| Decision of the Ministry of Transport on Amending the Detailed Rules for the Implementation of the Regulation of the People's Republic of China on International Maritime Transportation | | 交通运输部关于修改《中华人民共和国国际海运条例实施细则》的决定 |
| The Ministry of Transport hereby decides to amend the Detailed Rules for the Implementation of the Regulation of the People's Republic of China on International Maritime Transportation (Order No. 9 [2013], Ministry of Transport) as follows: | | 交通运输部决定对《中华人民共和国国际海运条例实施细则》（交通运输部令2013年第9号）作如下修改： |
| I. Article 3 (8), (9) and (13), Article 22, Article 30, Article 33, Article 35, Article 36, Article 43, Article 44, Article 45, Article 46 and Article 64 are deleted. | | 一、删去第三条第（八）项、第（九）项、第（十三）项，第二十二条、第三十条、第三十三条、第三十五条、第三十六条、第四十三条、第四十四条、第四十五条、第四十六条、第六十四条。 |
| II. "Negotiating on and taking charges, issuing bills of lading and other relevant transport documents" in Article 3(1) is amended to read, "negotiating on and collecting passenger ticket fares and freights, issuing passenger tickets and bills of lading and other relevant transport documents, arranging embarkation and disembarkation by passengers." "Port-to-port" in (4)(f) is deleted. "Overseas" is added before "enterprise business registration documents are photocopies" in (12). | | 二、将第三条第（一）项中的“商定和收取运费、签发提单及其他相关运输单证”修改为“商定和收取客票票款和运费、签发客票和提单及其他相关运输单证、安排旅客上下船舶”。删去第（四）项第（6）目中的“港到港”。在第（十二）项的“企业商业登记文件为复印件的”前增加“境外”。 |
| III. "The establishment of enterprise within China to undertake international shipping, or" in paragraph 1, Article 4 is deleted. | | 三、删去第四条第一款中的“在中国境内设立企业经营国际船舶运输业务，或者”。 |
| IV. "The establishment of enterprise within China to undertake international shipping, or" in paragraph 1, Article 5 and (2) are deleted. Paragraph 1(3) is amended to read, "(2) Photocopies of the enterprise business registration document and company bylaws of the applicant." An item is added in paragraph 1 as (4): "(4) Photocopies of required International Ship Security Certificate, Safety Management Certificate, and shipping company safety and pollution prevention capacity compliance certification." A paragraph is added as paragraph 4: "An enterprise with a Business Permit for International Vessel Transportation shall, within the period of running international vessel transportation business, ensure that the relevant certificates and certification as set out in this Article remain lawful and valid." | | 四、删去第五条第一款中的“在中国境内设立企业经营国际船舶运输业务，或者”和第（二）项。将第一款第（三）项修改为“（二）申请人的企业商业登记文件、公司章程的复印件”。在第一款中增加一项作为第（四）项“（四）规定的国际船舶保安证书、安全管理证书、航运公司安全与防污染能力符合证明的复印件”。增加一款作为第四款“取得《国际船舶运输经营许可证》的企业在经营国际船舶运输业务期间，应当确保本条所列有关证书、证明持续合法有效。” |
| V. Paragraph 1(2), Article 6 is deleted. Paragraph 1(3) is amended to read, "(2) Photocopies of business registration documents and bylaws of the parent company." "Duplicate" in paragraph 1(4) is amended to read, "Photocopy." "Issuing bills of lading" in paragraph 2 is amended to read, "Issuing passenger tickets or bills of lading." | | 五、删除第六条第一款第（二）项。将第一款第（三）项修改为“（二）母公司的商业登记文件、公司章程的复印件”。将第一款第（四）项中的“副本”修改为“复印件”。将第二款中的“签发提单”修改为“签发客票或者提单”。 |
| VI. Paragraph 1, Article 7 is amended to read, "A foreign-funded enterprise established to run international shipping agency business shall have fixed business premises and necessary business facilities, and have at least two senior business executives with more than three years of experience in international maritime transportation business." Paragraph 2 is amended to read, "An enterprise running international shipping agency business shall, within 30 days following the commencement of the business, file enterprise name, registration place, contact information and other information and a photocopy of the Business License for Enterprise Legal Person with the Ministry of Transport. The Ministry of Transport shall regularly publish the names of international shipping agency business operators at its website or a website which is authorized to do so." | | 六、将第七条第一款修改为“设立外商投资企业经营国际船舶代理业务，应当有固定的营业场所和必要的营业设施，其高级业务管理人员中至少应当有2人具有3年以上从事国际海上运输经营活动的经历。”将第二款修改为“经营国际船舶代理业务的企业，应当在开业后30日内向交通运输部报备企业名称、注册地、联系方式等信息和《企业法人营业执照》复印件。交通运输部定期在其政府网站或者授权发布的网站发布国际船舶代理业务经营者名称。” |

Paragraph 1, Article 8 is amended to read, "A Chinese enterprise legal person which applies for running international ship management business shall file an application with the competent transport department of the people's government of the province, autonomous region or municipality directly under the Central Government where the business is to be run, and application documents shall include:
