根据一方的法律所设立的法人并在该方从事附件5中规定的“实质性商业经营”,则有权享受另一方在《安排》下给予该方服务提供者的优惠。

 
(1)The definition of "service suppliers" and relevant provisions under the Arrangement are set out in Annex 5.   第十三条 金融合作

 
双方采取以下措施,进一步加强在银行、证券和保险领域的合作:
(2)Service suppliers of other members of the World Trade Organization that are legal persons established under the laws of one party and are engaged in substantive business operations as stipulated in Annex 5 in the area of the said party will be entitled to preferential treatments granted by the other party under the Arrangement. 

 一、支持内地金融机构到澳门开展业务;
Article 13Financial Cooperation 

The two parties shall adopt the following measures to further strengthen cooperation in the fields of banking, securities and insurance:
 二、支持内地银行在澳门以收购方式发展网络和业务活动;

 
(1)The two parties support Mainland financial institutions in developing business in Macao; 三、鼓励、协助和支持澳门与内地银行、证券和保险机构之间的业务交流;

 
(2)The two parties support Mainland banks in developing network and business in Macao through acquisition; 四、加强金融监管部门之间的合作和信息共享。

 
(3)The two parties encourage, assist and support business exchanges between banking, securities and insurance institutions of Macao and the Mainland;   第十四条 旅游合作

 
(4)The two parties strengthen cooperation and information sharing between the financial regulatory authorities. 一、为进一步促进澳门旅游业的发展,内地允许北京市、上海市和广东省的广州市、深圳市、珠海市、东莞市、中山市、江门市、佛山市、惠州市的居民个人赴澳门旅游,并不迟于2004年7月1日在广东省全省范围实施。

 
Article 14Cooperation in Tourism 二、双方加强在旅游宣传和推广方面的合作,包括促进相互旅游以及开展以珠江三角洲为基础的对外推广活动。

 
(1)For the purpose of further promoting the development of the tourism industry in Macao, the Mainland will allow residents in Beijing, Shanghai, and Guangzhou, Shenzhen, Zhuhai, Dongguan, Zhongshan, Jiangmen, Foshan, and Huizhou of Guangdong Province to visit Macao individually. This measure shall be implemented in the entire Guangdong Province no later than July 1, 2004. 三、通过合作,提高双方旅游行业的服务水平,保障游客的合法权益。

 
(2)The two parties shall strengthen cooperation in tourism promotion, including promotion of to tourism between each other and external promotion programmes centered around the Pearl River Delta.   第十五条 专业人员资格的相互承认

 
(3)The two sides shall cooperate to raise the service standards their tourism industries and protect the legitimate rights and interests of tourists. 一、双方鼓励专业人员资格的相互承认,推动彼此之间的专业技术人才交流。

 
Article 15Mutual Recognition of Professional Qualifications 二、双方主管部门或行业机构将研究、协商和制订相互承认专业人员资格的具体办法。

 
(1)The two parties shall encourage mutual recognition of professional qualification and promote the exchange of professional talents between each other. 

第五章 贸易投资便利化


   第十六条 措施
(2)Competent authorities or professional bodies of both parties will study and design specific methodologies mutual recognition of professional qualifications through consultation. 
双方通过提高透明度、标准一致化和加强信息交流等措施与合作,推动贸易投资便利化。

 
Chapter V Trade and Investment Facilitation   第十七条 合作领域

 
Article 16Measures 一、双方将在以下领域加强合作:

The two parties shall promote trade and investment facilitation by through greater transparency, standard conformity and enhanced exchange of information.
 

 1.贸易投资促进;
Article 17Fields of Cooperation 

 2.通关便利化;
(1)The two parties shall strengthen cooperation in the following fields: 

 3.商品检验、动植物检验检疫、食品安全、卫生检疫、认证认可及标准化管理;
(i)trade and investment promotion; 

 4.电子商务;
(ii)customs clearance facilitation; 

 5.法律法规透明度;
(iii)commodity inspection, sanitary and phytosanitary inspection and quarantine, food safety, health quarantine, certification and accreditation, and administration standardization; 

 6.中小企业合作;
(iv)electronic commerce; 

 7.产业合作。
(v)transparency in laws and regulations; 

 二、本条第一款所列领域的具体合作内容载于附件6。
(vi)cooperation between small- and medium-sized enterprises; 

 三、应一方的要求,双方可通过协商,增加贸易投资便利化的合作领域或内容。
(vii)cooperation of industries. 

 四、任何根据本条第三款增加的领域或内容应补充列入附件6。
(2)Details on the fields of cooperation listed in paragraph 1 of this Article are set out in annex 6. 

 

第六章 其他条款

(3)At the request of either party, the two parties may expand the scope and content of cooperation in trade and investment facilitation through consultation.   第十八条 例外

 
《安排》及其附件所载规定并不妨碍内地或澳门维持或采取与世界贸易组织规则相一致的例外措施。
(4)Any new cooperation fields or content concluded under paragraph 3 of this Article shall be added to Annex 6. 

   第十九条 机构安排
Chapter VI Other Provisions 

 一、双方成立联合指导委员会(以下简称“委员会”)。委员会由双方高层代表或指定的官员组成。
Article 18Exceptions 

The Arrangement and the provisions in its annexes shall not affect the ability of the Mainland or Macao to maintain or to adopt exception measures which are in line with the rules of the World Trade Organization
 二、委员会设立联络办公室,并可根据需要设立工作组。联络办公室分别设在中央人民政府商务部及澳门特别行政区政府经济财政司司长办公室。

 
Article 19Institutional Arrangements 三、委员会的职能包括:

 
(1)The two parties shall establish a Joint Steering Committee (hereinafter referred to as the "Committee"). The Committee shall comprise senior representatives or officials designated by the two parties. 1.监督《安排》的执行;

 
(2)Liaison offices shall be set up under the Committee. Working groups may be set up as the need arises. Liaison offices shall be set up in the Ministry of Commerce of the Central People's Government and Director General's Office of the Economic and Financial Department of the Macao Special Administrative Region respectively. 2.解释《安排》的规定;

 
(3)The functions of the Committee include: 3.解决《安排》执行过程中可能产生的争议;

 
(i)supervising the implementation of the Arrangement; 4.拟订《安排》内容的增补及修正;

 
(ii)interpreting the provisions of the Arrangement; 5.指导工作组的工作;

 
(iii)settling disputes that may arise during the implementation of the Arrangement; 6.处理与《安排》实施有关的任何其他事宜。

 
(iv)drafting additions and amendments to the content of the Arrangement; 四、委员会每年至少召开一次例会,并可在一方提出要求后30天内召开特别会议。

 
(v)steering the work of the working groups; 五、双方将本着友好合作的精神,协商解决《安排》在解释或执行过程中出现的问题。委员会采取协商一致的方式作出决定。

 
(vi)dealing with any other business relating to the Arrangement.   第二十条 杂项

 
(4)The Committee shall convene meetings at least once a year, and may convene special meetings within 30 days upon request by either party. 一、除非《安排》另有规定,依据《安排》采取的任何行动不应影响或废止一方依据其作为缔约方在其他协议下所享受的权利和承担的义务。

 
(5)The two parties shall settle any problems arising from the interpretation or implementation of the Arrangement through consultation in the spirit of friendly cooperation. 二、双方应努力避免增加影响实施《安排》的限制性措施。

 
Article 20Miscellaneous   第二十一条 附件

 
《安排》的附件构成《安排》的组成部分。
(1)Unless otherwise provided in the Arrangement, any action taken under it shall not affect or nullify either party's rights and obligations under other agreements to which it is a contracting party. 

   第二十二条 修正
(2)The two parties shall try to avoid adding any restrictive measures affecting the implementation of the Arrangement. 
根据需要,双方可以书面形式修正《安排》或附件的内容。任何修正在双方授权的代表签署后正式生效。

 
Article 21Annexes   第二十三条 生效

The Annexes to the Arrangement form an integral part of the Arrangement.
 
《安排》自双方代表正式签署之日起生效。

 
《安排》以中文书就,一式两份。
Article 22Amendments 
《安排》于二○○三年十月十七日在澳门签署。

If necessary, the two parties may amend the provisions of the Arrangement or its Annexes in writing. Any amendment shall not come into effect officially until the authorized representatives of both parties have signed it.

关于货物贸易零关税的实施

The Arrangement shall be signed on October 17, 2003 in Macao.

   三、内地自2004年1月1日起分阶段对原产澳门的进口货物实行零关税。“原产澳门的进口货物”指符合《安排》附件2规定的货物。澳门经济局按照澳门有关法规的有关规定签发《安排》下的原产地证书。进口享受《安排》中零关税的货物时,进口人应按照《安排》附件3的规定向内地海关提交澳门经济局签发的原产地证书。

   四、自2004年1月1日起,内地将对本附件表1列明的原产澳门的进口货物实行零关税。表1是本附件的组成部分。内地税则税目调整时,表1的税则号相应进行转换。澳门的生产企业提出要求享受零关税货物的申请时,应依照当年的内地税则号提出。

Apendix 6 Concernig the Facilitation of Trade and Investment(omitted)
 
   五、不迟于2006年1月1日,内地将对本附件表1以外的原产澳门的进口货物实行零关税。具体实施步骤如下:
 
 (一)申请和核查
 
 1. 自2004年1月1日起,澳门的生产企业可按澳门特别行政区政府的有关规定,向澳门经济局提出要求享受零关税货物的申请。
 
 2. 申请企业应向澳门经济局提供货物名称和生产能力或预计生产情况的资料和数据。
 
 3. 澳门经济局应对申请企业提供的资料和数据进行核查和认定,按照现有生产货物和拟生产货物分别汇总。
 
 (二)确认和磋商
 
 1. 每年6月1日前,澳门经济局应将其分别汇总的货物名称、生产能力或预计生产情况的资料和数据提交商务部。
 
 2. 商务部在收到澳门经济局提交的上述材料后,应会同内地有关部门与澳门经济局在当年8月1日前共同核定和确认货物清单。
 
 3. 货物清单确认后,海关总署应与澳门经济局就有关货物的原产地标准进行磋商。双方应于当年10月1日前完成原产地标准的磋商。
 
 (三)公布和实施
 
 1. 对澳门现有生产的货物,根据双方达成的一致意见,内地将货物清单及相应的原产地标准分别补充列入本附件表1和附件2表1。自完成磋商后第二年1月1日起,内地根据澳门经济局签发的原产地证书,准予有关货物按照《安排》零关税进口。
 
 2. 对拟生产的货物,根据双方达成的一致意见,内地应将有关货物的原产地标准补充列入附件2表1。申请企业正式投产后,经澳门经济局核查,由澳门经济局通知商务部,经双方共同确认,内地将有关货物清单补充列入本附件表1。自双方确认后第二年1月1日起,内地根据澳门经济局签发的原产地证书,准予有关货物按照《安排》零关税进口。
 
 3. 双方应于每年12月1日前公布磋商确认的货物清单及原产地标准。
 
 (四)澳门经济局每年6月1日后向商务部提交资料要求享受《安排》零关税的货物,降税安排顺延一年。
 
   六、当因执行本附件对任何一方的贸易和相关产业造成重大影响时,应一方要求,双方应对本附件的有关规定进行磋商。
 
   七、本附件自双方代表正式签署之日起生效。
 
本附件以中文书就,一式两份。
 
本附件于二○○三年十月十七日在澳门签署。
