城市房地产中介服务管理规定


(Promulgated by Order No. 50 of the Ministry of Construction on January 8, 1996. Amended according to the Decision of the Ministry of Construction on Amending the Provisions on the Administration of Urban Real Estate Intermediary Services of August 15, 2001)

Chapter 1 General Provisions 

第一章 总则   


 
Article 1 In order to strengthen the administration of the urban real estate intermediary services, to maintain the order of the real estate market, and to guarantee the lawful rights and interests of the parties to the real estate activities, these Provisions have been formulated according to the Urban Real Estate Administration Law of the People's Republic of China.   第一条 为了加强房地产中介服务管理,维护房地产市场秩序,保障房地产活动当事人的合法权益,根据《中华人民共和国城市房地产管理法》,制定本规定。

 
Article 2 Whoever engaged in the urban real estate intermediary services shall observe these Provisions.   第二条 凡从事城市房地产中介服务的,应遵守本规定。

The term “real estate intermediary services” used in these Provisions is the general term of the activities including real estate consultation, real estate price evaluation, and real estate broker, etc.
 
本规定所称房地产中介服务,是指房地产咨询、房地产价格评估、房地产经纪等活动的总称。

The term “real estate consultation” used in these Provisions refers to the operations of offering services to the parties to the real estate activities in such aspects as laws and regulations, policies, information, and technologies, etc.
 
本规定所称房地产咨询,是指为房地产活动当事人法律法规、政策、信息、技术等方面服务的经营活动。

The term “real estate price evaluation” used in these Provisions refers to the business operations of measuring and calculating real estates, evaluating the economic value and agency business thereof.
 
本规定所称房地产价格评估,是指对房地产进行测算,评定其经济价值和代理业务的经营活动。

The term “real estate broker” used in these Provisions refers to the business operations of providing real estate information and brokerage service to the trustees.
 
本规定所称房地产经纪,是指为委托人提供房地产信息和居间代理业务的经营活动。

 
Article 3 The administrative department in charge of construction under the State Council shall be responsible for the centralized administration of the real estate intermediary services of the whole country.   第三条 国务院建设行政主管部门归口管理全国房地产中介服务工作。

The administrative departments in charge of construction of the provinces and autonomous regions shall be responsible for the centralized administration of the real estate intermediary services within their respective administrative areas.
 
省、自治区、直辖市建设行政主管部门归口管理本行政区域的房地产中介服务工作。

The administrative departments in charge of construction of the people's governments of the municipalities directly under the Central Government, cities, and counties (hereinafter referred to as the departments of real estate administration) shall be responsible for the administration of the real estate intermediary services within their respect administrative areas.
 
直辖市、市、县人民政府房地产行政主管部门(以下简称房地产管理部门)管理行政区域内的房地产中介服务工作。

 
Chapter 2 Administration of the Qualifications of Intermediary Services Personnel 

第二章 中介服务人员资格管理   


 
Article 4 The personnel engaged in the real estate consultation shall be the professional technical personnel who have the educational background of the middle level or above degree of real estate or relevant trades, and have the professional technical title of the primary level or above relating to the trade of real estate consultation and have obtained the certificates for passing the examinations.   第四条 从事房地产咨询业务的人员,必须是具有房地产及相关专业中等以上学历,有与房地产咨询精力相关的初级以上专业技术职称取得考试合格证书的专业技术人员。

The measures for the examinations for personnel of real estate consultation shall be formulated by the administrative departments of the people's governments of the provinces and the autonomous regions in charge of construction and the departments in charge of real estate administration of the municipalities directly under the Central Government.
 
房地产咨询人员的考试办法,由省、自治区人民政府建设行政主管部门和直辖市房地产管理部门制订。

 
Article 5 The State applies the qualification authentication system for the personnel of real estate price evaluation.   第五条 国家实行房地产价格评估人员资格认证制度。

The personnel of real estate price evaluation are classified as the master valuator of real estate and the valuator of real estate.
 
房地产价格评估人员分为房地产估价师和房地产估价员。

 
Article 6 The master valuator of real estates shall be the personnel that have passed the national uniform examination and the authentication of practice qualification, obtained the Certificate of Practice Qualification of Master valuator of real estates, and obtained the Certificate of Registration of Master valuator of real estates through registration. The personnel that haven't obtained the Certificate of the Registration of Master valuator of real estates may not conduct the operations of real estate evaluation as the master valuator of real estates.   第六条 房地产估价师必须是经国家统一考试、执业资格认证,取得《房地产估 价师执业资格证书》,经注册登记取得《房地产估价师注册证》的人员。未取得《房地产估价师注册证》的人员,不得以房地产估价师的名义从事房地产估价业务。

The examination methods for master valuator of real estates shall be jointly formulated by the administrative department in charge of construction and the department in charge of personnel under the State Council.
 
房地产估价师的考试办法,由国务院建设行政主管部门和人事主管部门共同制定。

 
Article 7 The real estate valuators shall be the personnel who have passed the examination and obtained the Certificate of Post Qualification of Real Estate Valuator. The personnel who haven't obtained the Certificate of Post Qualification of Real Estate Valuator may not conduct the operations of real estate evaluation.   第七条 房地产估价员必须是经过考试并取得《房地产估价员岗位合格证》的人员。未取得《房地产估价员岗位合格证》的人员,不得从事房地产估价业务。

The examination methods for the real estate evaluators shall be formulated by the administrative departments in charge of construction of the people's governments of the provinces and the autonomous regions, and the departments of real estate administration of the municipalities directly under the Central Government
 
房地产估价员的考试办法,由省、自治区人民政府建设行政主管部门和直辖市房地产管理部门制订。

 
Article 8 The real estate brokers shall be the personnel who have passed the examination, gone through the registration and obtained the Certificate of the Qualification of Real Estate Broker. The personnel who haven't obtained the Certificate of the Qualification of Real Estate Broker may not conduct the operations of real estate broker.   第八条 房地产经纪人必须是经过考试、注册并取得《房地产经纪人资格证》的人员。未取得《讲话经纪人资格证》的人员,不得从事房地产经纪业务。

The examination and registration methods for real estate brokers shall be formulated separately.
 
房地产经纪人的考试和注册办法另行制定。

 
Article 9 It is strictly prohibited to forge, alter or transfer the Certificate of Practice Qualification of Master valuator of real estates, the Certificate of Registration of Master valuator of real estates, the Certificate of Post Qualification of Real Estate Valuator and the Certificate of Real Estate Broker.
