| Announcement on Expiry Review Investigations of Countervailing Measures against Imports of Potato Starch Originated in the EU | | 关于对原产于欧盟的进口马铃薯淀粉所适用反补贴措施进行期终复审调查的公告 |
| On September 16, 2011, the Ministry of Commerce issued the Announcement No. 54, deciding to levy countervailing duties against imports of potato starch originated in the EU for a period of five years starting from September 17, 2011. | | 2011年9月16日，商务部发布该年度第54号公告，决定对原产于欧盟的进口马铃薯淀粉实施最终反补贴措施，实施期限为自2011年9月17日起5年。 |
| On July 15, 2016, the Ministry of Commerce received an application for expiry review on countervailing measures from the Potato Starch Special Committee of the China Starch Industry Association on behalf of the industry of potato starch in China. The applicants claimed, if the countervailing measures against the imports of potato starch originated in the EU was terminated, the subsidy to the imports of potato starch originated in the EU and the injury to the industry in China might continue or reoccur, and requested the Ministry of Commerce to rule and maintain the countervailing measures against imports of potato starch originated in the EU. | | 2016年7月15日，商务部收到中国淀粉工业协会马铃薯淀粉专业委员会代表国内马铃薯淀粉产业提交的反补贴措施期终复审申请书。申请人主张，如果终止反补贴措施，原产于欧盟的进口马铃薯淀粉的补贴可能继续或再度发生，对中国国内产业造成的损害可能继续或再度发生，请求商务部裁定维持对原产于欧盟的进口马铃薯淀粉实施的反补贴措施。 |
| In accordance with relevant provisions of the Countervailing Regulations of the People's Republic of China, the Ministry of Commerce has reviewed the qualifications of the applicants, relevant situations of products under investigation and similar products in China, the imports of products under investigation during the period of taking countervailing measures, the likeliness of continuance or re-occurrence of subsidy or injury, and relevant evidence. The existing evidence showed that the applicants complied with the provisions of Article 11, Article 13 and Article 17 of the Countervailing Regulations of the People's Republic of China on industry and industrial representativeness, thus they were qualified to file applications on behalf of the industry of potato starch in China. The Investigation Authority holds that, the claims from the applicants and the prima facie evidence provided comply with the requirements for case-filing of an expiry review. | | 根据《中华人民共和国反补贴条例》有关规定，商务部对申请人资格、被调查产品和中国同类产品有关情况、反补贴措施实施期间被调查产品进口情况、补贴继续或再度发生的可能性、损害继续或再度发生的可能性及相关证据等进行了审查。现有证据表明，申请人符合《中华人民共和国反补贴条例》第十一条、第十三条和第十七条关于产业及产业代表性的规定，有资格代表中国马铃薯淀粉产业提出申请。调查机关认为，申请人的主张以及所提交的表面证据符合期终复审立案的要求。 |
| In accordance with Article 47 of the Countervailing Regulations of the People's Republic of China, the Ministry of Commerce decides to initiate an expiry review against the countervailing measures applicable to the imports of potato starch originated in the EU from September 16, 2016. Relevant matters are hereby announced as follows: | | 根据《中华人民共和国反补贴条例》第四十七条规定，商务部决定自2016年9月16日起，对原产于欧盟的进口马铃薯淀粉所适用的反补贴措施进行期终复审调查。现将有关事项公告如下： |

| According to the proposal of the Ministry of Commerce, the Customs Tariff Commission of the State Council made a decision to continue to levy countervailing duties on the imports of potato starch originated in the EU pursuant to the scope and rate of countervailing duty as released in Announcement No. 54 of 2011 of the Ministry of Commerce during the period of the expiry review. | | 根据商务部建议，国务院关税税则委员会决定，在反补贴措施期终复审调查期间，对原产于欧盟的进口马铃薯淀粉继续按照商务部2011年第54号公告公布的征税范围和税率征收反补贴税。 |

The review period of the subsidy investigation is from April 1, 2015 to March 31, 2016, and the period of industry injury investigation is from January 1, 2012 to March 31, 2016.
